Federal Appeals Court Rules Trump Administration Can Keep Sending Asylum Seekers to Mexico

A federal appeals court ruled on Tuesday that the Trump Administration can continue to keep returning asylum seekers in Mexico (for now).

A panel of three judges on the US Court of Appeals for the 9th Circuit cited many different reasons for allowing the migrants to stay in Mexico while they wait for an immigration judge to hear their cases.

This is yet another victory for Trump and America.
Politico reported:

Judge Diarmuid O’Scannlain, an appointee of former President Ronald Reagan, authored the 11-page opinion and wrote that the administration was likely to succeed on legal challenges to the policy under federal immigration and regulatory law.

O’Scannlain also said the Homeland Security Department could face harm if a federal court order freezes one of its enforcement tools.

“DHS is likely to suffer irreparable harm absent a stay because the preliminary injunction takes off the table one of the few congressionally authorized measures available to process the approximately 2,000 migrants who are currently arriving at the nation’s southern border on a daily basis,” he wrote.

The other two judges — Obama and Clinton appointees — also backed allowing the policy to stay in effect, but raised questions about it in concurring opinions.

Judge William Fletcher, the Clinton appointee, argued that existing federal statute did not allow DHS to send migrants to Mexico under the program.

“The government is wrong,” he wrote. “Not just arguably wrong, but clearly and flagrantly wrong.“

Last month Judge Richard Seeborg blocked President Trump’s policy of returning asylum seekers to Mexico as they wait their turn for an immigration judge to hear their cases.

Judge Seeborg, an Obama appointee in San Francisco, granted a request by a civil liberties group that sued the Trump Administration on behalf of 11 asylum seekers from Central America.

The lawsuit claims the Trump Administration violated US law by failing to properly evaluate the dangers that migrants face in Mexico — it also accuses DHS officials of depriving migrants of their right to apply for asylum.

Tuesday’s ruling in favor of the Trump administration will stay in effect until the case continues before the appeals court.

Dirt and crime: Brussels bus driver avoids northern railway station

Bus drivers of the Belgian public transport company De Lijn have announced that they will no longer stop at Brussels Nordbahnhof due to the hygienic conditions and the poor security situation. “It is unacceptable that we should be exposed to the dangers of the northern station for much longer, both in terms of safety and health. That applies to the drivers and to our passengers”, the Belgian media quote a communication from trade unions.

Last week newspapers reported cases of malaria, tuberculosis and scabies around the station. There are many homeless people and migrants in the area.

Meanwhile, it became known that on Sunday morning a camera team from RTL-TVI was attacked while filming at the northern station. Bus drivers had already avoided the stop at the Nordbahnhof last November.

I was happy to read that yesterday! I was going to post it as another “off topic”. It is an uphill battle. Every time Trump does something to stop the invasion, a liberal judge pops up to block it and it has to be appealed. Trump is doing what he can. I hope the acting DHS Secretary is replaced soon.

Immigration judges cannot release migrants who are caught sneaking into the United States, even if the migrants ask for asylum, says a binding legal decision by Attorney General William Barr.
The decision will dramatically shift the migration-caused civic and housing crises from the nation’s blue-collar communities over to the Congress and the Department of Homeland Security, whose budget and detention centers only have enough resources to house about 50,000 people year-round.

“The [text of the relevant] Act provides that, if an alien in expedited proceedings establishes a credible fear, he “shall be detained for further consideration of the application for asylum,” says Barr’s April 16 decision, titled. Matter of M-S-. Because of the law, “I order that, unless DHS paroles the respondent under section 212(d)(5)(A) of the Act, he must be detained until his removal proceedings conclude.”

“This is a HUGE ruling that will harm thousands seeking protection from persecution at the US border since far more will be held in detention even after passing the threshold screening under the credible fear standard,” complained Greg Chen, director of government relations at the American Immigration Lawyers Association.

The association’s lawyers make their money by guiding migrants and corporate hiring managers through the extremely dense network of migration laws and regulations. But Barr’s decision blocks the use of a common path for migrants who are trying to get through the courts and into the U.S. jobs they need to repay the smuggling fees they owe to the cartels.

Barr directed officials to delay implementation of the law for 90 days, giving DHS managers — and congressional leaders — three months to decide which migrants should be released into the nation’s cities and towns.

The delay gives time for DHS to set up tent cities where migrants can be held until the judges decide the asylum pleas. If DHS detains most of the migrants — and so prevents them from working — the next wave of migrants may decide that any effort to get into the United would be an economic disaster for their families.

Atheist Group Sues to Remove Bible from New Hampshire Veterans Affairs POW Display

A lawsuit was filed against the hospital by the anti-Christian Military Religious Freedom Foundation (MRFF), a group with a history of attacking Christians across the country. The lawsuit calls the display of the Christian Bible an “outrage” and a violation of the U.S. Constitution, Fox News reported.

MRFF claims it filed the suit on behalf of a New Hampshire veteran named James Chamberlain.

“As a Christian, [Chamberlain] respects and loves all his military brothers and sisters and does not want to be exclusionary by placement of the Christian Bible,” the filing says.

Mikey Weinstein, the founder of the anti-Christian organization, attacked the display, saying it was a “repugnant example of fundamentalist Christian triumphalism, exceptionalism, superiority, and domination, and it cannot stand.”

For its part, the facility did remove the Bible from the POW display when the MRFF first complained. But the book was returned to the display when the veterans protested its removal.

Are you sure you have that right? Isn’t Mikey Islamophobic as well as anti-Christian?? I was sure that someone once said that he thought that he heard anti-Islamic slurs coming from Mikey?? Hmmm, could be, I guess.

These INVADERS are NOT Citizens of America. Thus, these INVADERS have “NO STANDING” in an American COURT. Any Judge would see this and THROW OUT THE CASE. SEND THEM BACK TO Mexico which allowed the access. Their situation belongs to Mexico!!!!!
