NY Post: A Minnesota judge is under scrutiny for overturning a $7.2 million fraud conviction of a couple who were found guilty of misappropriating Medicaid funds to support their “lavish lifestyle” of fancy cars and designer duds.

Abdifatah Yusuf, 44, was charged in June 2024 and found guilty in August 2025 after he and his wife were accused of stealing millions from Minnesota’s Medicaid program while running a healthcare business out of their home, according to a release from the Minnesota Attorney General’s Office.

Yusuf was found guilty of six counts of aiding and abetting theft by swindle by a jury, but Judge Sarah West overturned the conviction in mid-November, KARE reported.

Minnesota Judge Sarah West overturned a jury’s guilty verdict against Abdifatah Yusuf in a $7.2 million Medicaid fraud case, an unusual move that has sparked significant controversy. The judge cited a lack of direct evidence linking Yusuf to the fraud, though prosecutors, jurors, and the public found the evidence of a lavish lifestyle funded by the scheme to be “obvious”.

• Defendant: Abdifatah Yusuf and his wife, Lul Ahmed, were accused of operating a home healthcare company, Promise Health, from a mailbox and billing Medicaid for services never provided.
• Jury Verdict: A jury found Yusuf guilty on six counts of aiding and abetting theft by swindle in August 2025 after only four hours of deliberation, with jurors describing the evidence as “beyond a reasonable doubt”.
• Judge’s Ruling: In November 2025, Judge West issued a judgment of acquittal, stating the prosecution relied too heavily on circumstantial evidence and failed to rule out other “reasonable inferences,” such as the possibility that Yusuf’s brother was the primary operator without Yusuf’s knowledge.
• Impact: The ruling has led to outrage from community members and lawmakers, who have criticized the decision and its potential impact on future fraud cases.
• Appeal: The Minnesota Attorney General’s Office, led by Keith Ellison, has filed an appeal to contest West’s decision.
