Brendon Carr writes: Last year, after Elon Musk acquired Twitter, President Biden gave federal agencies the green light to go after him. And they have. Today, the FCC adds itself to the growing list of federal agencies engaging in the regulatory harassment of Elon Musk.

President Biden stood at a White House podium & stated that Elon Musk “is worth being looked at.” When asked “How?”, President Biden responded “There’s a lot of ways.” There certainly are. The DOJ, FAA, FTC, NLRB, SDNY, & FWS have all taken action. The FCC now joins them.

The FCC’s recent decision – like many of the other actions being taken by federal agencies against Musk – fits the Biden Administration’s pattern of regulatory harassment. It is a decision that cannot be explained by an objective application of law, facts, or policy.

First, the FCC revokes Starlink’s $885 million award by making up an entirely new standard of review that no entity could ever pass and then applying that novel standard to only one entity: Starlink.

The decision does not even grapple with the evidence—it simply ignores it.

Second, rural America ends up paying the highest price for this decision.

Over 642,000 rural homes & businesses would have gained high-speed Internet access for the first time ever under the deal.

But the FCC just vaporized that commitment and replaced it with . . . nothing.’

How the Biden Administration and the Left are Weaponizing Federal Agencies to Target Elon Musk and his Companies

Tuesday the FCC’s denial of SpaceX’s Starlink $885.5 million in rural broadband subsidies is just the latest example of how the Biden administration goes after Elon via his companies. Most times, like this example, at the expense of the US citizenry. FCC Commissioner Brendan Carr criticized the decision publicly and accused the administration of targeting Elon by weaponizing federal agencies.

If you need perspective, Starlink is the only company with the scale and capability to reach the rural areas and provide high speed broadband as needed. Running fiber or waiting for other satellite providers would take between 7 to 10 years and triple the cost at a minimum.

– The Department of Justice (DOJ) recently filed a lawsuit against SpaceX, alleging that the company discriminated against asylees and refugees in its hiring practices. The DOJ claims that between September 2018 and May 2022, SpaceX only hired one asylee and zero refugees out of a total of 10,000 hires. Keep in mind, SpaceX only accepts 0.2% of applicants, making it more selective than Harvard, Princeton, and Stanford.

– The Department of Justice (DOJ) is also examining personal benefits Tesla may have provided to Elon since 2017 as part of a criminal probe. This investigation includes a review of transactions between Tesla and entities connected to Elon, as well as the use of company funds to build the proposed Glass House (Project 42). The DOJ is also looking into the advertised range of Tesla’s electric vehicles, which has led to increased scrutiny of Elon’s actions and Tesla’s operations. The Environmental Protection Agency (EPA) determines the range of an EVs by running them through a series of tests, or ‘schedules,’ on a dynamometer that simulate real-world driving conditions.

– The Securities and Exchange Commission (SEC) has scrutinized Elon for his tweets about taking Tesla private, resulting in a securities fraud charge and a settlement that required Elon to pay a fine and step down as chairman of Tesla’s board of directors. Yet, the SEC continues to monitor Elon’s communications and is currently investigating whether he violated the terms of the settlement by failing to have his tweets pre-approved by Tesla’s lawyers.

– The Federal Trade Commission (FTC) is investigating Elon and his companies, including X, for potential antitrust violations. The agency is looking into whether Elon acquisition of Twitter has led to anti-competitive practices and unfair trade practices. The outcome of the investigation is uncertain, but it could have a significant impact on the future of X and Elon’s other businesses.

– The Department of Homeland Security (DHS) is reportedly investigating whether Elon’s companies have violated immigration laws as part of a broader investigation into Elon’s business practices. This investigation is being led by the U.S. Attorney’s Office for the Southern District of New York and includes a review of transactions between Tesla and entities connected to Elon.

While some claim that the Biden administration investigations are legitimate and non-political let me remind you that all of this started mainly due to Elon’s Twitter acquisition. They knew the “Twitter Files” with the suppression of Hunter’s Laptop and the overall censorship at Twitter would hurt the administration and Democrats. Elon’s unwillingness to comply, foreign business interests, and resistance to labor union have also contributed to Elon’s scrutiny. Biden himself stated Elon is “worth looking into.”

For me, FCC Commissioner Brendan Carr said out loud what I already knew. The Biden administration is and has been weaponizing federal agencies to target Elon and his companies for years. This is political and at the expense of the American people, plus the hundreds of thousands that work at arguably the greatest companies on Earth…

As I was writing this yesterday evening, Democratic Senators Blumenthal and Markey demonstrated their leveraging of the NHTSA’s recent actions to spread misguided and extreme views about Tesla safety. This falls within the ongoing efforts to undermine Elon, as their statements failed to acknowledge that Teslas are the safest vehicles on the roads, and the Autopilot system has saved thousands of lives.

How many Americans are currently at risk of buying substandard vehicles due to their statements? How many American children residing in underserved rural areas will lack internet access?
