CNN is a fake news outlet. How is this a right? Furthermore, it is not lost on me, of all people, that CNN is suing based on their First Amendment rights when they have denied me (and many of my colleagues ours). They attacked and smeared us for our free speech event in Texas in submission to the speech laws under the sharia.

They adhere to the draconian prohibitions on speech under Islamic law. And they self-comply.

Speaking after the ruling, Ted Boutros, an attorney for CNN said the news organization is “Extremely pleased with the ruling today.”

“A great day for the First Amendment and journalism,” he said. “We’re very excited to have Mr. Acosta be able to go back and get his hard pass and report the news about the White House.”

CNBC, November 14, 2018:

A federal judge on Friday grants CNN’s request for a court order that would temporarily reinstate network correspondent Jim Acosta’s White House press pass.

CNN’s legal challenge comes in response to the Trump administration’s decision last week to yank Acosta’s “hard pass,” which gave him access to the White House grounds, after Acosta clashed with the president at a news conference earlier that day.

CNN’s lawsuit underscores Trump’s increasingly hostile relationship with many mainstream media outlets, which he regularly decries as “fake news” and “the enemy of the people.”

Seen a few posts here and I’m hoping you can set the record straight as to what exactly qualifies a person to have press credentials in the first place. Seems to be an unknown. If audience numbers is a qualifier, then others have more standing.

IINM, it has to do with working for a bona fide news organization. If Trump were to say that CNN is not such, he would then have the burden of proof of showing how he arrived at such a decision neutral in content. CNN has 50 passes, but most organizations have more passes than will be there at one time, just in case, since no organization has more than 2 reporters there at any one time.

Or you’re asking a dumb question! The judge cited precedent in his circuit by which he is bound (Sherrill v. Knight). You knew or should have known about that case. Trump was wrong and so are you…and that’s final!

There were many judges that, over the years, cited Dred Scott and Plessy v. Ferguson and Buck v. Bell (which institutionalized eugenic sterilization) as “precedent.” You are clearly in league with an entity that is an avowed enemy of the American people if you agree with that ruling.

This judge was appointed by Trump. His ruling cited specifically the lack of a code of conduct. As for CNN, as they are not government (addressing Geller now), they cannot deny Geller 1A rights.

Unfortunately this is a Trump appointed judge.

“The Trump administration countered the motion, saying Acosta “disrupted the fair and orderly administration of a press conference” when he refused to give up the microphone. Judge Kelly dismissed the Trump administration’s claim that CNN could simply send another reporter in Acosta’s place and told attorneys to file additional court papers in the case by Monday.”

Acosta has emerged as a hero of the #Resistance after making a habit of shouting and interrupting when Trump and members of his administration are available to the media. Acosta has also gotten into combative arguments with other members of the administration, including former Press Secretary Sean Spicer, Management and Budget Director Mick Mulvaney and Senior Policy Adviser Stephen Miller.

Yes, I don’t quite understand it. However, I was talking to an ace reporter from the Pioneer Republican, a weekly published in Marengo, Iowa. I couldn’t quite understand why she did not have a White House “hard pass”. Perhaps, precedent has been set and she should receive one, as to have denied her the pass is definitely, pursuant to that judge’s order, a violation of the First Amendment. Hayull, I want one too.

Agreed. As a solid response, the WH is rewriting its code of conduct for those attending briefings. You can bet your ass that getting physical with the WH staff members will be very near the top of the list.

Lack of a written code to enforce = denial of due process. This is an open-and-shut 5A case thanks to an unforced error by Trump, although the judge is ensuring there won’t be a repeat by having a code written and approved by him.

How is this even a 5th amendment case? Was Acosta arrested? Was he imprisoned and then prosecuted unjustly for a crime? Or was he just excluded because he’s a jerk? Precedent and not the 5th Amendment dictates that the President can choose who he speaks to and who he doesn’t. If Trump had Acosta imprisoned and held then due process because a factor. That is not the case here. The judge’s ruling here is almost like saying that one is required to allow somebody who entered your house to stay against your will. I shouldn’t need a reason to ask somebody to leave and asking them to leave is not a due process issue.

He is NOT an American and his own white grandmother SAID so on national TV before the 08 election – I heard and saw her speak! I have watched Sarah Sanders press briefing over at the Conservative Tree House. All he does is grandstand.
His questions are accusatory and he argues when replied to. He takes up time not allowing others to get their questions in. The news is about HIM! He rarely gets his facts straight so we have moved beyond fake news to being an unruly, disrespectful cretin. Even a school teacher can expel a student for this disruptive and disrespectful behavior. There are civilized LIMITS to “free speech”. Try shouting down a flight attendant or yelling “fire” in a theater or “I have a bomb in my suitcase” while in line to check in at an airport. Even the woman who would NOT sit for the plane to take off because a RAPIST was being deported was punished. This is a wrong decision.

As president Trump stated this morning, decorum rules and regulations will now be outlined and applied. More importantly, while non-violent free speech is sacrosanct and must be protected, there is nothing in our constitution that requires anyone to answer. Though I understand saying nothing to a question has its ramifications, there is nothing in the coostitution that requires anyone to answer every question posed.

