They were planning a major terror attack at the compound. And yet all charges against three of the five defendants arrested in connection to the New Mexico jihadi compound where children were starved and murdered while training for school shootings have been dismissed on a technicality. The “10 day rule”: If discovery in the case isn’t in before the 10-day deadline, cases are dismissed.
Judge dismisses all charges against 3 ‘extremist Muslim’ New Mexico compound suspects
District Judge Emilio Chavez on Wednesday dismissed all of the charges against three of the five defendants arrested in connection to a New Mexico compound linked to “extremist Muslims” because authorities violated the state’s “10-day rule.”
Story continues below advertisementThe child abuse charges against Lucas Morton, Subhannah Wahhaj and Hujrah Wahhaj were dropped, while those against fellow defendants, Siraj Ibn Wahhaj and Jany Leveille, remain.
Siraj Ibn Wahhaj and Leveille were also charged Friday with abuse of a child resulting in the death of a child and conspiracy to commit abuse of a child,
Taos County Sheriff Jerry Hogrefe said in a news release.

I just heard this on FOX. Frankly, I am not surprised but am utterly gutted. It is indicative and betraying of the Judiciary’s amoeba-like gutlessness and banality. These terrorists, murderers, will laugh their vile heads off and more so will strike some innocent Americans because of this judge’s liberal, golly-gee, I ain’t an Islamophobe, set these Jihadis free.
A warning to the leftist progressives aka, the Democrats, and true believers; you will pay heavily for your never-ending deceitfulness and alliance with this perfidious, Cult of Satan. It’s time to toss me cookies.

Or maybe it’s a failure of the prosecutor to follow the rules of the court (see Page 9). The prosecutor missed the deadline to turn over evidence.

RIGHT…This is not a bar to refiling the charges and was completely in the hands of the prosecutor. Only the defense can waive this time period and the judges ruling was mandated. See my expanded discussion above.

New charges have already been filed. And it wasn’t discovery failure, as Breitbart reported but with the same misleading angst, failure to offer preliminary hearing within 10 days because defendants are still in custody. No fault by any judge, all on the DA and people on the ground are distressed by their failure..

It would seem that the “prosecution” is the one in on it. First, recall that the raid was the County Sherriff, although the FBI had received several complaints. Secondly, after the FBI moved in, they commenced the destruction and bulldozing of the complex, in order to hide any, and all, evidence. Then, the local “prosecutors” did not schedule the requisite hearing(s) within the legally proscribed period. That made the job very easy for the “judge”, as legally mandated due process was not followed. It would seem that there’s a whole bunch involved in protecting those moslems.

EASE UP FANS…this is a technical dismissal mandated by the law and not a “dismissal with prejudice” that would be a bar to refiling the charges including new charges. THIS IS NOTHING and on occasion done by a prosecution intending new charges that may even take the case regarding bail to a different judge than the character who granted release without bail. Only a dismissal “with prejudice” precludes further prosecution and this isn’t it. Even if some crazy judge tried to make it with prejudice on technical grounds it would be easily reversed on motion to an appeals court. This report needs to dig a little deeper to understand what is going on and how it “might” negatively affect the case. Also dismissals like this followed by refiling are actually very common.

There will have to be a preliminary hearing first, which is what the DA blew, and not a “discovery issue”, another mistake in this article. Catch up with the news and it will set you straight about what is happening. The Judge did what the law required him to do. This was all on the DA and we don’t know if they intend to effectively prosecute, but I believe they do.

Agreed. Great point. NM has a state law that an evidentiary hearing must be held within ten days of a suspect’s arrest or they are freed. Though the prosecutors dropped the ball on this one, you can bet your ass that they would have dotted every “i” and crossed every “t” had it been a case where President Trump was the target.

No surprise here. For many years now the legal system has existed essentially to serve the legal community. When justice emerges it’s, often as not, because it was unavoidable. As a public asset the legal system’s broken–an expensive negative. Get over it.

