The former president, like all Americans, is owed an ‘impartial jury.’

The trial that ensues from the indictment sought by District Attorney Alvin Bragg and handed up by a Manhattan-based grand jury will be a homecoming of sorts for President Trump, who was born at Jamaica Hospital, Queens.

It was the novelist Thomas Wolfe who popularized the phrase “you can’t go home again.” He used it as the title of his posthumously published classic, but in Mr. Trump’s case a better rendering might be that you are likely to find not a welcome mat but an unfriendly jury eager to convict. It raises a question both practical and constitutional: Can the former president get a fair trial in his hometown?

A longtime lawyer, Harvey Silverglate, thinks not, telling the Sun that the indictment is a “bad idea” and that at least one member of the jury will engage in “jury nullification,” when a not-guilty verdict is given regardless of guilt or innocence. He predicts that prospective jurors “won’t be honest during voir dire, or the process of jury selection.” He adds that “people love to get on a high-profile jury.”

Mr. Silverglate observed that were he representing Mr. Trump, he would request a “sequestered jury,” meaning one where the jurors are prohibited from gaining access to press reports during the course of the trial, even when they are off-duty. He muses that Mr. Trump’s team would love to hold the trial at “Tallahassee or Ames,” but that the case will likely end in a hung jury.

The Constitution’s Sixth Amendment promises that “in all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed.” The trial’s location is determined by the “nature and cause of the accusation.”

If an alleged crime spanned a range of jurisdictions, the law allows that “any district in which such offense was begun, continued, or completed” is suitable for trial. This flexibility allows for “forum shopping,” or the effort to find the most hospitable terrain for a trial. Jury consultants have become de rigueur at high-profile trials, or those with deep-pocketed defendants.

The right to an “impartial jury” is also linked to the Equal Protection and Due Process clauses of the 14th Amendment.The Supreme Court explains that impartiality requires the selection of a jury from “a representative cross section of the community” in which the trial is held. The jurors selected must be able to decide the case based on only the evidence presented.

Question; What is the NY Grand Jury ? Answer; It’s a kangaroo court.

Trump has ZERO chance for a fair trial which is part of the point I was trying to make in my comment to your “Uncharted Territory” post which really ticked off a lot of your readers, btw.

Responses like; “Vote harder”, “Never give up”, “You are a loser” probably make my critics feel better. But how will any of this change anything?

The reason I post is to generate interesting discussions with people who do not necessarily agree with everything that I say.

Almost every one else has been at least civil and polite.

But you have taken the level of discussion straight into the toilet.

First you engage in personally attacking me, calling me “A WOLF in sheep’s clothing” because you disagree with what I said.

Then, showing your true Christian charity, you “rebuke me in the name of Jesus”.

To be at least somewhat intellectually honest, you should rebuke me in the name of Aleister Crowley.

Grand jurors need to be culpable for wrongful prosecution. I sat on a Grand Jury once. 23 citizens and I would say only 4 or 5 weren’t complete idiots. Six weeks in and the group still thought we were deciding guilt or innocence. I was given permission to take a business trip and a murder case was heard in my absence. A young woman who stabbed her boyfriend with a knife testified she was abused and the idiots on the jury let her off with a finding of “No true bill”. The young man’s mother told the press she was heartbroken the jury felt her son’s life wasn’t worth a trial; and called the 23 (22 really) jurors morons. I wish I had been there to tell the jurors on the panel what a travesty of justice they were making. It was federal court in Providence, RI which has about the same IQ level of NYC.

I know the feeling and in ny you can bet all of them were morons. As you know it takes less than 100% to vote to indict, but the jury 100% to convict.

Never ask for a jury trial. Ask for a “Judge” only trial. I, too, was on a jury. Everyone was in a hurry to go home, to do their taxes, laundry, or the babysitter was waiting. They just wanted to get over the trial and all voted the same without discussion.

The Killing of America has started some time ago.
The totalitarian Democrats have been doing fascistic things for over a decade, especially since Obama was put on the scene
The Republicans sat on their hands and pretended that this was not happening.
First, it was through social media that the Democrats started to build their dictatorship. Using the cover of “private enterprise ” they started to construct the surveillance state and establish the models of state censorship. Conditioning people to live under a totalitarian regime and fooling the so-called “principled conservatives” by acting through private enterprise.

Sure enough, by the time Trump came to the scene, the state apparatus started its covert merger with these “private” companies.
Twitter became a reposit of CIA agents and was in constant contact with the FBI. Later they worked together to rig the 2020 election.
They also worked together to de-platform dissenting views. Including elected officials’ accounts.