Does a judge tell a president what to do? Does a judge determine what is right and wrong? Where is the trial by jury to be judged by his peers?

Yes and yes. As for trial by jury, that will happen later. Trump will lose because the facts of the case indicate that there were no written codes of conduct. The Fifth Amendment applies to all of government, and you need a written code to have it.

The judge apparently does see a need to define this, or at least codes of conduct. What should also be mandated is a lottery (conducted externally) for reporters to ask questions each session (twice weekly)…the Press Secretary not knowing beforehand who won the lottery, or the questioning.

They will appeal, but I see it being upheld since there wasn’t a written code of conduct to enforce. The judge wants one by Tuesday that he would then sign off on, that would then be binding going forward.

Activist Judges issuing fake opinions based on other law besides the Constitution, are separating reporters, business owners and citizens into categories of those with rights, and those without rights, based on their political leanings, their race and sexual orientation.
Unconstitutional opinons of rogue judges are null and void. By following judicial opinions that are unconstitutional, politicians and citizens make our founding documents null and void, and place judges on thrones as dictators ruling over the other two branches of the government.
Remember the ‘Separation of Powers’! None of the three branches of government have ultimate power over the other two, allowing for checks and balances.
But the Constitution isn’t being followed in our country today…by any branch of the federal government, or most state governments.

Is anyone surprised that an “activist” judge ruled in error? Yes, this judge was a Trump appointee, recommended to him by an obvious RINO. This is not about freedom of speech; Acosta is free to spew his vitriol whenever he wishes, but not in the White House. Did you know there are 50 other CNN reporters holding hard WH press passes? Being allowed to go to a WH briefing is a privilege, not a right. If you conduct yourself like a fool, you can expect to be removed. A federal judge doesn’t have the authority to dictate how the executive branch runs their house. There was no suppression of 1st amendment rights; CNN has 50 other “reporters” in the room. Basically, if I were President, I’d tell the judge to get bent. It ain’t his house.

Trump had the last word, however, and said if it happens again, he and his staff will simply leave the room and the “journalists” will be left sitting there facing an empty podium. And that is the right thing to do! If they’re going to be rude and accusatory, rather than asking real questions, there is NO reason he should stay in the room.

If what you say is true, then over 200 years of precedent must be thrown out. This was decided on Fifth Amendment grounds, not First Amendment grounds.

More and more I realize there needs to be a right-wing, patriotic TV station which will report the true unadulterated news and many pro American documentaries and stories. There is a series called “Lives of Great Americans” — the one I saw was about Frank Lloyd Wright. There are many about the deeds of our Founding Fathers,especially one about all the inventions of Benjamin Franklin — what a genius — and our other Inventors, writers and artists. Biographies of all our heroes. Who gets to see all these wondrful offerings? No one.

Why cannot such a TV starion be established? It would make millions because so many would want to advertise there and millions of people would watch it and put all the others to shame — CNN would soon be bankrupt and disappear, including Acosta. Why are ALL the TV stations controlled by the swamp creatures?. And ALL the newspapers? I can understand why Communists and Seditionists could get control of one or two newspapers, but ALL of them? Is it a matter of money??? were they bought, and sold out?? All our universities were bought with Saudi money — it is said you cannot just buy a professor at Harvard, you can buy a whole department. Where were the Alumni?? The protests? All our universities are in the hands of the enemy and that’s why nearly half of American citizens are anti-Trump, our students have been perverted — any thinking person could only vote for him, who is standing there like a sacrificial giant taking the slings and arrows and protecting us from the total destruction we would suffer without him. May God bless him.

I can tell you why such a TV station wouldn’t be established:

1. No large market audience.
2. No significant audience in the 25-54 age demographic (MSNBC occasionally wins in this critical demo)
3. No existing channel space that could be used for such.

This is why Trump wanted so hard for Sinclair to succeed in buying Tribune (this transaction collapsed in August).

I don’t agree — I believe the audience would be enormous — just look at all the crowds that come to Trump’s rallies — of all ages and types, and all the people who make comments to all the blogs. Everybody is sick and tired of all the blasphemy on CNN and Co. — it is dying. I don’t mean just patriotic stuff — show Father Botros, the Coptic Monk who villifies islam by showing passages direct from the koran, infuriating the islamists because they cannot deny it — and have Kamal Saleem and oher apostates wwho have become Christians after having seen that Islam is just a hoax — You cannot tell he truth about islam ANYWHERE, but it mut be unmasked. There are great personalities who could give talks and inspire our unknowing citizens.
I didnÄt know about the the buying of The Tribune — which Tribune, the one in Chicago, or the one in Paris?? Some way, righteousness has to break through the wall of lies surrounding us at every turn and let the truth be provlaimed.

What a half-baked fool of a judge! Does his ‘mummy’ know he’s out? Utterly clueless, compromising, weak and knows little to nothing about the real world. So a reporter can conduct himself rudely, ignorantly, try to hijack a White House press conference, be rude to a WH employee, and this is okay?
