USA Powerlifting Looks to Appeal Decision by Judge Allowing Biological Man to Compete Against Women

There’s truly something mentally disturbed in any man who wants to compete against women. There’s an underlying rage and hostility in that very act. Think about it.

All biological women should sit out any competitions until the matter is cleared up in the courts. If JayCee Cooper wants to be the only one competing, then it can have the prestige of winning the gold medal against an empty field. And as an aside, the judge in the case should have his credentials reviewed by a judicial grievance committee. There is a principle called equity that comes into play to trump the law when following the law leads to an absurd result. The classic case in this regard is Rigs v Palmer, 115 NY 506 (1899), a New York Court of Appeals case written by Justice Cardozo. There grandfather writes a will leaving substantially everything to his grandson Elmer Palmer. Grandfather starts getting very unhappy with his grandson’s behavior and threatens to change his will, so the grandson poisons him.

The statute of wills, then in effect, stated that a person named in a properly executed will inherits in accordance with the will. So, Elmer Palmer who was at that time convicted of his grandfather’s death would inherit according to the statute, and the criminal aspect of the situation would be separate. Judge Cardozo, writing for the majority, invoked the principles of equity to block Elmer Palmer’s inheritance. The gist of the decision is that laws are written for the usual situations and cannot possibly cover all situations. So, if there are situations where following the law would lead to an absurd or unjust result, equity does what ought to be done, and it trumps the law.

Likewise, the legislative intent concerning the law that prohibits discrimination against transsexuals never contemplated using it as a sword to ruin women’s athletics. Instead, it probably contemplated non-discrimination in employment, college admissions, admission to places of public gathering such as restaurants, sporting events, etc. The judge should have seen that allowing transsexual men to compete against females is an absurd result obtained by strict application of the law and ruled the opposite of how he did.