By the time the Biden regime came, social media platforms were working hand in hand with the DNC and the security agencies.
What first was the rigging of speech on these platforms, became the rigging of an election by silencing reports and silencing users with views not supportive of the Democrat agenda

Then there was China. China is a communist party-run fascist state. Yet it enjoyed the status of a legitimate trade partner.
When Trump alerted that they’re not trading fairly, that they’re ripping off America (and the West) that they steal IP so he would impose tariffs on their imports;
What did the “conservatives” say or do?
They attacked him for “ruining free trade” and accused him of being against the “free market”.
How free can a market be when you’re dealing with genocidal communists who operate slave labor camps and perform medical experiments Mengele style on concentration camp prisoners?

While all this was going on, basically from 2007 onward the American media completely abandoned even the pretense of journalistic ethics or methods and became a Pravda-like organization spewing total lies and propaganda not even with a grain of truth. They made up stories, buried other stories, lied, and agitated for social unrest, chaos, and racial division .
Again, “conservatives” maintained that this was the “free press” and free speech allowed them to lie like a 3rd rate propaganda pamphlet from a 1930s dictatorship.

Then January 6th came and a Soviet-style purge began of the citizens now that the purging of officials has been going on for some time. People were sent to prison and held without charges for extended times (using covid..the other fake crisis) and after being charged awaited trials in 3rd world conditions.
Did the “conservatives” protest this?
Not really, they even supported it, and with a few exceptions they rallied behind the persecution of citizens.
Even members of Congress were raided by the FBI as were journalists, former Mayors, and lawyers who worked for Trump or worked to defend some of these newly defined political criminals.
“We are law-abiding” as the AG and President were visibly shredding the Constitution and the Bill of Rights.
Supreme Court Justices faced threats of assassination and were denied proper state protection.
That, after a circus the media and the democrats created over Kavanagh putting him in front of a show trial where mentally disturbed individuals’ sick sexual fantasies were indulged and treated as “evidence”.
All the while the Democrats orchestrated riots, encouraged looting and lynchings, and deployed a foreign-based terrorist organization, Antifa to intimidate anyone critical of their policies.
What did the GOP do?
Well, they defended their “right to protest” and the Republican AG refused to arrest them, and in the rare cases when he did go after them he refused to allow the media to see these terrorists being arrested.
“Because we’re better than that”.
As they watched Paul Manafort sent to Rikers to sit with murderers and serial rapists for having failed to fill out a form and what amounted to a tax violation
Or seeing Roger Stone raided more aggressively (with full media presence) than El Chapo.
Stone’s crime?
Forgetting a date of an email sent or received 3 years before!
Who protested that?
“He’s not above the law” some stated.
All this was going on while the cities crumbled under Soros-funded law enforcers who prosecuted victims and defended perpetrators.
None of what happened yesterday came as a surprise or came out of some vacuum. This was the culmination of years of degeneration of all the systems and institutions that previously sustained the democratic order and the rule of law.
It is not yet finished.
It just entered a new stage.
Trans Terrorists have attached a Christian School and the regime openly sided with the terrorists.
Media personalities were openly calling for mass murder before and after the attack.
The former House Speaker wants to reverse the 400-year-old Common Law principle of innocent until proven guilty and is arguing for Chinese-style courts where the accused has to prove his innocence.
The City of NY is now a 3rd world craphole.
Its legal system is now on par with that of Liberia or Pakistan
Witch hunts are now the norm as if this was the 1600s or if this was the Soviet Union.
Elections are now openly interfered with and opponents criminalized.
The thing about Democracy is that it takes decades, if not centuries to build but it takes only days to tear down.
You can see how the Roman Republic fell, how fast the German Republic succumbed to tyranny, or see how quickly the fragile Latin American democracies crumble and become banana republics or outright dictatorships.
It starts with political prosecutions, then uncontrolled crime, and eventually a tyrant rises to either institutionalize the nihilistic chaos or to promise to end it.
Either way what ends is democracy.
At the root of this is culture.
Once you have enough people not adherent to a democratic culture, usually because these people either aren’t sophisticated enough to participate in a civilized democracy having come from mob cultures, rape cultures, or tribal cultures, or you allow an elite emerge that is smart and sophisticated but judges that the rest aren’t and should be dictated to for their own good, you end up with a totalitarian system. There’s no need for Soviet tanks to come and impose this when the Soviet thinking spreads among too many at the top. As it is now evidently the state of play on the American left. It gave up on the American people as free agents able to decide who should govern them and what laws should guide them.
When these forces meet in the “private enterprise” board rooms or in the halls of legislatures they will collude to create a system that protects them and their power against the rest. This will never be limited to just political power, they will extend that to economic power as well as they will move to systematically impoverish the rest of society to disarm it of any means of resistance or even any means to speak and think about resistance.
Eventually, that will result in a feudalistic-style cast system of total top-down control and violent enforcement of the same.
The USA is entering that phase.
The systematic degradation of the middle class has commenced.
The shutting down of energy supplies, and the coming bans on gas and diesel cars are already on the way.
Every dictatorship strived to destroy the middle class.
Because the middle class is where social and political conscience is nurtured and is usually born.
In Tzarist Russia, the regime deliberately sabotaged economic growth fearing that a rising middle class will follow the lead of the rest of Europe and revolt against the tyranny.
We see that in the Middle East and Latin America where regulations exist specifically to halt social ascent to keep masses of people in poverty and desperation needing the state for their sustenance.
Those who think that government is irrelevant to their lives because they own nice things or have a good job or some social status without political participation fail to realize that their choice of not participating is directly related to the democratic system they take for granted.
They will be shocked when the regime will come for their economic status. Because it will. It has already started in some European countries where farmers are forced to shut down. Covid should have been the wake-up call as the state actually forced the economy to shut down, yet was selective as to whose economy.
“Climate Lockdowns” are coming.
Private home ownership has already been challenged in Oregon.
CA is talking about “reparations” for slavery that never existed in the state. All these crazy things will slowly coalesce into a purposeful set of policies and rules which will eventually rob people of their possessions based on their political loyalties or even racial background.
This is not new, this has happened before and happened in places nobody expected.
Nothing is really new except the renewed denials and pretending otherwise.
Our nature can be our greatest strength or our greatest weakness also.

