Trump legal team argues impeachment article is in ‘violation’ of Constitution, calls on Senate to acquit

Trump legal team denies that the former president violated the oath of office

Former President Donald Trump’s legal team on Tuesday filed its response to the House article of impeachment ahead of next week’s trial, denying wrongdoing and calling for the Senate to acquit Trump of the charge.

The answer denies that Trump violated his oath of office while also saying that he was protected by the First Amendment in response to claims he incited an insurrection.

“It is denied that the 45th President of the United States ever engaged in a violation of his oath of office,” the Trump legal team brief says. “To the contrary, at all times, Donald J. Trump fully and faithfully executed his duties as President of the United States, and at all times acted to the best of his ability to preserve, protect and defend the Constitution of the United States, while never engaging in any high Crimes or Misdemeanors.”

Trump’s legal team also argues that a Senate trial against him would be unconstitutional.

“Donald John Trump, 45th President of the United States, respectfully requests the Honorable Members of the Senate of the United States dismiss Article I: Incitement of Insurrection against him as moot, and thus in violation of the Constitution, because the Senate lacks jurisdiction to remove from office a man who does not hold office,” the brief says.

The argument from Trump’s counsel that the trial is constitutionally impermissible is one that is supported by the vast majority of the Republicans in the Senate. Last week Sen. Rand Paul, R-Ky., raised a point of order, claiming that it is unconstitutional for the Senate to hold an impeachment trial of a former president.

It was defeated by a 55-45 vote, with five Republicans joining all 50 Senate Democrats in what is likely to be the final word on whether or not the trial may proceed – it’s highly unlikely any court would step in and tell the Senate how to run the trial.

But it would take 17 Republicans joining all 50 Senate Democrats to convict Trump on the impeachment article, meaning a dozen Senate Republicans would have to change their mind about the trial’s constitutionality for Democrats to even have a chance of convicting the former president.

RAND PAUL CALLS TRUMP IMPEACHMENT TRIAL ‘DEAD ON ARRIVAL’ AFTER 45 GOP SENATORS VOTE AGAINST IT

The brief also doubles down on the false claims that Trump won the election.

“To the extent Averment 5 alleges his opinion is factually in error, the 45th President denies this allegation,” the brief reads, referencing the House’s allegation that Trump at his Jan. 6 rally “reiterated false claims that ‘we won this election, and we won it by a landslide.'”

“Insufficient evidence exists upon which a reasonable jurist could conclude that the 45th President’s statements were accurate or not, and he therefore denies they were false,” the brief also says.

Trump’s previous legal team quit over his demand that they make an election fraud case, Fox News was told. Trump’s new legal team of Bruce Castor Jr. and David Schoen were the only two lawyers signed onto the document that was submitted to the Senate on Tuesday.

Earlier Tuesday, the House impeachment managers filed their pre-trial brief, essentially previewing their argument against Trump in the trial that’s set to start next Tuesday.

“In a grievous betrayal of his Oath of Office, President Trump incited a violent mob to attack the United States Capitol during the Joint Session, thus impeding Congress’s confirmation of Joseph R. Biden Jr. as the winner of the presidential election,” the impeachment managers, led by Rep. Jamie Raskin, D-Md., wrote. “As it stormed the Capitol, the mob yelled out ‘President Trump Sent Us,’ ‘Hang Mike Pence,’ and ‘Traitor Traitor Traitor.'”

They added: “This is not a case where elections alone are a sufficient safeguard against future abuse; it is the electoral process itself that President Trump attacked and that must be protected from him and anyone else who would seek to mimic his behavior.”

But the Trump team brief on Tuesday directly addresses the allegation that the former president incited the riot.

“It is denied that the phrase ‘if you don’t fight like hell you’re not going to have a country anymore’ had anything to do with the action at the Capitol as it was clearly about the need to fight for election security in general, as evidenced by the recording of the speech,” the Trump team brief reads. “It is denied that President Trump intended to interfere with the counting of Electoral votes.”

