Showdown Brews As U.N. Court Targets U.S. GIs

Story continues below advertisementAn international prosecutor, Fatou Bensuda, was advised Thursday by a panel at Hague that she should go ahead and investigate alleged war crimes committed by Americans in Afghanistan. It’s a shocking development.
Secretary of State Mike Pompeo called the International Criminal Court panel’s ruling “a truly breathtaking action by an unaccountable political institution masquerading as a legal body.” It is, but what to do?
In a little noticed address to the American Israel Public Affairs Committee last week, Senator Ted Cruz urged an American push at the United Nations Security Council to ban ICC investigations against Israelis, Americans, or citizens of any other non-member of the Hague-based court.
According to the Rome Statute, which governs the ICC — a global trial venue for war crimes and crimes against humanity — it has no jurisdiction over countries that have not joined its 123 member states. So non-members like America, Israel, China, Russia, and India are off limit. Or are they?
When the court started functioning in 2002, I made a bet with a friend, an avid universal jurisdiction supporter, that despite non-membership, Americans and Israelis would early on end up in the dock. I lost that bet, but only because I thought such ICC prosecutions would be launched right off the bat.
In the early days, the court went after alleged war criminals in places like Darfur, Congo, Burundi, and the Central African Republic. A few years ago, however, several African countries contended there’s a racist pattern against their continent and threatened to renounce their ICC membership. Political pressures grew on Ms. Bensouda, the Gambian-born ICC prosecutor, to land more visible non-African fish.
With that, a loophole was found to allow prosecution of Americans. In November 2017, Ms. Bensouda asked an ICC appeal panel to investigate cases against American military and CIA personnel over alleged war crimes in Afghanistan, which is an ICC member. Last year the panel rejected the request. What happened Thursday is that an appeals panel reversed the decision.
The new gusto to try Americans in Afghanistan looked a bit awkward at the exact moment the Trump administration pushes to end our presence in Afghanistan. The Afghan government opposes the ICC move but the court and its supporters in the West are delighted.
It’s not just Afghanistan. In 2015, Palestine, a UN “observer state” that is unrecognized by America and others, joined the ICC as a full-fledged member, and immediately pushed to try crimes allegedly committed by Israeli soldiers in the territory of its “state under occupation.” Last December, Ms. Bensouda asked the ICC appeals panel to open an investigation against Israelis combating terrorists in Gaza. That case is pending.
“I’d like to see an effort at the UN Security Council to prevent the International Criminal Court from moving against any nation state that is not a member,” Mr. Cruz told the American Israel Public Affairs Committee last week. Such a move, he said, “would protect Israel, and it would protect the United States from our enemies using the ICC to try to target our citizens and our soldiers for persecution.”
It could prove difficult, but not undoable. The much-cited concept of international law is based on agreed treaties and binding Security Council decisions. The 15 member council itself can be a wild card. Nine supporters must be gathered to pass a resolution. America’s habitual veto-wielding opponents, China and Russia, may in this case side with a resolution that would exempt them from the the Hague’s reach.
Hard to say at the moment. Most European members, though, are avid ICC supporters. America has leverage to pressure council members and, beyond Turtle Bay, Washington can use America’s global clout to press countries that have initially cheered the formation of the ICC (or at least thought joining would make them look good) to now drop out.
Following the post-WWII lustration at Nuremberg, war crimes and crimes against humanity were tried in international tribunals dedicated to specific cases, as in Rwanda and Bosnia. The formation of the ICC meant to replace such ad-hoc venues with a permanent, global body. What’s coming to a head is a showdown over that mistake.

