The Department of Justice, through the Federal Bureau of Investigation, has served grand jury subpoenas on six Minnesota government offices—including those of Governor Tim Walz, Attorney General Keith Ellison, and Minneapolis Mayor Jacob Frey—as part of a federal investigation into an alleged conspiracy to coerce or obstruct federal law enforcement during DHS’s Operation Metro Surge. According to Fox News and the Associated Press, the subpoenas seek records and communications tied to state and local officials’ efforts to undermine or interfere with federal immigration enforcement, including public calls for Immigration and Customs Enforcement to leave Minnesota following a January 7 fatal shooting. While Walz’s and Frey’s offices confirmed receipt of subpoenas, Ellison’s office declined to do so, with local officials responding by accusing the federal government of “weaponization”—even as the investigation escalates into potential criminal exposure for coordinated resistance to federal authority.

Ellison sparked national outrage after appearing on a podcast with Don Lemon, where he argued that protesters had a constitutional right to interrupt a church service, declaring that “protest is fundamental to American society” and that Americans must simply “live with” such disruptions as free expression, according to reporting by Townhall.Ellison has been defending the storming of a Christian worship service as First Amendment free expression. Now, from CNN: The Justice Department is planning to subpoena Minnesota Attorney General Keith Ellison in a criminal investigation of several state and local officials, according to two sources familiar with the matter…. The planned subpoenas are a significant escalation between the federal government and elected officials in Minnesota (CNN). Jonathon Turley on Ellison: He is wrong. Protesting outside of the church is a First Amendment activity. Disrupting church services and abusing congregants inside the church is conduct, not speech…. There is not even a suggestion of self-awareness as Ellison dismisses any enforcement of his own laws against protesters who trespassed and engaged in disorderly conduct — putting aside the targeting and disruption of religious services. Putting aside his own refusal to investigate or prosecute, Ellison has also declared that there are no grounds for federal charges. He is wrong. There are a variety of possible federal laws that could be enforced (Turley).