It adds: “The purpose of the Joint Sessions of Congress in 2017 and on Jan. 6, 2021, was for Members of Congress to fulfill their duty to be certain the Electoral College votes were properly submitted, and any challenges thereto properly addressed under Congressional rules. Congress’ duty, therefore, was not just to certify the presidential election. Its duty was to first determine whether certification of the presidential election vote was warranted and permissible under its rules.”

Outside of a range of answers to the specific allegations from the House impeachment managers, the Trump team brief also previews a menu of legal arguments it says support the argument that the Senate should not convict Trump.

These include the Senate lacking jurisdiction to hear a trial of a former president; that Trump’s speech was protected by the First Amendment; that the House ignored due process in “rushing to issue an Article of Impeachment”; that Chief Justice John Roberts will not oversee the trial, and that the House weaves together a plethora of independent allegations into a single article of impeachment.

Trump’s team and the House impeachment managers will submit another round of briefs next Monday. These will be the House managers’ reply to Trump’s answer today, and the Trump team’s pre-trial brief.

The impeachment trial will then start in earnest next Tuesday.

Part of the problem with counting the total loss of life lies with the incompleteness and unreliability of Soviet records. A more troubling dilemma has to do with the fact that many some deaths – like starvation from famines – may or may not have been directly connected to Stalin’s policies.

In any case, if the figure of 60 million dead is accurate that would mean that an average of 2 million were killed during each year of Stalin’s horrific reign – or 40,000 every week (even during “peacetime”).

If the lower estimate of 20 million is the true number, that still translates into 1,830 deaths every single day.

I read the president’s lawyers statement of defense today I thought it was very good. They also mentioned their articles of impeachment proved political hatred and the Constitution did not provide for impeaching someone who was no longer serving in the office of president…

It was a perfect response. The only problem is they don’t care about what the Constitution states and we haven’t for a long time.

If you expect the Supreme Court to get involved at some point, keep your expectations low. They wouldn’t hear procedural or legitimate Constitutional issues this stolen election violated. Even when Samual Alito ordered PA. to separate ballots, PA thumbed their nose at him and didn’t do it. He did nothing about it. He could have ordered a U.S. Marshall to go in and make them do it but he didn’t. I was horrified and so disappointed to see the cave to election fraud.

I have no respect for ANY of them! Not one. At one time I had respect for Alito and Thomas but not anymore. Their response to hear a cause but offer no remedy was also horrifying and cowardly.

Apparently that is not enough to whoever is controlling the imbecile. The imbecile is putting together a committee to examine “reforming” the U.S. Supreme Court. Conservatives have too much power – LOL! It’s blackmail to make sure the rulings are liberal and suit the imbecile or get a packed court. They will eventually get a packed court and Judge Merrick Garland Garfield will be the first judge installed and of course the GOPe will not object. He has been nominated as Biden’s A.G. and will be confirmed.

I missed the legal need to argue based on it being a Bill of Attainder – that is potent and legally necessary.
They seemed to have missed the Separation of Powers argument – that the Congress lacks judicial authority except in impeachment to remove an office holder. It is an exceptional authority, and thus not granted for other purposes.

2nd impeachment is plausible though wrong-headed and Pelosi-punked, but for the intelligent out there not totally seduced by MSM or Internet hucksters ‘news’, Trump is still our President, so he’s still in office, he won the election in a landslide. Once you put the facts together, and read up on the friggin’ laws of the USA and the Constitution, what is going on is an enormous ‘reality’ TV show for all to enjoy.
Research Obama’s eight year reign of terror for clues to the insurrection now. BTW, I’m a black man.

As a retired physician age 78 living in paradise (read as Tacloban, Philippines) to stretch my Social Security dollars, I have asked my California election office how they came up with a $0.02 postage stamp on my official ballot and official envelope to cross the Pacific Ocean (10,002 miles). I thin 2 cents might have worked back in 1776 to movee a letter from two people in the same state perhaps close enough to use two cans and a wax string as backup for voice recognition. Someday Congress must ask if the 25,000,000 ballots that were sent out officially from the state had two mailing costs stamped on them: $0.02 and $0.48 or higher for those ballots meant to arrive in time to mail back. My Sept ballot arrived in late January of 2021 with the official envelope.

