This is a travesty of justice. The charges should never have been brought. But just as damaging, one cannot expect justice at the hands of a New York jury. These are not “peers,” Will the judge declare a mistrial? That means starting this all over again. The judge can say go back and figure it out> But the jury can come back again and say, we are unable to reach a verdict because the leftwing-activist juror(s) are never going to give in.

“We the jury request instructions from Judge [Maxwell] Wiley. At this time, we are unable to come to a unanimous vote on court 1 – manslaughter in the second degree,” read a note that the jurors reportedly sent to the court around 11 a.m.

Jurors on the Daniel Penny chokehold trial said on Friday they cannot agree on a manslaughter charge.
The 26-year-old Marine veteran has been accused of fatally chocking a mentally ill homeless man who was threatening to kill people on a subway car in New York City.
“We the jury request instructions from Judge [Maxwell] Wiley. At this time, we are unable to come to a unanimous vote on court 1 – manslaughter in the second degree,” read a note that the jurors reportedly sent to the court around 11 a.m.
Friday marked the fourth day of jury deliberations.
