Federal judge rules to protect provisional ballots, Abrams’ campaign cheers ‘good news’

A federal judge on Monday ordered Georgia take steps to protect provisional ballots and to wait until Friday to certify the results of the midterm elections that include an unsettled race for governor.

Lauren Groh-Wargo, Abrams campaign manager, announced Judge Amy Totenberg’s decision late Monday. WSBTV.com reported that the judge’s 56-page ruling could affect thousands of provisional ballots. Groh-Wargo called the ruling “good news.”

Brian Kemp, her Republican challenger, issued a statement a day earlier calling for Abrams to concede. Kemp has declared victory and said it is “mathematically impossible” for her campaign to force a runoff.

Abrams’ campaign did not immediately respond to a phone call from Fox News late Monday night.

Abrams, 44, a Democrat, has maintained that she will not concede until every vote has been counted, and pointed to the 5,000 votes tallied over the weekend that favored her.

Totenberg, who was appointed by President Obama, ruled in connection to Common Cause’s lawsuit filed on Nov. 5. Totenberg’s order doesn’t change the Tuesday deadline for counties to certify their results.

Common Cause, a nonpartisan group, claimed in the suit that Kemp, while secretary of state, failed to maintain “the security of voter information despite known vulnerabilities” leading up to the midterm. The suit blasted the state’s “provisional ballot scheme,” that could disenfranchise a registered voter at the ballot box.

The suit pointed out cases where voters were turned around after computer glitches and cases where voters were not offered provisional ballots. One man voted for decades and was “disturbed” to learn his registration history was erased.

The court ruled that the secretary of state’s office must establish a hotline and publicize it on its website for voters to see if their provisional ballots were counted. Totenberg also ruled that Georgia must not certify the election results before Friday at 5 p.m., which falls before the Nov. 20 deadline set by state law.

“I am fighting to make sure our democracy works for and represents everyone who has ever put their faith in it. I am fighting for every Georgian who cast a ballot with the promise that their vote would count,” Abrams said in a statement explaining her refusal to end her bid to become the first black woman elected governor in American history.

A total of 21,190 provisional ballots were cast in the state during the midterm, 12,151 were cast in 2014. Four Democratic-leaning counties with the largest number of provisional ballots — Cobb, DeKalb, Fulton, and Gwinnett – “had not yet reported their numbers to the secretary as of November 11,” the suit said.

The lawsuit also asked that provisional ballots cast by a voter registered in another county be counted as if the voter had shown up at the wrong precinct. The lawsuit says that of the 1,556 provisional ballots Fulton County reported having rejected by Nov. 9, nearly 1,000 were disqualified because they were cast by voters whose registration records showed them registered in another county.

Edgardo Cortes, who currently works as an election security adviser at New York University, said these uncounted provisional ballots could sway the election and, despite Kemp’s claims, his unofficial vote total is so close to 50 percent, a runoff is possible.

Kemp was up 50.2 percent to Abrams’ 48.7 percent early Tuesday. More than 3.9 million votes were cast in the election, and Abrams would need to acquire more than 20,000 additional votes to force a runoff.

Abrams’ campaign filed a lawsuit Sunday asking a federal court to push the deadline for counties to certify their results to Wednesday, while also requiring that elections authorities count certain provisional and absentee ballots that have been or would be rejected for “arbitrary reasons.”

“This ruling is a victory for the voters of Georgia because we are all stronger when every eligible voter is allowed to participate in our elections,” Sara Henderson, executive director for Common Cause Georgia, which filed the lawsuit, told AJC.com.

Agreed. It reminds me of my days as a football coach. If you played one of those schools with a misplaced sense of their own importance and privelege and they beat you, it is because they were supposed to. But if you beat them, then something is wrong, such as you used an ineligible player or the refs cheated. You know, like “Russian collusion.”

All I heard was Trump’s message. What did Congress with the majority deliver other than tax cuts?
The GOP had the majority but they don’t stick together. The GOP is happier being the minority.
That is the ugly truth. Ryan was as quiet as a mouse. Mitch at least stood firm on Kavanaugh.

The Demokkkrats roll out their Voter Fraud and Election Stealing machine every time. And the Republicans haven’t even got their attorneys on speed dial. “To use a provisional ballot, each voter whose eligibility to vote is UNCERTAIN must provide a written affirmation, signed in front of an election official at the polling place, stating that he or she is a registered voter and is eligible to vote in the election.”

So unregistered voters and illegals will be counted as legitimate ballots. Notice there is no effort made to ascertain if the ballot SHOULD be counted! Nope! Just COUNT IT and magically the DEM will win. They should NOT be counted. There should be no such thing as a provisional ballot. You have plenty of time to get on the roll with the proper ID – oops DEMS don’t want ID’s. Let’s put it this way, with whatever is required to vote, if anything, there is plenty of time to get that in order and be on the voter roll. This is a joke! Can you imagine what 2020 will be like?

I live in Georgia and governor-elect Kemp has figuratively given Abrams credit for EVERY outstanding ballot which stills does not give her the necessary number of votes to induce a run-off.

This is total grandstanding by the Dems in order to once again keep a campaign going in order to marginalize the Republican winner as unjustly elected and thus, illegitimate, just as they have done to Trump. The Dems are also wanting to keep their voters riled up to get to the polls for the Secretary of State run off in a few weeks.

The Dems are always in our faces and just never, ever give up.

Actually Felix it is worse than that. The rule at the polls where I have been are:
1. If you do not have ID you can sign an attestation and are given a regular ballot that goes into the counter. But I see no way that the attestation could be confirmed. So the entire idea of having ID is nonsense!
2. If you have ID and if there is a discrepancy between the ID shown and the ID in the poll book THEN you get a provisional ballot, which goes into a separate envelope and does NOT go into the counter. We are told that they are checked and counted only if the election is close. But no one knows what really happens to those ballots when we lose site of them.

So basically NO ID gets you a ballot only for signing a piece of paper and nothing is done to determine if the attestation is true. So in fact anyone in the US can already vote without ID!

I am with you all the way. There should be no provisional ballots and there should be no attestations. And there should be no deviations between the name on the poll book and your ID.

Why Are Provisional Ballots Issued?

For a voter to cast a provisional ballot, there must be some question as to his or her eligibility to vote. These questions vary across states. The most common reasons, as identified by the EAC, are:

The voter’s name is not on the poll or registration list
The voter’s eligibility cannot be otherwise established
The voter’s identity and/or eligibility to vote has been challenged by a poll-worker or election official
The voter does not have identification as required by that state
The voter requested an absentee ballot but claims he or she either didn’t receive it or didn’t cast it
The voter’s address or name has changed but their voter registration information does not reflect the change
For primaries, the voter registration reflects an error in party listing
Most states have additional reasons specific to those states. In addition, HAVA requires all states to issue provisional ballots if the polling place hours are extended by court order.

So in Georgia, they are going to try to count the illegal votes of Felons, non-citizens, non-registered voters, illegals, and dead people. The future offered by the Demonrats sure looks bright! Not! They cannot be allowed to steal the elections in Florida and Georgia. They already stole it in Arizona. McSally should have never conceded without a terrific fight to verify votes. It was the establishment flowing through her veins I suppose. If the Demonrats succeed, the will of the people exercised through voting will be lost forever, unless we take up arms like they did in Athens, TN in the late 1940’s. Get your torches and pitchforks and begin the demonstrations.

My understanding is that there are ongoing investigations in every state in America with particular interest in Florida, Arizona, Georgia and California. Oh, and the fully unredacted FISA should be coming out before long. That will bring down the house. Q uite interesting.
