Miscarriage of Justice: Judge Dismisses Lawsuit Alleging FBI Role in 2015 Jihad Attack on AFDI Event in Texas

In another court filing related to Joiner’s suit, the DOJ had described the ‘tear up Texas’ text message as ‘innocuous.’ In March of last year, the undercover agent testified against the ringleader of the entire attack, Erick Jamal Hendricks. The testimony came under highly unusual circumstances where the agent appeared on the stand under a light disguise and using a pseudonym, and the courtroom was cleared except for attorneys, jury members, and essential court members. In that testimony, the agent said he did not have advance knowledge of the attack, and was surprised when the shooting began.”

This undercover agent’s story defies belief. He claims that when he told jihadi Ibrahim Simpson to “tear up Texas,” that he was only saying what a mujahid, a warrior of jihad, would say, and that he wasn’t encouraging Simpson to “tear up Texas” himself.

The agent is apparently hoping that everyone will forget that Ibrahim Simpson and Erick Jamal Hendricks thought he was a Muslim who was interested in waging jihad against unbelievers. They didn’t know he was an agent. So when he said to “tear up Texas,” Simpson likely saw it as confirmation.

And then this agent wants us to believe that he didn’t know that Simpson and Nadir Soofi had traveled from Phoenix to Garland, Texas to attack the event, and he was shocked when they got out of the car and opened fire. He was right behind them. Did he not notice their Arizona license plate? Did he not know what these men he had been communicating with for so long looked like, and was not able to recognize them from the back? And all this time he was communicating with them and telling them to “tear up Texas” and he didn’t know that that’s exactly what they were planning to do?

The undercover agent’s testimony is absolutely beyond belief. It is the FBI covering up its complicity in this attack. If they were telling Simpson to “tear up Texas,” they had every reason to suspect that just that would happen. Yet they had no agents in place to repel a jihad attack. And they refuse to answer questions about why.

Hendricks made it clear that he was an ISIS supporter and spoke of using acres of land to train recruits, the agent said.

“My work is for Allah. It is my full-time job,” said Erick Jamal Hendricks, making it clear once again what jihad violence is all about. It’s ironic that he said it to an FBI agent, with the FBI committed to the claim that Islam is a religion of peace that has nothing to do with terrorism. Did the agent try to convince Hendricks that he was misunderstanding Islam?

A federal judge has dismissed a lawsuit by a security guard who was injured during a 2015 terror attack by ISIS radicals in Garland, Texas. Bruce Joiner alleged the FBI was liable, arguing the bureau had prior knowledge of the impending violence and had even helped incubate the idea with attackers, but then failed to stop it.

Joiner was shot in the lower leg after Elton Simpson and Nadir Soofi opened fire at a perimeter checkpoint at the Curtis Culwell Center in Garland, where inside “The First Annual Muhammad Art Exhibit and Contest” was taking place.

ISIS later claimed responsibility, marking the first time the terror group ever carried out an attack on U.S. soil. Simpson and Soofi were fatally shot within yards of where their attack began.

Documents released through other court cases, however, revealed how close the FBI was to the action of the attack, which has since drawn media and congressional scrutiny.

Shortly after the “Muhammad Art Exhibit” event was announced in early 2015, the undercover agent who had been infiltrating the small cell of radicals texted Simpson, saying, “tear up Texas.”

Additionally, the undercover agent was in a separate car directly behind Simpson and Soofi when they opened fire and had been taking pictures of the attackers’ car just seconds before the shooting began.

When the first shots were fired, the undercover agent fled his own vehicle, but was apprehended by local police, at which point the agent told police he was undercover with the FBI.

Joiner claimed the FBI was liable for his injury and was seeking millions in damages but has consistently maintained that his lawsuit was about getting information from the bureau to uncover the full extent of their actions leading up to the attack.

“It seems like it had to have been one or the other,” Joiner’s attorney Trenton Roberts said in 2017, just a few months before filing the lawsuit. “Just a complete botched operation where [the FBI] don’t want the attack to actually take place, or, it’s something where they need the attack to take place in order for [the agent] to advance in the world of ISIS.”

Joiner and Roberts went further in their court filing, alleging a cover up at the highest levels of the FBI.

“In the aftermath of the attack, former FBI Director James Comey lied to the American people by claiming that Simpson was a ‘needle in a haystack’ that was ‘invisible to us,'” the filing said. “Even after it had come to light that an undercover FBI agent had been communicating extensively with the terrorists during the week prior to the event and had accompanied them as they carried out the attack, the FBI continued to assert that ‘there was no advance knowledge of a plot to attack the cartoon drawing contest.'”

