New York bike-path jihad murderer using Trump’s tweets in defense

This is so absurd. Sayfullo Saipov is a cold-blooded jihad murderer. He deliberately murdered eight people by driving his truck onto a Manhattan bike path. President Trump called for the death penalty. The defense attorneys are banking on the likelihood that a New York judge will hate Trump, and will be so moved by that hatred as to avoid giving Saipov the death penalty simply to spite the President. This is not the rule of law, it is the rule of spite. The Democrats, including Saipov’s lawyers, are so deranged by their hatred of the President that they would apparently rather see Saipov walk than Trump’s wishes fulfilled.

President Trump’s tweets criticizing the Justice Department are being used against him in the case of “bike path terrorist” Sayfullo Saipov, who stands accused of mowing down dozens of people — killing eight — in an ISIS-inspired attack in Manhattan last year.

On Thursday, Saipov’s defense lawyers argued that Trump’s tweets about their client’s case — combined with his attacks on Attorney General Jeff Sessions — have made it impossible for the Justice Department to fairly seek the death penalty in his case.

Specifically, they claim Sessions is getting pressure to make politically charged decisions to please Trump — who has also called for Saipov to face the death penalty in tweets.

“A decision not to seek death would expose the decision-maker to a blaze of public scorn and ridicule as well as the possible loss of employment,” his Federal Defender lawyers said in a filing.

The lawyers, led by Jennifer Brown, want the judge overseeing Saipov’s case to either block the feds from seeking a death sentence or “appoint an independent prosecutor to make the decision.”

“As soon as Mr. Saipov was arrested, President Trump, without knowing a thing about Mr. Saipov and barely anything about the crime itself, peremptorily instructed his Attorney General to ‘move fast’ to execute Mr. Saipov,” his lawyers said.

“Should move fast. DEATH PENALTY,” Trump tweeted last year of Saipov’s alleged attack using a Home Depot rental truck….

“The pressure from Mr. Trump’s intemperate demands are simply too great for Attorney General Sessions or anyone else who works for President Trump to appropriately exercise the fact-based, independent decision-making process,” Saipov’s lawyers said.

So Jennifer Brown and her little band of legal beagles thinks a call for the death penalty for a mass-murderer is “intemperate.”

Actually, the best part is the defense claim that nasty old president Trump tweeted about the death penalty – without knowing a thing about Mr. Saipov.”

Not the least bit unexpected, is it?

Death, or life in prison without parole, is academic. Even if the federal charges are dismissed, Saipov would still face the same charges in state court and a likely sentence of 200 to life.

As for the motion, I see it being granted and upheld by the 2nd Circuit, since Trump did override federal due process. (This doesn’t cause a problem for the state though.)

Once again the ultra-liberals are trying to turn commentary that we all thought was appropriate to enable a monstrous believer of Islam to escape the fate that he chose. I can only hope that right thinking people recognize that he premeditatedly acted to commit homicide, the Jihadist’s way, and that taking his life was the expected ultimate result. Thereafter, he will then come to nothing or, if there is a hereafter will find himself in Hell.

Obama lost several cases the same way…passing guilt and a judge ruled it denied due process…causing guilty people to go completely free. Due process is more important. That said, the state can still charge murder and Trump would be irrelevant there. This is something that could come back to haunt Trump in the future if there isn’t a state fallback possible in a future case.

This is old hat. When I returned from Vietnam, I saw a headline that read, “Nixon: ‘Manson Guilty!'”. He tried using that at trial claiming the President had prejudiced the jury pool, petitioning for a mistrial. He died in a CA prison just last year, well into his 80s.
