Democratic senators sue to block appointment of Matthew Whitaker as acting attorney general

Three Democratic senators on Monday filed a lawsuit in federal court challenging the constitutionality of President Trump’s appointment of Matthew Whitaker as acting attorney general.

Trump appointed to Whitaker to lead the Justice Department after Attorney General Jeff Sessions was forced out of the role earlier this month.

The senators who filed the complaint in the U.S. District Court for the District of Columbia are Connecticut Sen. Richard Blumenthal, Rhode Island Sen. Sheldon Whitehouse and Hawaii Sen. Mazie Hirono. All three released fiery statements Monday.

“Installing Matthew Whitaker so flagrantly defies constitutional law that any viewer of School House Rock would recognize it. Americans prize a system of checks and balances, which President Trump’s dictatorial appointment betrays,” Blumenthal said.

“The stakes are too high to allow the president to install an unconfirmed lackey to lead the Department of Justice – a lackey whose stated purpose, apparently, is undermining a major investigation into the president,” Whitehouse said.

“Donald Trump cannot subvert the Constitution to protect himself and evade accountability. We want the court to make clear that the Senate must confirm Matthew Whitaker’s appointment as Acting Attorney General—otherwise this temporary appointment violates the Constitution’s Appointments Clause,” Hirono said.

The senators argue that Whitaker’s appointment is in violation of the Constitution’s appointments clause. They ask the federal court to declare Whitaker’s appointment unconstitutional and block him from carrying out duties.

The Justice Department maintains that the appointment is legal. DOJ spokeswoman Kerri Kupec said Monday it is “lawful” and comports with the with the Federal Vacancies Reform Act, the appointments clause of the U.S. Constitution, Supreme Court precedent, past Department of Justice opinions and past actions of Republican and Democratic presidents.

“There are over 160 instances in American history in which non-Senate confirmed persons performed, on a temporary basis, the duties of a Senate-confirmed position,” Kupec said. “To suggest otherwise is to ignore centuries of practice and precedent.”

Last week, the Justice Department Office of Legal Counsel issued an opinion supporting Whitaker’s appointment.

“This Office previously had advised that the President could designate a senior Department of Justice Official, such as Mr. Whitaker as Acting Attorney General,” the OLC said, noting that Whitaker has been serving at the Justice Department “at a sufficiently senior pay level for over a year.”

The Democratic senators are being represented by two non-profit law firms in the case: Protect Democracy and the Constitutional Accountability Center.

Mostly these Senators are trying to shield themselves from being exposed for the collusion and illegal activity in support of trying to take down a duly elected president.

BTW will they ever reveal the names of swamp people who used our tax dollars to pay off
women they harassed, raped or assaulted? I’d like to see the names, dates and what our Congressmen and Senators covered up at our expense. Where is the “transparency” ?

There is nothing unConstitutional about this.
At some point this DEM cash cow witch hunt has to end and it needs to be soon.
We have spent over 20 million for this DEM feeding frenzy of our tax dollars and still NO WALL or more ICE agents.

Using government as a ROD for their personal anger and hangups? I know Mazie Hirono is upset her mommy was abused by her father and now is MAD at all WHITE MEN for this.

Using Washington like a CLUB to pound WHITE MAN who had nothing to do with this. When all they are suppose to do up there is work for you and ensure you and your constitutional rights are represented in Washington.

But this almost NEVER happens. They go up there to represent their own interest, and lately, FEELINGS. The Constitution does not say anything about “feelings”.

Nope . Trump can renew the appointment an unlimited number of times , he only needs to make it permanent before his 2nd term is up .
hey , senator schumer , watch this ! A renewal every 210 days with pomp and ceremony , free beer for all Republicans in the Senate, democrats in the Senate will whimper and dribble before renewal number two .
