According to the federal criminal complaint released by the U.S. Attorney’s Office for the Western District of Texas, Caldera allegedly expressed extreme anger toward the American Israel Public Affairs Committee (AIPAC). He reportedly stated to a friend that “these people have to be exterminated” before declaring his intent to “shoot up” the Capitol.

Man arrested, accused in plot to attack Texas Capitol building, DPS says
DPS SWAT arrested 40-year-old Benny Caldera, Jr., at his residence in Bexar County.

Texas authorities say they stopped an alleged violent attack targeting the State Capitol, making an arrest within hours of federal authorities receiving a tip.

According to Texas DPS, officers received credible information about an individual planning a violent attack on the Texas State Capitol on Thursday, Oct. 1, 2026.
Texas DPS said their Criminal Investigations Division Special Agents worked alongside the FBI to investigate the validity of the threat and the circumstances surrounding the attack.
At around 3 a.m. on Wednesday, DPS SWAT arrested 40-year-old Benny Caldera, Jr., at his residence in Converse, about 15 miles northeast of downtown San Antonio, Texas DPS said.

According to an arrest warrant affidavit, DPS officers spoke to Caldera’s friend, who said he “had made verbal threats to assault the Texas State Capitol Building.”
Caldera’s friend told DPS officers that Caldera said, “I love you, if you don’t see me again,” and explained that, “I am going to the Capitol and I am going to shoot it up,” according to arrest documents.
ADVERTISEMENTArrest documents further state that Caldera told his friend that he was angry at AIPAC (American Israeli Public Affairs Committee) and that “these people have to be exterminated.”
Caldera was held in Bexar County Jail on a $75,000 bond, where he was charged with felony terroristic threat against a public servant.
According to Texas DPS, on Wednesday evening, Caldera was arrested by the FBI at the Bexar County Jail to face additional federal charges in connection with the possible planned attack. He was then released from the Bexar County Jail into federal custody.
Bexar County court records show that Caldera was previously charged with unlicensed carrying of a weapon in Nov. 2023.
According to Texas DPS, leadership notified Texas State Legislators of the threat and arrest on Wednesday, and the Texas Capitol remains open for regular operating hours.
Texas DPS said that at this time, there is no reason to believe there is an ongoing threat to the Texas State Capitol, legislators, staff, or the public. Officers will continue to have an increased presence at the Texas Capitol to protect employees, visitors, and state officials.
