US court blocks Arizona law targeting Israel boycotters

A Federal court just overturned Arizona’s anti-BDS law. The court said that the anti-BDS law, enacted by Arizona, violates the free speech rights of Americans who want to engage in boycotting Israel. This decision will undoubtedly encourage Israel-haters to fight the anti-BDS legislation that has been enacted in 24 other states. The fight against the BDS is intensifying, and will surely reach the Supreme Court in the coming years.

Those in the pro-Israel community should be watching the Judge Kavanaugh Supreme Court nomination process very closely. If Kavanaugh is confirmed, and the Supreme Court has a conservative majority, the BDS movement will suffer many defeats at the Supreme Court. However, if the Socialist Democrats are successful in derailing the Kavanaugh nomination, the BDS movement will certainly chalk up a number of victories in the future. One should expect that the four left-wing Supreme Court justices (three of whom are Jewish) to support the anti-Semitic BDS movement. Judge Kavanaugh on the Supreme Court will prove to be vital in successfully fighting the BDS movement for years to come.

A US federal court blocked an Arizona law requiring state contractors to certify that they will not boycott Israel, finding that the law likely violates the contractors’ free speech rights.

“A restriction of one’s ability to participate in collective calls to oppose Israel unquestionably burdens the protected expression of companies wishing to engage in such a boycott,” District Court Judge Diane Humetewa wrote in Thursday’s order blocking the law.

The judge also said that the law interferes with First Amendment rights, the news site Tuscon.com reported.

I have often commented that those who support the BDS movement are either being fooled by the fallacious Arab propaganda that claims that Israel is an apartheid state, and is an illegal creation of the U.N. and are “occupiers.” Otherwise, those who support BDS are likely simply anti-Semitic. Reality establishes that Israel is probably the closet ally this country has across the Atlantic ocean. Israel partners with the U.S. and I understand that Israel supplies a great deal of the technical knowhow that goes into building sophisticated military equipment that helps keep American’s and its people safe. Israel also is a democracy that treats all of the people living their with due process and equal protection, and to accuse them of apartheid is clearly without merit, yet the fools out there buy into that nonsense. The same goes for the claim that that nation is an “occupier.” Unfortunately, this world is overwhelmed with fools, and to compound that problem, those fools are playing directly into the hands of the Jihadists who seek the destruction of Israel as well as America. I cannot speculate on what the appellate courts will do about the decision of the lower court, but I respectfully believe that with the relationship that exists between us and Israel, someone should urge that Congress or POTUS find some leverage under our commerce clause or as a matter of national defense, and adopt laws or rules that might make it unlawful to DENY any company its right to do business with Israel. The issue ought to be approached as guaranteeing business freedom of action and unmolested authority for companies to freely deal with our important ally, a kind of resolution supporting companies that choose to do business with Israel, which would also have the effect of putting down those fools who support the unmeritorious BDS movement, rather then some legislation that might face the consequences of the first amendment. Though I believe the federal judge was wrong in determining that a law that was passed as support for our ally nowhere violates free speech, simply because whether one chooses to do business with Israel is a business decision, having nothing to do with freedoms guaranteed by our Constitution, I hope that we all start recognizing that type of conduct plays directly into the hands of the Islamic’s and our adversaries, to our detriment. Unfortunately, we just can’t seem to educate the fools out there to recognize the realities that exist.

The simple solution is the truest – and in this case the motivation is hatred of Jews, no more and no less.

Free speech is important … but if an organization organized a boycott of any business that did business with a nation full of Muslims – say Japan- because they conquered the Ainu – or say China – because they conquered Tibet – I would expect them to rule that Free Speech is important, but that any such boycott amounts to the restraint of trade, and that freedom of commerce prohibits businesses from colluding or conspiring to form a cartel.

Of course – what do we expect from a judicial system that allows Drug Cartels and Unions – and other Corrupt Organizations – to operate outside the law with impunity.

Imagine what would happen if all the utilities, banks, telecoms, and social media market makers decided to get together and boycott conservatives? … Oh, wait …

Yes – I’m not sure how long, but my memory says 1500-2000 years ago.

Of course – if it’s political what does a few millennia matter? America will never be forgiven for slavery (and everything else the Democratic party has ever done) … until we have vanished as completely as the Olmec… maybe. 😉

It should be challenged. Boycotting a nation based on false propaganda is not free speech but fascism. Its like nazis calling out for boycott of jews shops/Business was Free Speech

Because Israel is the Jewish State. Nothing the Israel / Jew haters say about Israel is true, The hatred of only Israel proves that the so-called human rights movement is a sham and a total fraud and has become nothing more than a way to attack Jews while hiding behind the veil of some fabricated altruistic nonsense. The charges made against Israel are lies, however those same charges are true in many other countries, as you pointed out, but are met with silence. The human rights charade has nothing to do with who is being violated or why, but simply about who the human rights fraudsters would like to falsely blame, which is almost always Israel. Saudi Arabia can bomb a school bus in Yemen killing dozens of children and no one cares. Israel neutralizes a suicide bomber and suddenly the world goes crazy and starts screaming about stolen land, ethnic cleansing and genocide.

This is proof that the sword of the constitution cuts two ways.

However, Israel and its many friends have overcome worse and will overcome BDS because as one firm drops out, an opportunity arises for another to take that role. That’s the strength of a capitalist market economy.

Adversity is the Propellant for Human Advancement. The tremendous success of Israel proves it.

Israel is surrounded by more than 200 million muslims (each and everyone are fanatics according to their quran) but still exist as a nation. The “Company’s” can either support the Nat. Socialist Democrats and boycott Isreal, or they can bid for govt jobs.
It’s NOT hampering the “INDIVIDUALS'” free speech.

What if they supported/did business with Iran or N Korea ??

Iran and the DPRK are designated state sponsors of terrorism. The others are not relevant since they can’t be qualified vendors. Government cannot pick and choose based on legally held viewpoints.

A judge’s first responsibility is to the Constitution, without caring for popular opinion. The judge did nothing wrong. Government must be viewpoint neutral, unless that viewpoint is material support for a foreign designated terrorist organization. Arizona will appeal, but it would be foolish to do so.

People who support BDS should be required to register and carry medical alert cards and have notices filed with their medical insurance that no matter what the emergency or medical condition, no Jewish doctor may treat them, and no doctor of any background may treat them with any medicine or technology invented by Jews.

Same for their children and their parents. Let them all suffer, and die slowly and painfully from cancer, MS, heart disease and quadraplegia.