Very thought out and well composed account of the controlled degradation of a once proud nation. And whatever areas you didn’t touch upon in any detail (educational institutes, the money supply etc,), are all in and under the same state and destructive control.
There is of course a centralized body directing most of this (some of it is of course a ‘B’ follows ‘A’ progression), because no level of incompetency could ever bring such designed chaos on its own on such a grand scale.
You did not mention the state of mind of the populace – their social/political IQ, nor their beliefs/faith in God – all things that, at a minimum, can affect the health/longevity of a society. Even if your not mentioning God is a reflection of your position, it has been a major foundation of western civilization that too has been attacked. So few (4% of Americans) hold a biblical worldview today – the rest (82%) have made up an image of God based on their own ‘flavor of the day’.
It’s not that we have a lot of problems – it’s that we have a lot of serious, nation destroying problems. All of them would need fixing, but the means to do so (unity) is lost. There is no fixing it any longer – we have hit our iceberg.

So many of our youth have been so indoctrinated and radicalized thanks to Howard Zinn, CRT, et al., that it has long warranted a push to raise the minimum voting age to up to 30 – especially since, besides the factor of indoctrination, 18-29 year olds are top-heavy as shock troops in the ultra-violent Antifa and BLM movements. Yet not only has this NOT been floated by TPTB, leftist Democrats want to lower it ever FURTHER to 16. But drastic steps DO have to be taken to ensure that that age group does not do any further damage to this country than they already have.

The major banks are supposed to down the Debit card / Checking Account system for an entire week in late April 2023, tentative for now, to connect our bank accounts to the federal reserve system that connects us into a social credit score so they can lock our accounts up to a month to violate and regulate our fee speech to choke it off.
We will ALL be subject to unConstitutional punishments that will make 34 Felony indictments look like a joke.
The anti Tik-Tok legislation “allegedly” threatens all of us with 20 years in prison and up to $200,000 in fines for daring to Free Speech counter the Biden Regime on the murder vaccines, on Hunter and Joe Biden’s treason and bribe taking from China and Ukraine, on mentioning the stolen election, on any criticism NOT on the Biden Regime tell their lies as the new truth agenda.
Trump will never be given anything fair anything. These 34 indictments are past statute of limitations and outside the scope manufactured charges.
Soros, who died on Feb 28th apparently and whose estate paid the IRS $9 billion, is having his minions prosecute Trump — when Soros has already died and gone to Hell — for no other reason but spite.

What else can any informed person expect from a left-wing jury that isn’t really “grand” at all.

This indictment is an absurd, unjust unfair biased case of malicious of political harassment of Mr. Trump and his family.

Trump WILL be found guilty. It will be just prior to the 2024 election process and Trump will be fighting in court on an appeal. Meanwhile the election will proceed without Trump. One of the Traitors running against him will be the Republican nominee. Firmly entrenching a Demoncrat in The White House under the banner of being a Republican. Whether it be Gabbard or Pence, etc. You could vote YE West if you want crazy.
