Illegal Immigrant Can Carry Guns: Federal Judge

An illegal immigrant was wrongly banned from possessing guns, according to a recent ruling.
Story continues below advertisementA federal law, Section 922 of Title 18 of the U.S. Code, bars illegal immigrants from carrying guns or ammunition. Prosecutors charged Heriberto Carbajal-Flores, the illegal alien, in 2020 after he was found in Chicago carrying a semi-automatic pistol despite “knowing he was an alien illegally and unlawfully in the United States.”
U.S. District Judge Sharon Johnson Coleman rejected two motions to dismiss, but the third motion, based on a 2022 U.S. Supreme Court ruling, triggered the dismissal of the case on March 8.
“The noncitizen possession statute, 18 U.S.C. § 922(g)(5), violates the Second Amendment as applied to Carbajal-Flores,” Judge Coleman, appointed under President Barack Obama, wrote in her 8-page ruling. “Thus, the court grants Carbajal-Flores’ motion to dismiss.”Lawyers for Mr. Carbajal-Flores had argued in the most recent motion to dismiss that the government could not show that the law in question was “part of the historical tradition that delimits the outer bounds of the right to keep and bear arms.”
In 2022, the Supreme Court determined that the U.S. Constitution’s Second Amendment “presumptively protects” conduct that is covered by the amendment’s “plain text.”

Imagine the ruling class telling the millions of illegals to fight for their right to be here. They’ve been importing and paying that army for as long as I’ve been alive. Even the churches helped import millions of illegal invaders, and defend them by shaming opposition to that treason. As long as they were robbing and ruining and murdering disposable people, like me, no one cared. More US citizens have died from our open border than all our wars combined. When a federal agent with the Canadian government, I was invited to attend a training course sponsored by U.S. law enforcement. I had a permit for sidearm or shotgun issued by BATF. ICE would not honor the BATF permit and I had to return my weapon to my residence and return unarmed. Yet, under the Visiting Forces Act, as a Canadian soldier, I could legally train with military weapons on a U.S. military reservation. Amazing how the laws work……..

That is false. Non-citizens have exactly the same rights under the Bill of Rights as does a citizen. Unless they are felons, they can possess guns under our laws in most jurisdictions.

I agree with this decision. The Bill of Rights was not written to protect citizens, it was written to protect individuals. If we allow illegal aliens to enter the country unmolested, a practice I detest, then those individuals have a right to defend themselves nor should their illegal status play into any criminal prosecution other than deportation. We either have a Bill of Rights or we don’t.

If illegal describes someone who committed a crime by entering the country unlawfully then giving them citizen’s rights is wrong. Brandon knew this at the STOTU. Brandon had a slip of the tongue and told the truth calling a murder in GA illegal. Brandon has been trying to walk the truth back ever since. This judge is given citizens rights to criminals, terrorists, and other enemies. She, it or whatever should be disbarred.

If illegal alien / non-citizens have second amendment rights, it would automatically follow they have fourteenth amendment rights to vote.
