The 5-4 ruling was written by Chief Justice John Roberts and joined by Justices Ruth Bader Ginsburg, Elena Kagan, Stephen Breyer and Sonia Sotomayor.

SCOTUS Blocks Trump’s Attempt to End DACA

The Supreme Court ruled Thursday that the Trump administration’s attempt to end the Deferred Action for Childhood Arrivals program is “arbitrary and capricious” and cannot proceed.

Chief Justice John Roberts, joined by the four liberal judges, ruled that Trump’s decision to rescind DACA violated the Administrative Procedure Act. DACA, which was instituted in 2012 by President Obama, allowed 700,000 illegal aliens who were brought to the United States as children to apply for a two-year deportation deferral. The deferral, which comes with work eligibility, may be renewed, but does not provide a path to citizenship.

“Here the agency failed to consider the conspicuous issues of whether to retain forbearance and what if anything to do about the hardship to DACA recipients,” the court wrote, declining to rule on the legality of DACA itself. “That dual failure raises doubts about whether the agency appreciated the scope of its discretion or exercised that discretion in a reasonable manner. The appropriate recourse is therefore to remand to DHS so that it may consider the problem anew.”

In dissent, Justice Clarence Thomas, joined Justices Samuel Alito and Neil Gorsuch, wrote that DACA was illegal from its inception.

“Under the auspices of today’s decision, administrations can bind their successors by unlawfully adopting significant legal changes through Executive Branch agency memoranda,” Thomas wrote. “Even if the agency lacked authority to effectuate the changes, the changes cannot be undone by the same agency in a successor administration un- less the successor provides sufficient policy justifications to the satisfaction of this Court. In other words, the majority erroneously holds that the agency is not only permitted, but required, to continue administering unlawful programs that it inherited from a previous administration.”

“The question under the APA’s deferential arbitrary-and-capricious standard is not whether we agree with the Department’s decision to rescind DACA. The question is whether the Nielsen Memorandum reasonably explained the decision to rescind DACA,” Kavanaugh explained. “Under ordinary application of the arbitrary-and-capricious standard, the Nielsen Memorandum—with its alternative and independent rationales and its discussion of reliance—would pass muster as an explanation for the Executive Branch’s action.”

Why didn’t Bush-Justice Roberts simply rewrite the lawsuit to fit the DACA, like he has already shown his willingness and cronyism to do in Obamacare?
With twenty or thirty million illegal Mexicans and OTMs or more in our country right now, voting Leftist en mass, not to mention the mob in the street influencing legislation and law enforcement on all levels, we don’t have the luxury of extending the kind of compassion we would like to the DACA illegals.
We have to fight on every margin. The DACA illegals have only the adult illegal invasion to blame.

Because he doesn’t like Trump. Roberts has something to hide…. He had no problem making legislation on the LBGTQ+ 1964 Civil Rights Act. That ruling was just what the DEMS wanted. On this, imo he is stalling for time expecting a DEM to win as President and with voter fraud it is a possibility…..

these recent bizarre rulings from gorsuch and roberts are not differences of opinion. those 2 are just making shiite up. they are either evil or stupid. the reasoning used by gorsuch to extend the title VII protection to sexual perverts was childish and would be slapped down by any jury under cross-examination. i’m really beginning to wonder if he’s just a stupid rich kid that bought some diplomas from the ivy league and oxford, and will led around by the nose by the 4 commies on the court for the next 40 years

John Roberts is not, I don’t believe, a “traitor.”

Alas, he’s just another anodyne Republican – a mediocrity on stilts.

He was appointed, naturally, by George W. Bush, a world-class mediocrity.

I am reminded of JFK’s “Ask not what your country can do for you…” inaugural, or his “Ich bin ein Berliner” in Berlin – phrases for which he is remembered.

For George W., it will always be “Islam is a religion of peace.”

It’s fitting, really, that Bush will also be remembered for John Roberts.

I can agree with that superficially but if any of the non Left survive the coming holocaust then posterity will perhaps think differently. Even benevolent cooperation with the blatant enemy on humanitarian grounds is treason however virtue signalling it may be.

I had hope George W would be out of the Bush mould. He’s not. The grand son to a banker to the Nazis why would he be any different. This family is more a banking family than oil. They make money when we’re at war. He probably got a chill up his leg going to war in the Middle East. Problem is his family has never shed any blood. Some will argue I’m wrong, but I have little doubt that GHW Bush killed two crew men on his plane. Being in sports is not like being in war and I’ll bet a buck that he bailed out of a plane without warning his crew. My own father was a degreed engineer and ended up in the Pacific as a enlisted combat engineer. GHW Bush was a pilot? My understanding was that you could not be an officer and pilot in the Navy with less than 2 years college. He had none. Like the late John Dingell nepotism came to GHW Bush’s aid.

GHW Bush’s uncle Prescott Bush was the one that helped the FBI stop the real father of electricity – Tesla – from going forward with his invention, and as a senior…and spent his last days isolated in a hotel . They also have some great uncle or grandfather who was the banker to Hitler….

