A highly respected and famous Islamic scholar slapped Farah Faiz, a female woman’s advocate lawyer on national TV because she is fighting against Triple Talaq, a form of Islamic divorce which has been used by Muslims in India. It allows any Muslim man to legally divorce his wife by stating the word talaq (the Arabic word for “divorce”). Muslimas, on the other hand, face insurmountable obstacles should they wish to escape polygamy, beating and abuse. Faiz, who runs an NGO Muslim Women’s Quest for Equality in Uttar Pradesh, is also national president (honorary) of the RSS-associated Rashtrawadi Muslim Mahila Sangh.

On the website FatwaOnline.com, Qasmi claims to be one of “India’s leading Islamic scholars,” who is “an expert in the fields of Urdu Literature and Islamic Jurisprudence (Fiqh), Hadith, Tafseer.” It says he is “bestowed with multifacted talents and skills” and that he combines his “in-depth understanding understanding of Quran and Sunnah.”

The description goes on to say: “He has a unique capability of suggesting insightful Islamic solutions to the new-age problems without compromising on fundamental tenets of Islamic Shariah.”

Here is what we know about Mufti Qasmi:

1) Ejaz Arshad Qasmi is a member of All India Muslim Personal Law Board (AIMPLB).

2) He is the general secretary of Peace Foundation of India, New Delhi, which runs a website fatwaonline.org for online fatwas.

3) He claimed to be an expert in the fields of Urdu Literature and Islamic Jurisprudence (Fiqh), Hadith, Tafseer.

4) He has written several books on Islam.

A Muslim cleric caused outrage on Tuesday after he slapped a female lawyer during a live TV debate on Zee Hindustan. Mufti Ejaz Arshad Qasmi was later arrested from the Zee Media’s office after a complaint by the media house for assaulting Farah Faiz, an advocate fighting against Triple Talaq.

The incident took place on Tuesday evening when the cleric, a regular on TV debates, reacted violently to the woman lawyer’s argument on triple talaq.

Ms Faiz had said in the debate that triple talaq is not a form of divorce recognised in the Quran. This triggered a war of words between her and Maulana Qasmi which resulted in the physical scuffle.

On Monday, the Imam of Bareilly’s Jama Masjid issued a fatwa, a ruling on a point of Islamic law, against a woman who had been opposing several Islamic practices, including Triple Talaq, and demonstrating against the same.

The woman, Nida Khan, had been opposing practices such as Triple Talaq, Halala, Bahu Vivah, and so on. She was the wife of a relative of the Imam and was also a victim of Triple Talaq. She had been fighting for the justice for many other victims of the laws that she had termed ‘Non-Islamic’.

“Nida Khan has been ostracised from Islam because she has been regularly speaking against the religion and its practices. A fatwa has been issued against her. No Muslim is to maintain contact with her until she publicly apologises and retracts her anti-Islam stand,” said Imam Khurshid Alam while addressing a press conference.

In response, Khan said, “Who are they to oust me from Islam. I will be liable to take this issue directly to the Supreme Court if they try to exploit my constitutional, fundamental human rights. They are trying to spoil my image.”

Earlier in the day, a woman from Uttar Pradesh’s Shamli filed a complaint with the police, alleging that her husband gave Triple Talaq to her for giving birth to a girl child.

The woman alleged that her husband and in-laws even thrashed her and demanded a dowry for giving birth to a baby girl a week ago.
