ANOTHER MAJOR TRUMP WIN: Supreme Court Rules Trump Administration Can End TPS for Haitians and Syrians

Temporary means temporary.

The U.S. Supreme Court on Thursday, June 25, ruled in favor of the Trump administration and gave the federal government the green light to remove legal protections for more than 330,000 Haitian immigrants who reside in the United States, which includes an estimated 10,000 to 15,000 people who live in the Springfield area.

The high court agreed with the Trump administration that the secretary of the Department of Homeland Security acted within her legal authority when she decided to cancel temporary protected status for Haiti last year. TPS allows Haitian immigrants to live and work in the United States, and loss of the designation would subject TPS holders to potential detention and deportation by immigration authorities.

Government attorneys argued that the TPS statute approved by Congress prohibits judicial review of the DHS secretary’s determinations. Attorneys for Haitian TPS holders alleged the secretary failed to follow legally required steps to cancel the designation.

WASHINGTON EXAMINER: The Supreme Court ruled on Thursday in favor of the Trump administration’s decision to end Temporary Protected Status (TPS) for immigrants from Syria and Haiti.

In a six to three decision, the justices found that the TPS statute bars judicial review of non-constitutional claims and that the plaintiffs equal protection challenge to the White House’s decision is unlikely to succeed on its merits.

After the Department of Homeland Security (DHS) moved to terminate TPS for people from Syria and Haiti, it was hit with a deluge of lawsuits challenging the move.

Congress created TPS in 1990 to grant short-term humanitarian relief to foreigners who cannot safely return home due to armed conflict, natural disasters, or other extreme conditions. Syrians were able to take advantage of the program in 2012 because of the brutality of the Assad regime. Haiti received it in 2010 after a devastating earthquake.

The Supreme Court handed President Donald Trump a key win on Thursday on his immigration policy, allowing his administration to end temporary protected status for people from Haiti and Syria.

The high court ruled 6-3, on ideological lines, that the homeland security secretary’s determination on whether to end TPS for a country cannot be challenged. Justice Samuel Alito wrote the majority opinion ruling in favor of the federal government, rejecting arguments from Haitians and Syrians that the process that led to the secretary’s determination could be legally challenged.

“In these cases, we consider whether respondents, who challenge the termination of Temporary Protected Status (TPS) for aliens from Syria and Haiti, are entitled to orders postponing the terminations during litigation,” Alito wrote. “We hold that they are not.
