Last year, BART refused to run AFDI’s “Back the Ban” ad. Worse still, they instituted a ban, the infamous Geller Ban, because of this ad. So they are in violation of their own ad ban.
I am exploring my legal options on this now. Viewpoint discrimination is when they permit a particular subject, but pick and choose which viewpoints on the subject they will run. I will resubmit this ad, and Bart officials will likely argue that it is not the same subject matter as the ad from this Holocaust denial group, and maintain their ban. However, Bart spokeswoman Alicia Trost says below: “We cannot deny the ads…the agency does not endorse the message or group. You have to look at it for exactly what words are used and what images are used.” But when I submitted this ad in April 2017, I was told that “the SFMTA’s policy prohibits all political or public issue ads.” If that is so, they would have rejected the ad from these Jew-haters, which, if not political, is certainly a “public issue.” So we will continue fighting this. It’s a fight for our freedom of speech rights, and yours.

A San Francisco public transit agency has approved adverts from a group that promotes Holocaust denial and antisemitic views, claiming the organization has a “free speech” right to buy train station billboards.
Bay Area Rapid Transit (Bart) officials defended their decision to allow ads for the Institute for Historical Review (IHR), which the Southern Poverty Law Center (SPLC) has classified as a hate group that aims to “defend Nazism” and spread Holocaust denial propaganda.
The far-left Guardian has to go to the far-left hate group SPLC to find out that Nazism is bad? Does Obama know about this?
The electronic billboards, which say “History Matters!” and provide the name of the California-based organization, are in rotation at two Bart stations in San Francisco. They come at a time when antisemitic incidents have accelerated at alarming rates in the US and across the world, and as far-right groups and neo-Nazis have increasingly pushed racist and fascist views under the guise of advocating for free speech.
“We cannot deny the ads,” a Bart spokeswoman, Alicia Trost, said in an interview on Tuesday, noting that the agency does not endorse the message or group. “You have to look at it for exactly what words are used and what images are used … There is plenty of case law and court rulings that show if you deny the ad, you can be taken to court, and you’ll lose, and that’s obviously costly.”
The ads, which are running for most of September in the Powell and Montgomery stations, have prompted some backlash from the public, said Trost: “When people look into it, they are upset about the ads, which is understandable.”
The IHR was founded in 1978 by Willis Carto, a prominent far-right figure and Holocaust denier. The group previously published an antisemitic journal and sponsored Holocaust denial conferences, according to the SPLC, a not-for-profit that documents extremism and rightwing hate movements. IHR has been on the decline in recent years, but still runs a website where it promotes “extremist books and other materials”, the SPLC said.
The IHR website published an article saying there is “no evidence for Nazi gas chambers” and another saying “Germans were no more antisemitic than any other people”….

Feisty, I can see why you’re getting so much flack.
Did you notice that the article title began “San Francisco transit agency refuses AFDI ads” …
The ads which were refused are the AFDI’s ‘Back the Ban’ ads – which support the Immigration Ban from Muslim countries identified by the Obama administration as high risk sources of Islamic terrorists, which was attempted by the Trump administration, and thwarted by an unconstitutional action of a couple of Federal judges. A sample of one of the banned ads is at the top of the article.
BART refused the ads because it is Sharia compliant. It is a Leftist controlled entity that supports Muslim immigration and the Islamization of victim communities. It also does not want to attract the attention of the powerful Muslim Supremacist organizations such as CAIR. Alerting innocent Americans of the threat of Islamic terrorism is a means to awaken them to the larger threat of Islamic Supremacy and its underlying Hate-ideology.
Meanwhile BART accepted ads from a Holocaust Denier entity, and put its own double standards on full display. Hate-ideology of Na z ism (Socialism) is okay, and the Hate-ideology of Islam is okay, but resistance to Hate-ideologies is not okay with BART.
The aforementioned article does discuss Holocaust Denial, and we are against Na z is, but the whole thrust of the article –
Is about weighing the options of using this double standard to sue BART to force them to accept ads to alert the public to Islamic terrorism and raise awareness of the threat of Islam.

The message itself is bland- unlike AFDI’s provocative declarations. The fact that the latter are truthful, while the former are intended to lead people into a morass of deception, is of no consequence to BART.
I think a reasonable analogy might be to IG Farben corporation, whose management likely argued, “We just make chemicals- our customers decide what to do with them”.

Huh? I didn’t realise this article was about Islam. Since when did the name ,”Willis Carto” become a Muslim name? So the group “SPLC” and the The “IHR was founded in 1978 by Willis Carto” as mentioned in the article you’re commenting on, are Muslim groups? Maybe you should read before you comment or seek some therapy for your Islam obsession. I think the medical journal needs to recognise the emergence of this new obsession and addiction for people like you who can’t go a day without ruminating over their Islam addiction. By pointing me to your own comment what you’ve proven is the extent of your Islam addiction where you displayed that you are incapable of responding to an article in a relevant manner without bringing the topic back to the point of your addiction. As there were NO REFERENCES MADE TO MUSLIMS IN THE ABOVE ARTICLE YOU RESPONDED TO MR OH SO SHARP TOOL. Oh the HYPOCRISY! The double standards you express are some of the most extreme I’ve ever encountered. For a person who spends all their time inciting hate speech, generalizations and the persecution of people based on religious preference, I find it astounding and shamelesss how quickly you are able to change gears and cry wolf when you end up on the other end of the stick that you so actively enforce. When it happens to you it’s called discrimination and violation of rights, anti-Semitism, anti-religion and speech but when you do it to others it’s called freedom of speech and protecting your rights. You have a way of using the same terminology to argue both sides of the line depending on where your agenda stands. And the sad part is that you appear so oblivious to your own hypocrisy when in fact the types of persecution you whine about should in fact be serving as a lesson in empathy.