I’m unsure of the Tesla connection as he had given many patents to George Westinghouse,

but Prescott Bush that you mention was a director at the Union Bank, which was a bank to the Nazis. G W Bush’s great grandfather George Herbert Walker, merged two banks, an English Bank, Brown with the Harriman bank to form Brown Bros. Harriman. I think Antony Sutton writes and speaks about this. With exception of George Herbert Walker, they are all Skull & Bones members. You may want to read Sutton’s book “America’s Secret Establishment: An Introduction to the Order of Skull Bones”

I can’t stand Roberts….a clearly “up yours” by the Bush Cabal to America….but I seriously doubt that he has anything to do with the Epstein crowd….would love to blame something like that on him….but only if iron clad proof.

I’m with you 100%. Roberts has shown himself to make judgements based on the results he wants, not on the law as written. He should be impeached for that reason alone.
I mentioned the flight manifest on Epstein’s Lolita express because many people believe someone is blackmailing Roberts, forcing him to make these terrible rulings. Maybe they are right, but maybe you are right – the Bushes are globalists and the corrupted Clintons are among their good friends. Whatever, Roberts is part of the swamp.

Let me give it to you: Court of Appeals, Second District, Case 18-2868, Document 271: Julie Brown vs. Ghislaine Maxwell. The suit is 883 pages long but in the section dealing with the flight manifest of Jeffrey Epstein’s private jet, John Roberts’ name appears twice.

I thought DACA was a program that the POS anti-American muslim put into action. If so then why can’t another president cancel a program that was never passed in the Houses??? it is a policy and NOT a LAW so how does the SCOTUS claim that a policy can’t be changed??? Actually that is not so. DACA is not a law and is not subject to Supreme Court ruling. They perpetrated a farce. Trump can stop DACA, he just went about it the wrong way. He shot himself in the foot just as he did when he hired Bolton, Sessions and others, and when he was slow to rid agencies of imbedded leftist to include career leftist State department employees and appointees!

I believe John Roberts is corrupt and should be impeached. His decision allowing ObamaCare alone is proof that he is owned. As Chief Justice he wields enormous influence over the lower courts.

It is insane to understand that Obama’s DACA EO was unconstitutional, but also say Trump has no grounds to overturn that order.

This nation was not meant to be ruled over by a few black robed dictators that feel they can steal the role of legislators and the Chief Executive.

I couldn’t tell by your comment if you meant my idea was insane or the situation is insane. Chief Justice Roberts and any other justice could be impeached by the same process as impeaching a President. I believe an investigation by Congress 1/100 as intense as the farce against POTUS Trump would turn up evidence that Roberts is corrupt. I just know it won’t happen. About 5% Americans would have to get fed up and get active bothering their Congressman, do their own research on Roberts to give him/her a clue that there really is good reason to look at Roberts, and hound Congress until they get the fear in them that the people won’t re-elect their worthless behinds. The election season is the perfect time for Americans to stand up, but it won’t happen. One reason I know that is that we are bombarded almost every day that I know of by geoengineering, solar spraying, chem trails are whatever you want to call it. We have had weeks on end of mostly rain. It isn’t dry enough to mow. I have truly been set back on maintaining my roofs for years now due to fake weather. A lot of people are finally aware or this now and pretty sick of it. But they have been brainwashed for many decades that there is nothing you can do about anything and that it is useless to contact your Congress critter. They have never tried telling him/her they work for us instead of the other way around. People that can’t even trouble themselves to protest the fact that the weather, hence food production and storms that can destroy your property, is controlled by the same people who want 90% of the world’s population gone, are not likely to worry about DACA.

It’s perfectly legal to reverse Obama’s unconstitutional order by Trump’s Executive Order. The justices decided that even though Obama’s order was unconstitutional, POTUS Trump needs to somehow prove to a few black robed oligarchs that he has justification for wanted DACA rescinded.

I turned against Chief Justice Roberts early in the game. Usually when my discernment tells me something is fishy it turns out to be true. His ruling that ObamaCare was constitutional when it clearly isn’t was enough for me to know it would be nice to know who really owns him. The process for impeachment for one of the justices is the same as for the POTUS. Congress has to investigate corruption and bring articles of impeachment. That would never happen until/unless the American sheeple get off their duffs and hold their own Congressmen’s feet to the fire. We both know that will not happen. Conservatives are much more complacent than the Left.

First, Roberts decided Obummer Care was a “tax” and the government has the right to tax….total hogwash because Obummer didn’t argue it was a tax. Roberts just pulled that out of the air.

Second, I heard Rush talking today about what Roberts is doing is “making law”….the Supreme Court does not have the right to make law. They have been outside their wheelhouse for years. When does it stop?

Trump just needs to go ahead and do whatever he’s going to do…..then like Obama…let the opposing party spin around like nut cases trying to undo it and running to the Supreme Court….

1) The ONLY governmental body with any “authority” to “make” or “un-make” Law is Congress.
2) The Court MAY ONLY give their OPINION …. THEY MANY NOT “RULE” ABOUT ANYTHING – read the Constittution.
3) If DACA was created by fiat executive order, then it, MOST CERTAINLY, may be un-created by the same means.

What else could we expect from a Bush appointee? Roberts party is kept private. Wonder why? Maybe because he votes with the democrats on most things. So now we know that he is for Obama rules. But knowing doesn’t change anything. More illegals bowed down to and put above national citizens although by law (?) since many of them are criminals and one of the things that let them stay in the first place, was their vow to not break the law. What a joke but it does show up that we’re living in latter days. All we see anymore is good being called evil and evil being called good.
