Supreme Court won’t revive 6-day ballot deadline extension in Wisconsin, siding with GOP

The Supreme Court on Monday evening voted 5-3 against Democrats who were pushing to extend the deadline for counting absentee ballots in Wisconsin by six days in order to provide the state more time to deal with the surge in mail-in voting caused by the Covid-19 pandemic.

The decision, announced in an order, came eight days before Election Day. Wisconsin is a key battleground state in the battle between President Donald Trump and Democratic nominee Joe Biden. As a result of the Supreme Court’s decision, ballots will have to be delivered by 8 p.m. on Nov. 3 to be counted.

The court’s eight justices divided along partisan lines, with the court’s three Democratic-appointees in dissent. The order, which came amid a flurry of election-related disputes that are making their way to the justices, was released as the Senate voted 52-48 to confirm Judge Amy Coney Barrett to the Supreme Court. Barrett’s confirmation gives conservatives a 6-3 majority.

The top court’s order followed a ruling from District Court Judge William Conley last month extending the state’s absentee ballot counting deadline in response to a suit from the Democratic National Committee and its allies. Conley cited the unusually high number of ballots cast by mail as well as delays with the Postal Service.

A similar 6-day extension that was in place for Wisconsin’s April elections resulted in 80,000 ballots being counted that otherwise would have been disqualified, or 5% of the total ballots, according to the Wisconsin Elections Commission.

A panel of the 7th U.S. Circuit Court of Appeals blocked Conley’s ruling earlier in October. The Democrats appealed to the Supreme Court to reverse the appeals court ruling, but the justices declined to do so.

Heart failure is the final common pathway for all organ failure. When the heart stops beating, life stops. So that means that all human mortality is caused by ‘heart failure’. So how do they define ‘heart attacks’? That’s a colloquial term, not a medical term. In Holland, heart failure has been labelled Covid-19 mortality, even if there was no positive diagnosis for Covid-19.comment image

As another high-stakes confrontation between Democrats and Republicans went down to the wire, Chief Justice John Roberts again crept left and sided with the liberals.

Roberts’ vote on Monday night, in a ballot dispute in the battleground state of Pennsylvania critical to President Donald Trump’s reelection bid, led to a 4-4 Supreme Court deadlock. That left in place a Pennsylvania court decision allowing mailed ballots to be counted up to three days after Election Day, despite familiar yet unfounded claims from Republicans regarding “the taint of” illegal ballots.

Pennsylvania Poll: Donald Trump 48.4%, Joe Biden 47.6%

President Donald Trump has taken a narrow lead in Pennsylvania, a Trafalgar Group survey released on Tuesday — one week from Election Day — found.

The survey, taken October 24-25, among 1,077 respondents, found Trump carrying a slight edge in the Keystone State, garnering 48.4 percent to former Vice President Joe Biden’s 47.6 percent. The results, which include leaners, show 2.2 percent backing Libertarian candidate Jo Jorgensen and one percent of voters remaining undecided. The survey’s margin of error is +/- 2.91 percent.

Do I have this right, all ballots can continue to be counted after election day but all ballots must be delivered by election day to be counted? I am trying to make sense of their PA ruling.

Delivery of ballots vs counting of ballots after election day without signature matching?

THEY would have to use the postmarked date, because stuff that gets stuck in the mail system should not be penalized. But there is no logical escape from the fact that this election, every vote will not be counted.

Had the turtle, McConnell, who doesn’t think there is a mail in ballot voter fraud problem….. moved a little faster on the Barrette confirmation, we would not have these issues. I have reservations on Amy Barrette but I do believe she would have used common sense and not left room for ballot fraud.

She ruled against Trump’s rule on having immigrants be self sufficient in supporting themselves to become citizens. Many if not most, come here to be supported by us. Trump was simply clarifyng the law that is in place and not enforced. It used to be new immigrants had to have sponosrs be responsible for them financially for a set period of time.

This collective apprach for Pilgriams didn’t work out…and her motivation for adoption is more easily understood. I suspect she us quit the social liberal…. There are tons of kids here in dire straights that you don’t need to go to Haiti to adopt….. At their income level, and position they have help raising her kids….which is fine but that is what doesn’t make her the typical mom.

There are other things too….such as the blind student she helped to graduate to be a lawyer. Yes, literally blind. I leave it to your imagination what a company would have to go through to accomodate her as an employee. Today there are more things in place to accomodate that but I’d bet many lawfirms aren’t eager to have those requirments in place….. There is this thing called reality… where it may not be too practical to hire someone that is literally blind… I don’t believe it is heartless to steer a person with that problem to another occupation….

Okay. I appreciate the information. I was right on thinking she seemed very nice, and she calls herself a Constitutional Originalist. That would be great. I am fine with letting some people in need come here in unusual circumstances. Some severely persecuted Christians come to my mind. Will read what you sent when I have time later today. Basically, we don’t owe anyone anything. And in the unlikely event I moved to their home I guarantee you no one would be providing my needs. Most nations demand that you have quite a lot in your coffers if you want to be there any time beyond something considered a vacation.

Supposedly, all ballots must be post marked by election day. Not delivered. Simply postmarked. Pretty common. Been that way, in many states for many years.

The Supreme Court could soon revisit a challenge to a Pennsylvania Supreme Court decision on extending the deadline for the receipt of
absentee ballots — this time, with Justice Amy Coney Barrett on the Court, possibly casting a tie breaking vote.
