New York Post: Conservative blogger Pamela Geller sues de Blasio for over pandemic protest ban

Controversial conservative blogger Pamela Geller says in a new lawsuit that  Mayor Bill de Blasio’s ban on public demonstrations violates her First Amendment right to protest the shut-down.

“There is no justification, pandemic or otherwise, for a government official to revoke this fundamental right of the people,” wrote lawyer David Yerushalmi in the civil rights filing that asks a judge to rescind the directive.

The suit, which also names Police Commissioner Dermot Shea, says that if not for the “draconian restrictions on liberty” banning demonstrations, Geller would have organized and participated in a rally against the shut-down.

These demonstrations, she argued, can be held while “maintaining proper social distancing.”

The mayor’s office defended the policy and said it is pursuant to Gov. Andrew Cuomo’s executive order.

“If our officers see any large groups gathering, they will break it up — whether in a park or protesting on a street corner,” said spokeswoman Oliva Lapeyrolerie. “This pandemic has killed at least 13,000 New Yorkers, and will not be treated as business as usual. That is our responsibility to New Yorkers and we take it incredibly seriously.”

Yerushalmi said the suit doesn’t name Cuomo because his PAUSE directive doesn’t specifically forbid public protests, while de Blasio’s executive order does.

During a recent press conference, de Blasio and Shea announced that the ban on “non-essential gatherings” included a suspension of the right to publicly protest, Yerushalmi wrote in the filing.

Geller is asking for nominal damage and attorneys’ fees. The NYPD didn’t immediately return a request for comment.

Indeed. What is needed though, is not a favorable judgment against De Blasio, but punitive action as well. Jail time. Breaking big rocks in the hot sun … where he fought the law, but the law won.

The more PRESS the better!
Our representatives should be ashamed of themselves. They all swear in to uphold this and ONLY Ms. Geller is coming forward to STAND UP for this. She shouldn’t have to go through the time and expense to do this. Our REPRESENTATIVES should be doing this if they weren’t so dam corrupt and self serving.

amen. i blame the repubs for all of this. they could have gone to court on day 1, or better yet, told the nation to ignore the democrats and the deep state “doctors”. i attended the protest in denver several weeks ago, and not one repub politician was present there to address the crowd and tell them to ignore the governor’s orders. they are all pussies

bobby: Don’t give up, Geller has room to maneuver. Standing relies on personal harms, and she has been harmed, by interfering with her right to organize pretests, and human rights is a core element of her business. Or she can change the suit to fit with financial harm, because of economic problems in NY caused by banning crowds. The first amendment is very broad, and it includes the right to petition the gov’t to redress grievances, including the grievances over the massive death in NYC retirement homes and hospitals. That right is also being ignored.

I’d like to know WHO determines what is considered “essential”?

Why is it that GOVERNMENT or COUNTY employess are considered “essential” and ONLY selected private sector employers are “essential”. I point to Home Depot, Walmart, construction to name a few. In our development, state employees are redoing roads yet CHURCHES and SYNAGOGUES remain closed and deemed not “essential”. Why are MOSQUES allowed to be open? Imagine the weddings and baptisms that had to be cancelled etc..

It is not normal or healthy for human beings to live an isolated life. Suicides, domestic abuse, drug abuse and also alcohol abuse are going up!

It will be time for CIVIL DISOBEDIENCE SOON!

An evangelical church network in California will ignore Democratic Gov. Gavin Newsom’s executive prohibitions this month, opening sanctuary doors for communal worship despite the ongoing coronavirus pandemic.

According to Fox News, California Church United, representing roughly 3,000 churches and 2.5 million congregants statewide, announced Thursday that it will return to conducting in-person services by Pentecost on May 31 rather than await the third phase of planned societal reopening.

“Our churches are part of the answer, not part of the problem,” Water of Life Community Church senior pastor Danny Carroll said. “We’re an essential part of this whole journey and we’ve been bypassed … kicked to the curb and deemed nonessential.”

“My church made 10,000 masks and gowns for doctors while practicing social distancing,” Brown told The Sun of San Bernardino County. “We feed people and procure electronic devices for seniors who are isolated. [Newsom] has no problem with all of that. But when we want to gather to worship, he has a problem.

“We have a pastor in the south, in Chula Vista feeding hungry people a mile long in cars, socially distancing,” Domen said, according to Fox. “How can the church not be essential?”

“It’s the heart of Jesus to love and care for all people. The heart of God supersedes government,” he added.

But other holdouts such as New York and Washington – despite revealing phased plans to do so – remain for the most part locked down indefinitely.

“As we look at what we need to do to responsibly reopen the state, we can’t help but note that yesterday, May 6 — so this is now over two months since our first case — 325 people walked through or were taken through the doors of hospitals,” New Jersey Gov. Phil Murphy said Thursday as protesters amassed once again at its statehouse in Trenton, reportedly chanting “open New Jersey now” and “freedom over fear!”

New Jersey – another one of the holdouts – reopened its parks and golf courses last week. Murphy around that time told “Fox & Friends” that the rest of his state’s reopening can begin to be phased in “as soon as we can responsibly get the health challenges under control” — which he thinks could be in a matter of weeks, not months. But as of Friday, that exact date remains unclear.

No bad idea. PG is just going after this erroneously. Mainly just to get a blow at deBlasio. Large gatherings inevitably will lead to close contact and possible contagion. It clearly makes nonsense of social distancing

Those in politics and the media who see fit to trample the constitutional liberties of the First Amendment of others need to be reminded that those are the very same constitutional guarantees that allow political discourse and a free media to even exist in the first place.

It is absolutely horrifying to see and to observe the draconian, bizarre, totalitarian measures and restrictions in the states and towns ruled by the Democrats.
At the same time, we are discovering how badly these states and towns have been governed, how many people “officially” are dying from Wuhan-Covid-19, what is revealed about the miserable treatment and dubious diagnoses and deaths in their hospitals and old people’s homes, how badly they ruined their economies for many years.

All of these and the godless past actions prove that Democrats are made of a disgusting and dangerous race, for Democrats the fate of other people is absolutely unimportant, if they cannot be exploited.

To benefit from others, Democrats try – like all groups based on nepotism and dictatorship – to breed useful idiots, slaves and cannon fodder.
Focused on their ideas, hedonism, lust for power, they have developed a coordinate system that suits them – in this they wallow like pigs in the mud.

Well – not everyone wants to wallow in the DEMOCRATS mud.
Not everyone is an idiot and wants to wake up echoed as a slave and as cannon fodder in DEMOCRATS coordinates.

The attempt to impose this coordinate system on people, who think and feel different, will fail – like all similar attempts in human history have failed.

Similar lawsuits must be brought in every jurisdiction where tyrannical governors and mayors are refusing to reopen the economy. This effort must not be limited to NYC. These wannabe tyrants must be turned back or they will continue to erode and erase our liberties. Te CCP Virus was designed to crush our economies and establish CCP hegemony. To allow these lockdowns to continue is to cede victory to the CCP.

In my opinion, the longer a State is shutdown because of the Coronavirus, the more Federal dollars they are hoping to get from the Federal Government.

What they should do is protest on the buses and in the subways.
That would show their opposition to a lot more people.