This was another gift from the Democrats. Who led the U.S. delegation to the founding in San Francisco? Ever heard of Lager Hiss? Anyone think FDR was not a Marxist has not been really looking. It’s Alger Hiss, I do that quite often at my age, but you’re absolutely correct. When the Soviet Union fell, the Verona papers exposed all of this. Of course, it won’t be mentioned since it proves what you are saying to be correct. And we can’t have academia teaching the truth…I mean how can they support people like Bernie? Nixon was hated much because he exposed this as a Congressman. Yeah…get out of the UN…move it out of America, and don’t let the doorknob hit them in the butt on the way out. Trump may have found a way to changing NATO and UN importance. Trump is doing something interesting. He wants Brazil to join NATO (North American Treaty Organization). Of course Brazil doesn’t fit that old grouping and the old purpose of NATO doesn’t exist anymore and that is the whoel purpose of it. Trump could redefine NATO, plus have the U.N. be less relevant.

Since the ‘WORLD’ has no UNIFIED law system, it operates on what the INTERNATIONAL PROSECUTOR suggests or chooses and therefore is BIASED, at least that is the consensus or goal. You cannot have different laws for each country and then expect an INTERNATIONAL PROSECUTOR to rule. That country will never accept the outcome/verdict if it does not meet WHAT THEY WANT. Every country is biased, even America because its people only know THAT LAW of their land. Unless every country lives under A ONE-WORLD GOVERNMENT AND THEIR LAWS, IT WILL NEVER SUCCEED. This is why the Book of Revelation states that soon, the world WILL BE under a one-world government. Right now, it is not, but I will predict that AFTER PRESIDENT TRUMP LEAVES OFFICE, THAT IS WHAT THE ‘WORLD’ POWERS WILL WANT AND THEY WILL GET IT, no matter what you and I say because WE WILL HAVE NO POWER BY THEN.
Of course, I will be gone by then as I am a follower of Christ, filled with the Holy Spirit and will therefore be taken from this world that is controlled by Satan. That is our reality, and it’s not a good prognosis albeit not entirely hopeless.

The so-called UN’s Court would be a kangaroo court or camel court, an egregious attempt to sleight the reputation and lives of our courageous military. It comes as no surprise, as the UN is a front for terrorism, The enemies our troops face follow no International Laws, they are barbarian terrorists out to kill Americans or civilians by any means. Our troops’ hands are tied by Rules of Engagement, as not to kill someone not bearing a weapon. The UN should be dismantled and shipped to some nation, Iran, N Korea, China, as it is they whom the UN advocates.

The U.N. is a re constitution of the League of Nations, which was founded after WW1, the so called “war to end all wars”. Interestingly, as part of the U.N.`s charter, acts that were passed by the League of Nations were incorporated into it. One of these acts (I believe #80), granted a great deal of land for the renaissance of the nation of Israel. This land was to be comprised of all of biblical Israel (current day Israel, Judea, Samaria, all of Jordan, the Golan and Gaza), but, thanks to the collusion between Perfidious Albion (Great Britain) and France, the aforementioned didn`t happen. Instead, in 1947, a small piece of biblical Israel was “given” to Jews to be the renewed Israel. A year later, the real fun began……

The John Birch Society, and many others, have been right all along.
It’s long past time that we terminate our support of the UN, which has been demonstrated repeatedly to be infested with corruption and graft at many levels, including kicking their headquarters out of the USA.
We could take the Headquarters Complex and convert it to a Service Center and Low Cost Housing for US Veterans and their dependents/survivors. This would serve the dual purpose of removing a source of political infection and upgrading the quality of life for many of our veterans at a lower cost than would otherwse be possible in the NYC area.

While I accept the “vote of confidence”, I’m not now, never have been, and never will be a candidate for public office. You can help most to promote this idea by helping to explain it in as many different forums as possible.
As to my not running for public office, I recognized a long time ago that I do not have the temperament required for public office. I’ve worked in a close enough analog within a Fraternal Order to be intimately familiar with how the legislative process operates, and I don’t have either the intestinal fortitude to deal with the graft and grifters that infest politics or the facility as a bare faced liar that seems to be the stock in trade of too many politicians.