Roberts did not respond to requests for comment for this article, including questions as to whether any kind of appeal might be pursued.

The Department of Justice and the FBI were invoking government immunity for their defense.

Judge Karen Gren Scholer in the Northern division of U.S. District Court delivered her ruling on the Friday before Christmas.

“The Court finds that the conduct alleged by Plaintiff fall within the scope of the discretionary authority conferred on the FBI by the Undercover Guidelines and the DOIG [Domestic Investigations and Operations Guide].”

As the case progressed in 2017, the DOJ lawyers representing the FBI had asked the judge to delay discovery in the case until a ruling on dismissal had been provided. Therefore, another consequence of Scholer’s ruling is that Joiner did not receive any additional documentation from the bureau about their activities leading up to the attack, and the odds of ever obtaining any additional information from the FBI now seem slim or nonexistent.

There is apparently one set of laws for Moslems and a different set of laws for WE THE PEOPLE who are not Moslems.

I went to Garland because I knew the jihadi would come, the only question was would it be one or one thousand. That and Pam gave me free tickets as I had entries in the contest. Extreme right wing to extreme liberals were there. All civil and you could talk to them. Look at all we know now about our gobermint. Time for the whole deep state apparatus to go. I was there in Garland that day. Little did I know my own government was going to be an accomplice in trying to have me killed for looking at cartoons. This is a blatant cover-up to hide the fact that Obama and his FBI wanted everyone at that event DEAD.The potential victims of this attack, including myself, and the American people, deserve JUSTICE and TRUTH, not this total bullshit from the people who ostensibly work for us. I wasn’t born yesterday and these assholes are LYING their butts off and the goddamned judges are obviously in the bag as well. Does ANYONE give a damn?

Hello Tom. I was there too. Since then I’ve went to Act for America meetings, learned everything I can about Islam and found no one truly interested in a solution. We are losing. The little or no news of this event tells a lot. However i would like to know exactly what happened that day. The location of the muzzum car, the location of the Guards when they were fired upon. Weapons involved. How many shots fired by both sides. The only pic i always see is the car with the trunk blown off. Was there explosives? I understand the guards held the line with handguns only. I would like to see a drawing of all the locations. i can’t find anything. And yes I think I would scratch out some kind of drawing of momad and enter.

There is some video out there on it but from 100ft away. A single police officer fired twice from what I understand during which he received a ricochet in the leg. I was inside and heard the shots echoing off the glass and some of the audience whom had started out the door started coming back in briskly but not afraid. Then they moved us more inside the building. Everything happened very professionally and one of the officers was shaken up a little after seeing a shooting. I can see why. These guys were shot dead and just thrown into the back of a van like it was just another day. The only thing they spent real time with was the car, which they finally just blew up at 2:43 in the morning. Next time I’d just get a front end loader or a Lull and put a shield of 1/2″ plate for protection from a blast and dump it into an end dump and take it out of the city. Even if it was triggered while in transport it would blow upward, but then it all depends on circumstances of travel route compared with disarming a potential threat in place.

Bradley….Thank You!! So LEO blew up the car suspecting explosives. Makes since now. Kudos to the boys who held the line. Don’t know the distance, but that’s damn good shoot’in with a handgun. My personal opinion is that more of this kind of action needs to take place. If the bad guy makes a play then his chances of walking away are pretty much nil. I live some 40 miles from VA TECH and vividly remember that day. Campus wannabe’s would not enter the facility as they were “waiting for back up” (SWAT). Lot of kids died. Same as Parkland FL. These guys are paid to draw fire away from innocents. Many Blessings to you.

There wasn’t anyone in attendance that thought it was LEO’s responsibility to protect us. If you’re going to do something provocative, own it yourself. That being said, there wasn’t a way of organizing this event any other way, as it wasn’t an established group putting it on. No one could come in without everything checked. When the shooting started a security detail guy stepped forward and took charge of the crowd. Basically saying ” Don’t worry, we’ve got this”, as if he was used to dealing with possibly panicky people. We kept saying we’ve got plans and contingency plans and interference would complicate things. Which was a given, but was said to reassure what could have been an anxious crowd. This wasn’t an anxious crowd. If you weren’t solid in your principles and had some righteous indignation against evil you didn’t come to the event. We think the muslins are the biggest problem, but who brought them here and why? The deep state and contrary to fox news their not hold overs of the Obama administration. Besides justice being denied Pamela, Robert, etc. imagine the message this conveys to jihadists! So expect more attacks just like the one in Garland.

And who will be responsible? America (herself) shares the blame for future Islamic terrorist attacks. That’s, really, what this decision means.
