Based on the secretary of state’s “interpretation and application” of the state Supreme Court’s decision in Pennsylvania Democratic Party v. Boockvar, President Judge Mary Hannah Leavitt concluded that Boockvar “lacked statutory authority” to issue the Nov. 1 guidance to Respondents County Boards of Elections, purportedly changing the deadline of the state’s election code.

The ruling stated that the aforementioned county board are “enjoined from counting any ballots that have been segregated” pursuant to the court’s order dated Nov. 5, granting a special injunction.

On Nov. 6, Justice Samuel Alito issued an order from the Supreme Court instructing that ballots received after 8 p.m. on Election Day in Pennsylvania are to be “segregated and secured.”

Last week, state Senate leaders wrote in a statement that Boockvar “fundamentally altered the manner in which Pennsylvania’s election is being conducted.”

Mainstream media ignored the plight from Senate President Pro Tempore Joe Scarnati (R-25) and Majority Leader Jake Corman (R-34) calling for Boockvar’s immediate resignation in light of her alleged “numerous actions to undermine public confidence in Pennsylvania’s elections.”

“Critically, the state has a Republican state legislature,” reported Fox News journalist Kyle Becker. “#SCOTUS may ultimately decide the case now.”
