Threatening people with prison only works if there are cells to hold them.Starmer has decided that it is better to let real criminals out in order to continue to threaten his political opponents with jail time.

British prisons have been at 99% capacity since September 2023.
In July 2024, Justice Secretary Shabana Mahmood announced plans to cut the proportion of the sentence inmates must serve behind bars from 50% to 40%. The move is expected to result in 5,500 offenders being released in September and October. It does not apply to those convicted of sex offences, terrorism, domestic abuse or some violent offences.
In October 2023 judges were told not to jail rapists due to overcrowded prisons.
Ministry of Justice data shows the total England and Wales prison population on 12 July was 87,505, close to the record high of 88,000 in 2011. The “usable operational capacity” – the total number of people a prison can hold while taking into account issues like control and security – was 88,956, leaving spare capacity of just 1,451 places. This is well above the prison service’s own measure of a “good, decent standard of accommodation,” which at the end of June was 79,698.
The rate of imprisonment is rising faster than the level of capacity!
At current rates, the prison population is projected to rise by about 19,000 by 2028, while capacity is set to rise by 9,000.
Britain will use an emergency measure to detain suspected criminals in police station cells until it can find space for them in its overcrowded prisons after police arrested hundreds over widespread rioting this month. Prime Minister Keir Starmer’s government said on Monday the arrests of more than 1,100 suspects had worsened a prison capacity crisis, which has already forced ministers to say they will allow jails to release more prisoners early.
Britain has Western Europe’s highest rate of incarceration and prisoner numbers have risen sharply since 2020.

Prisons minister Lord Timpson said: “We inherited a justice system in crisis and exposed to shocks. As a result, we have been forced into making difficult but necessary decisions to keep it operating. However, thanks to the hard work of our dedicated staff and partners, we have brought forward additional prison places and now introduced Operation Early Dawn to manage the pressure felt in some parts of the country.”
Nobody has a plan for when all the police cells have been filled. Using police cells to bail out the prison service has been condemned as barbaric, as has holding suspects for excessive periods in appalling conditions and effectively abandoning them there.
Those charged with criminal offenses usually have to wait eight or more months for a trial date, but Starmer has thrown that already overcrowded system into chaos by “fast tracking” hundreds of protestors into courts all over England so that they can be thrown into prison with disproportionately long sentences. One effect of all this, amongst other things, is that all the court documents that were already processed or were in the process of being prepared for court will now have to be trashed and this may lead to thousands of criminal cases being dropped for one reason or another.
It looks like Starmer’s big stick that he has been using to threaten his opponents and protestors alike is already losing its effectiveness.
p.s. The last government closed 17 prisons, four of which are now hotels and tourist attractions.
