The government can’t strip a terrorist of his U.S. citizenship, a federal judge ruled this month in a decision siding with a Pakistan-born man serving the last few years of a 20-year prison sentence for his guilty plea to plotting to destroy New York’s Brooklyn Bridge.

The case involves Iyman Faris, who was sentenced in 2003 for aiding and abetting Al-Qaeda by scoping out the bridge as part of a plot to cut through cables that support it.

His case was among the first and highest-profile terrorism cases after the September 11 attacks.

Faris met with Osama bin Laden in Afghanistan and worked with Sept. 11 architect Khalid Sheikh Mohammed, although some critics questioned how realistic the plot was, given post-Sept. 11 security in New York.

A court filing last year in U.S. District Court in southern Illinois argued that Faris lied on immigration papers before becoming a naturalized U.S. citizen in 1999 and that his terrorist affiliations demonstrated a lack of commitment to the U.S. Constitution.

Faris, who’s 49, was known as Mohammad Rauf before becoming a U.S. citizen, worked as a truck driver in Columbus and was married to an American woman for a while.

He is scheduled for release Dec. 23, 2020, according to the U.S. Bureau of Prisons.

‘American citizenship is precious, and the government carries a heavy burden of proof when attempting to divest a naturalized citizen of his or her citizenship,’ she wrote on July 11.

The Department of Justice declined to comment.

One of many objections raised by Faris’ attorney is that the government’s action violated the terms of his 2003 plea agreement, which never included the possibility of denaturalization or deportation.

‘We look forward to defending this case,’ Chicago defense attorney Thomas Durkin said. ‘It’s a wrong-headed decision by the government to proceed in this fashion.’

Unpopular but correct. The ONLY way citizenship can be revoked is if the citizenship was obtained as a result of fraud. COTUS first, majority will second.

Being convicted of treason or participating in any attempt to overthrow the U.S. government is only one of FIVE ways that a naturalized citizen may lose their citizenship. You referenced on … perpetrating fraud on their application, which this moslem DID.

As far as I am aware, if you were born in the United States, not even the government has the power to revoke your citizenship. But if you were born OUTSIDE the U.S. and were later naturalized, you are not under the protection of the 14th Amendment, and your citizenship can be revoked. This man who plotted to destroy the Brooklyn Bridge was born in Pakistan.

Personally, I think citizenship for acts of terror such as these, especially by U.S. citizens, should be taken very seriously. Perhaps it is very difficult to revoke citizenship, but I think they SHOULD lose it if they are willing to betray this nation; treason combined with terrorism should be justifiable cause in my opinion.

There are a total of six reasons to revoke a naturalized citizen’s citizenship. The first, is perpetrating fraud on the citizenship application, which this moslem did. Of the other five, four are almost voluntary, such as serving in another nation’s military … However, the one that is not really “voluntary” is committing treason, which is another thing this moslem did.

You are spot on. According to constitutional attorney Mark W. Smith appearing in Fox & Friends First this a.m. (Mon.), if a naturalized citizen commits an act of terrorism within five years of their arrival, their citizenship can be revoked. This jackwad had only been here two years.

During the Spanish Civil War of the 1930’s, the FDR administration used the Act of March 2, 1907 to discourage US citizens from joining the conflict for either side. The Act states that US citizens taking up arms for a foreign sovereign can have their citizenship revoked.

Revoking the citizenship of a natural born US citizen was ruled a violation of the Eighth Amendment’s stricture against cruel and unusual punishment. A naturalized citizen, as in this case is a different matter. The judge does not know the law.

But what do you expect from an Obhammud appointee?