Of course, the election was stolen. It is only sedition, if I come up with some method of disturbing the installed puppets who must be saluted, are able to tax, can create or destroy jobs (read as Pipelines), etc. I believe that Dr. Biden (educational PhD) will someday give us the sad news that her husband needs her to interpret his hand signals as to what to do about China. She already studied up on how Mrs. Wilson did the same – the first women President-Through-Interpretation or TPI. And Kamala Harris will go back to Oakland to a quiet life given Kaiser for life for having wrecked my medical license by tricks; this will become the Spiro Agnes Exit approach to politics. Exit or jail or license removal.

Nancy will then be in charge, but during hair treatments will turn over the Nuclear Football to the only sharp tack left -VP Tulsi Gabbard. India will be happy as we advance this Hindu forward to show we ARE using character to decide. I put my life on the line as a volunteer MD keeping open the top Emergency Room in the Middle East in Riyadh so pilots would not have to wait until Germany to get help at the heart transplant level. Sure, I was paid my $10,000 or less a month, but not a penny or a riyal more. I think in Desert Storm I was protecting Riyadh as the highest civilian employee not six floor down hiding in a bunker; I think Tulsi was over in Kuwait winning that part of the war. Character might be about country before life.

It was an honor to also protect the 2000 Filipino nurse who could not (like I could) leave and go watch Broadway shows still on salary. Later the Royal Family promoted me to covering the King at the Jeddah Palace for a week and thereafter being the top of four US ER docs to do the same, whenever he was out of Riyadh. The US War vets ask me to stand on Military Holidays like Nov. 11th; sometimes we civilians took the same risks – most soldiers and US pilots saying “We did not volunteer to go to the Theatre of War; ; you volunteered to stay as you already ran the top ER in the Middle East.”

Now, I hope I have the character to risk my life against: Kaiser, Big Tech, the Democratic Machine of California, Dr. Biden, etc. (though I am a registered Independent), Gates Uber Alles, etc. usually splitting my votes down the middle. I could clean up NIH for three months (done each day by lunch time) and not be paid except the high honor once again of serving my country. You already prepay me monthly SS $. I would like some occasional Thai Shrimp Soup but on Level 2 of 5 in spices – “Mai Pet” = not too hot. And Malaysian chicken satay (think peanut butter sauce) – that must be written into my contract under per diem expenses. Trump Hotel – Ok. My wife wants me home by May.

Filipino chicken adobo – do not forget that – as I must tell my Filipino wife “It is an 8 against your 12 in cooking on your camper stove”; she could help take over the White House Kitchen as a master chef ready to teach. Or she could assist the current Filipino Commander-in-Chef who Obama snubbed bringing in his own Chicago cook (I suspect beef, mashed potatoes, gravy, and corn on the cob – because I was a Chicago boy. If you cannot eat Asian food at least part of the time, you will never be fully respected within the Pacific Rim. Sure Martha’s Vineyard is where rich men and women go to eat prime rib or tenderloin. Luckily the cows on or near Martha’s do not make any gas; so, the Green Squad exempted them from mandatory fish and broccoli six nights a week.

I picture on “the Vineyard,” that Martha might stand for Martha Washington who is forgiven for being so rich with over a thousand slaves. George – a soldier married up; she married handsome and tall – her second rodeo. It works – love comes from respect not a dating app; If he ever strayed, any historian would first take poison rather than write such a paragraph. So, if some liberal writer collapses, it is not weaponized Anthrax spores … it is a Protect Martha Attack In medicine we would sign it off as another Covid-19 death since that pays much more. Even one cough, and YES a Covid-19 death is recorded as also occurring; NIH 2020 rules on Death Certificates.

So, Will Rogers used to say while twirling a rope, there are lies, damnable lies, and then ….statistics. Somewhere in 2050 some historian will blame everything on Tony Fauci when he is in Mob Heaven – already organizing a Heavenly Virus that he can “gain function” to also ruin Heaven – adding Chinese to his Greek and Latin (NOT). Be careful Tony; God also judges Heaven looking for post-arrival duds. HE is not always full of patience patients even if you jog every day (and you don’t). Do not turn into salt before I get to debrief you. I think Heaven will allow me a laptop and printer; I gotta keep up this blog. And tennis in Heaven, of course. CP