I read comments like the above and never know whether to laugh desperately or to cry in despair. Crying I cannot; I lost all my tears in life. To laugh I also cannot because it is so painful. The White world is fast disappearing under the assault of Muslims everywhere. They do not hide their intentions, like Hitler did not. But Hitler had been a nice guy. He did not want to destroy the world. He just wanted to kill Jews, Gypsies and enslave Slavic population. Muslims are conquering the world and do not hide that all Christian, Jewish, Hindu population should be either exterminated or brought to slavery. In Western Europe this is happening in front of our eyes. In the Middle East and Africa they are murdering Christians by thousands monthly. And yet Americans find one reason or another to submit to the inevitable. The hatred of terrible Russia, a weak nation barely surviving, awful North Korea that can be brought to their knees in one day, awful Iran that is really awful but can be brought to their knees in one week. Anything goes to cover up the obvious. The obvious is that the US elite is death plot against American people and sold their dirty souls to the world of Islam and Sharia. As Western Europeans American white people are biologically degenerating fast and frighteningly are not fit to survive.
Give up your personal weapon. You will never have guts to use it when a Muslim puts his dirty mmber into your daughters ass; its their preferred way of showing how much they despise you and are above you.

There’s something behind this …. and it’s not a good thing … All that the prosecution had to do, to be within compliance of the law, was to SCHEDULE a preliminary hearing. It takes about ten minutes to place a hearing on the docket(s). There is no excuse, outside of moslem loving corruption, that they weren’t scheduled within ten days.

A billion moslems, going multiple times to a mosque each day where they are harangued by an imam and praying for death to all non-moslems by running them down, Burning, poisoning , cutting their necks and Beheading. This is in keeping with the tendency to punish muslims less for the video’d rape of a 6 year old child.
Over the last decade there have been cases where the guilty have gone free as with the illegal who killed Kate Steinly.
No one should be surprised when civilian vigilante groups rise up the take up the slack.
If Trump’s wall is not built expeditiously and muslim immigration restricted severely both groups will have something to wail about soon.

One wonders if prosecutors were deliberately ‘dragging their feet.’ Are they too incompetent to properly prosecute what should, otherwise, be an ‘open and shut’ case? Let’s hope not. But, at this point, I’m not confident.

They did not have to even prosecute, at this time. All that the prosecution had to do was to SCHEDULE preliminary hearings for those arrested. That can be done in ten minutes. There’s more to the story that a mere “technicality”. There’s a reason, probably fbi related, for that. Ever met an fbi agent that was honest? Ever met one that didn’t take bribes? Ever met one that didn’t love moslems and hate human beings?

The judge claimed that there was no choice but to drop the charges and to release them because of some sort of technical error by the prosecution, and says they cannot be brought up on charges again. I give the judge zero credibility. I believe that as much as I believe that I can fly! I think this judge should be impeached or otherwise permanently removed from office for incompetence! I wonder what law was being followed? I don”t think it was U.S. law.

It was Arizona state law. And, not really a tiny little “technicality”. The prosecution has ten days to schedule (not hold, simply schedule) a preliminary hearing, following an arrest. The prosecution did NOT. That’s a simple procedure … placing something on the court’s docket. If anyone/thing should be blamed, it’s the prosecutor’s office. Hayull, they could all be moslems.
I am NO fan of the judiciary, but place the blame where it belongs … moslem loving prosecutors.

That was the technicality I was speaking about, that the hearing was not scheduled. Why the prosecution cannot still schedule such a preliminary hearing and re-charge the perps, is very unclear. I think it is not just Muslim loving prosecutors, but a Muslim loving judge. One of the charges against the perps is murder, and murderers should not be able to avoid prosecution for this crime. It was never brought to trial, so how can the judge set aside the charges permanently? May be time for the U.S. DOJ to get involved!

It’s Arizona state law and the law is quite specific. They could convene a grand jury, seek an indictment, receive said indictment, then charge and arrest. The prosecution, in this instance, holds ALL of the blame.
If the US DOJ gets involved, which they now are, NOTHING other than funding them to better achieve their goals, will occur. If you want to see a moslem run agency, it’s the DOJ.
