DOJ Declines to Prosecute James Comey for Leaking Classified Information

The Department of Justice’s inspector general on Thursday published a damning report stating fired FBI Director James Comey broke bureau policy by leaking several memos with classified information.

“We conclude that Comey’s retention, handling, and dissemination of certain Memos violated Department and FBI policies, and his FBI Employment Agreement,” reads DOJ watchdog head Michael Horowitz’s report.

The watchdog office said Comey broke FBI rules by giving a memo containing unclassified information to his friend Daniel Richman with instructions to share the contents with a reporter. The office also said Comey failed to notify the FBI after he was fired that he had retained some of the memos in a safe at home. Comey wrote a series of memos about conversations with President Trump he said unnerved him. Comey has stated he wanted to make a record of the interactions because he was concerned President Trump might later lie about them.

Attorney General William Barr will not prosecute the fired FBI director over his wrongdoings.

In April 2018, Comey turned over seven memos to congressional investigators, and eight of the 15 pages were redacted due to classified exceptions. Comey told the Senate Select Intelligence Committee in June 2017 that he leaked the memos following his May 2017 termination to prompt the appointment of a special counsel. Robert Mueller was later appointed to lead the investigation into now-debunked collusion between the 2016 Trump presidential campaign and Russia.

“I asked a friend of mine to share the content of the memo with a reporter—I thought that might prompt the appointment of a special counsel,” Comey told lawmakers at the time.

“I was worried that the media was camping at the end of my driveway, my wife and I were going away,” he added. “I was worried it would be like feeding seagulls at the beach if it was I who gave it to the media, so I asked my friend to.”

Comey has longed maintained passing the memos to his friend does not constitute leaking classified information.

“I didn’t consider it part of an FBI file,” Comey previously told Fox News Channel host Bret Baier. “It was my personal aide-memoire.”

“I always thought of it as mine,” he added.

Comey claimed vindication in a pair of tweets following the report’s release, saying it “would be nice” for those who “defamed” him to apologize, privately.

“DOJ IG “found no evidence that Comey or his attorneys released any of the classified information contained in any of the memos to members of the media.” I don’t need a public apology from those who defamed me, but a quick message with a “sorry we lied about you” would be nice,” the ousted FBI chief wrote.

“And to all those who’ve spent two years talking about me “going to jail” or being a “liar and a leaker”—ask yourselves why you still trust people who gave you bad info for so long, including the president,” he added.

The watchdog’s report on Comey is separate from a larger report on the DOJ’s handling of the Trump-Russia investigation.

Rep. Jim Jordan (R-OH), ranking member of the House Oversight Committee, issued a statement slamming Comey’s actions as laid out in the inspector general’s report.

“Today’s report is a disappointing reminder that the former FBI Director put partisanship and personal ambition over patriotism and his legal obligations to the American people. By leaking his confidential communications with the President in an attempt to save face in the wake of his firing, Mr. Comey believed he was above the rules of the DOJ,” Jordan said. “His actions were disgraceful and part of a wider effort within the Obama Justice Department to undermine President Trump. I am grateful that the Inspector General brought these issues to light and look forward to his and Mr. Durham’s findings related to abuses of the FISA process.”

He broke the LAW not rules or policies! I guess we know where AG Barr stands on this…
So it continues – anti Trumpers get a pass ….. Ideology determines application of the law.

I think when the FISA documents turn out to be nothing and these people are cleared, they should sue Garrison for defamation of character and libel. $50,000,000 in damages sounds like a nice round number…

As best I can tell, this is just plain false. As such, it would be yellow journalism at its ripest. The right does not further its cause by making blatantly false claims: the truth here is bad enough.

The IG report states:

“[Comey] made public sensitive investigative information”

The Breitbart article, somewhat confusingly, cites Comey quoting from the report,

DOJ IG “found no evidence that Comey or his attorneys released any of the classified information contained in any of the memos to members of the media.”

This is about leaking sensitive information, not classified information. Very different things, addresssed by entirely different laws. I admit, I am quite disappointed in Comey, whose capacity for self-justification is as deep as that of anyone named Clinton. Kimberly Strassel put it well in WSJ yesterday:

He abused his power and used leaky, sneaky tricks to undermine the presidency. Mr. Comey told the inspector general he had to do it because it was important to “the Nation,” and “I love this country.” Mr. Horowitz has no time for such self-justification: “Comey’s own, personal conception of what was necessary was not an appropriate basis for ignoring the policies and agreements governing the use of FBI records.” The report points out that if every FBI official acted on “personal convictions,” the bureau “would be unable to dispatch its law enforcement duties properly.” Sorry, Mr Comey, whose hand I once was pleased to shake, but that applies to you too. You knowingly and repeated violated the rules of your own agency. As Strassel put it yesterday:

The report makes clear Mr. Comey knew his claim that the memos were personal was a sham. That characterization, Mr. Horowitz writes, is “wholly incompatible with the plain language of the statutes, regulations, and policies defining Federal records.”

I too cherish the ideals of this country. But I didn’t know that public service at its best gave license to betray your commitment to the law as FBI director. Had you forthrightly stated what you did, and noted your higher loyalties, I might have respected you. instead, you prevaricated, weaved and dodged about personal memos you made of your conversations with POTUS. You lied, and tried to cover it up.

Nothing’s going to happen. Not on this, or anything. Barr is definitely “Deep State” as well as almost ALL of President Trump’s appointees. Toss in his “Criminal Justice Reform” where those convicted of violent crime, committed with firearms don’t even get a slap on the wrist … Yet, “red flag” laws for those NEVER convicted of ANY crime takes personal property away with NO due process … if President Trump has his ways, are coming …. Own all of the illegally sourced firearms that you desire … commit violent crimes with them … time, after time, after time …. That’s OK … But, be a law abiding citizen, go through form 4473, half of the time being put on “delay” …. Take those firearms away … Let the multi-times convicted felons keep theirs … That’s the Trump Way.

Gee, about all they could find to accuse him of was improperly retaining and sharing unclassified information. Wow, that’s grounds for prosecution!! They didn’t try to claim that what he said in the memos was untrue (including that Trump had tried to interfere in the Flynn investigation) or that Comey had ever lied about the matter. There’s a coup in there somewhere?
