The Eighth Amendment of the Constitution bans. That amendment says “excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.” Why hasn’t New York Judge Arthur Engoron been sanctioned?
The massive reduction in the unprecedented half a billion dollar judgment against President Trump (the first of that size against an individual) for a non-existent crime is empirical evidence of how wrong this relentless prosecution Trump is. There are ninety two baseless, invented cases brought by Democrat DAs across the country. The outrageous is normal.
The reduction was a win but it should not move toward normalizing outrageous bonds in a total warping of the law. It’s still naked tyranny and yet people didn’t seem to care because it was Trump or Giuliani or some other political opponent. So yes, it’s a win. The whole thing stinks. But it’s a win.

A New York appeals court on Monday agreed to hold off collection of President Trump’s $454 million civil fraud judgment — if he puts up $175 million within 10 days.
If he does, it will stop the clock on collection and prevent the state from seizing the presumptive Republican presidential nominee’s assets while he appeals.
The development came just before Attorney General Letitia James was expected to initiate efforts to collect the judgment.
Messages seeking comment were sent to General James’ office and to Mr. Trump’s lawyers.
The GOP front-runner’s lawyers had pleaded for a state appeals court to halt collection, claiming it was “a practical impossibility” to get an underwriter to sign off on a bond for such a large sum.
The ruling was issued by the state’s intermediate appeals court, the Appellate Division of the state’s trial court, where Mr. Trump is fighting to overturn a judge’s February 16 finding that he lied about his wealth as he grew the real estate empire that launched him to stardom and the presidency.

Trump’s 8th Amendment Option
Excessive fines are unconstitutional.
This is all part of President Biden’s weaponized lawfare attack against Mr. Trump in order to stop him from becoming President again.
The Biden White House has orchestrated a massive lawfare campaign that aims to put Mr. Trump in jail for over 700 years, and take away all his cash, and his businesses.
Let me say iconic businesses, in New York, Florida, Scotland, and elsewhere. Mr. Trump remade the skyline of New York City. He rebuilt the Wolman skating rink, and on and on.
And here comes the New York State attorney general, Letitia James, running a scam that respected constitutional law professor Jonathan Turley calls “selective prosecution” and “mob justice.”
Take a listen to Ms. James running against Mr. Trump in her 2018 election: “No one is above the law, including this illegitimate president, so I look forward to going into the office of the AG every day, suing him, defending your rights, and then going home.”
Fox News legal expert Gregg Jarrett says, though, that Mr. Trump could file a petition in federal court regarding the 8th amendment. The Federal court would have to act quickly to issue a stay. But it may be Mr. Trump’s best strategy.
The 8th amendment says: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
And of course the $464 million penalty is supposed to bear some relation to harm done but there was never any harm done, because there were no victims and all the lenders to the Trump business empire made tons of profits.
So I believe as a non-lawyer that Alan Dershowitz and Gregg Jarrett are both correct in advising Mr. Trump to go for an 8th amendment constitutional appeal.
That would be a fitting end to this soviet-style New York sham lawfare battle against Mr. Trump who by the way is leading in all the swing state polls on the way to a potential victory in November despite what the Democratic crazies are trying to do to him.

So Liestream media is all over the place discussing Trump’s alleged crime – based on an obscure law in New Yorks’ convoluted word salads that pass for laws up there …
But this is what common law fraud is: h/t Keglerbrown
a misrepresentation of fact;
made with knowledge that the statement is false;
with an intention that the other party rely on that misrepresentation;
the other party justifiably relies on the misrepresentation; and
the other party is actually hurt as a result.
An opinion of value in real estate is not a misrepresentation – even if other parties believe it’s nonsense. A market valuation is also an opinion – albeit it may be relied upon as a fact if determined by an appraiser. Read your appraisal in detail the next time you get one. Every statement is carefully measured to avoid lawsuits, and often was written by attorneys working for the state’s real estate regulatory body or an attorney with an RE certification. An estimated market value may appear in an appraisal – and, as often happens in rental property – this value may be ignored in favor of income value. For special properties with historic value etc, an appraiser may make other exceptions.
So – all the Leftards screaming about Orange Man Bad – are just liars with TDS or mental retards.
As can be seen by these five elements, no crime occurred. Only element No. 2 could have occurred, and if it did, it would be moot because no party was harmed.
Either way, we know Trump’s valuations were not unreasonable based on current and previous estimated market valuations of Trump’s properties. Any other presumption is TDS and nothing else.
Just saw Jon Stewart’s clip of Kevin O’Leary … Kevin complaining about valuations in a reality TV show. This clip is incredibly disingenuous – as Kevin was giving his opinion of the participants opinion of value – and whether his opinion was more or less correct – would have to be determined by an either – an appraiser making an opinion of value … or an actual sale.
One last point for the uninitiated … a tax valuation is not a market valuation nor an appraised valuation. These numbers should approach each other in a free market with low taxes and limited regulation … as they did in America and Europe for most of the 19th century – yes, we have records. In highly regulated markets the values vary widely for obvious reasons. If you taxed NYC property for instance on the basis of “market” value … NYC property would border on worthless. The only people buying would be speculators … which btw is what Trump did in the 70s – and the gamble made him a billionaire.
Meanwhile the appraised value for a commercial loan will always take into account the income value and the ability to repay the loan. And yes, I’ve done this – as the borrower. Obviously it is upon the bank to make the loan, and for small borrowers and speculators – and I’m both – they will not loan anywhere near the value of the property. The most I’ve borrowed was 50%, and that was tough to get. And yes, I’ve been shown the sheets by underwriters … I could be a millionaire – or a million dollar debtor – if I had a victim card or two. As a straight white guy, I’m just glad to have a couple of rentals I own free and clear.
