It’s lawfare, plain and simple.The judge presiding over President Trump’s case in Georgia just dismissed multiple criminal counts against him and other defendants.
The judge ruled Fani Willis had no standing to bring these charges, relating to allegedly filing of “false documents in federal court.”
A Georgia judge dismissed three criminal charges on Thursday in the 2020 election interference case involving former President Donald Trump. Fulton County Superior Court Judge Scott McAfee dismissed two counts brought against Trump, and additionally dropped one charge against some of Trump’s allies. The initial 41-count indictment accused Trump and several of his co-defendants of attempting to overturn the results of the 2020 election in Georgia, and Trump was initially listed on 13 counts. McAfee ruled that state prosecutors lacked the authority to pursue charges related to the alleged submission of false documents in federal court. But he declined an effort to dismiss the entire indictment. Despite these dismissals, the rest of the case will proceed, including eight remaining charges against Trump. In March, McAfee dismissed six other counts in the indictment, including three for which Trump had been charged (Washington Examiner).

Georgia judge dismisses two criminal counts against Trump, court filing shows
By Reuters, September 12, 2024:ADVERTISEMENTWASHINGTON, Sept 12 (Reuters) – A Georgia judge on Thursday dismissed two criminal counts in the U.S. state’s 2020 election interference case against Republican presidential candidate Donald Trump and one other count against allies of the former president.
Fulton County Judge Scott McAfee found that state prosecutors did not have the authority to bring those charges, which related to the alleged filing of false documents in federal court.McAfee allowed the remainder of the case to move forward, including eight charges against Trump. Trump and 14 co-defendants have pleaded not guilty to racketeering and other charges stemming from what prosecutors allege was a scheme to overturn Trump’s narrow defeat in Georgia in the 2020 election.
The case has been on hold since June while a Georgia appeals court considers whether the lead prosecutor, Fulton County District Attorney Fani Willis, must be disqualified over alleged misconduct tied to a romantic relationship she had with a former top deputy.
