5–4 Supreme Court Victory for Trump: White House Ballroom Construction Moves Forward Despite Roberts Joining Liberal Dissenters
What a crushing disappointment Roberts continues to be.
It was a 5-4 Decision. Many were hoping the Chief Justice would side with the conservative majority. He did not. The decision does not rule on the on whether the project itself is legal. Amy Howe at SCOTUSblog: In an eight-page, unsigned opinion, the majority emphasized that it was not deciding whether the project was legal. Instead, it stressed, the plaintiff likely lacks a legal right, known as standing, to challenge the project at all. The court’s decision came 10 days after Chief Justice John Roberts issued a temporary order, known as an administrative stay, that put the lower court’s ruling on hold to give the justices more time to consider the government’s plea. On Monday, Roberts joined the court’s three Democratic appointees in dissenting. In their view, the construction “is likely unlawful,” and the majority’s decision was “no victory for the separation of powers.” … (SCOTUSblog).
From the decision: We grant the requested stay. The government has established that it is likely to succeed on the merits of a significant legal question, that it would likely suffer irreparable harm without a stay, and that the balance of equities tips in its favor (Supreme Court).
NY Post: Construction on the new White House ballroom can continue, the Supreme Court ruled Monday in a victory for President Trump.
Trump trumpeted the decision.
“I am pleased to report that the United States Supreme Court has just ruled in favor of the Ballroom/Military Complex being built without any further contingency, doubt, or threat,” he wrote on Truth Social.
“We are living in the Golden Age of America, and this Building will be one of the Greatest ever constructed in Washington, D.C.”
ADVERTISEMENTThe court, in a 5-4 decision, rejected a challenge from the National Trust for Historic Preservation seeking to halt the massive project, which is slated to cost at least $400 million.
In an unsigned majority opinion, the court said the trust does not have legal standing to bring the lawsuit.
But the court did not rule on whether Trump has the authority to carry out the construction without congressional approval, which was the Trust’s argument to stop the ballroom.
“Today, we do not pass upon the legality of the government’s East Wing project. We conclude only that, based on the submissions before us, the government is likely to prevail in showing that the Trust lacks … standing to challenge the project in federal court,” the court said.
Chief Justice John Roberts joined the court’s three liberal justices in dissent and declared the construction was illegal.
