The number of former Guantanamo detainees suspected of “returning to the fight” has doubled.

Eleven Guantánamo inmates are challenging their indefinite detention in the US military camp in Cuba on grounds that Donald Trump’s defiant pledge to keep all remaining detainees permanently locked up is fuelled by hostility towards Muslims.

The inmate’s petition, filed on Thursday in a federal court in Washington, falls on the 16th anniversary of the arrival of the first 20 detainees to Guantánamo. The prisoners were brought in shackles from Afghanistan on 11 January 2002 dressed in distinctive orange jumpsuits.

Some of the petitioners in the new filing have themselves been held on the Cuban base almost since the beginning; others have been detained for 10 years. None of them has ever been charged, and all know that unless the courts intervene they could remain in their cells until they die.

In a memorable phrase, they say that “the aura of forever hangs heavier than ever”.

At the heart of the legal petition is the claim that President Trump has taken a radically new approach towards the treatment of the 41 prisoners who remain at Guantánamo. The inmates argue that his stance is defiant in spirit, arbitrary in nature, and fueled by his “suspicion and antipathy” towards Muslims.

The petitioners quote medical experts who have compared the prolonged indefinite imprisonment at Guantánamo to sensory deprivation and psychological torture. “Prisoners are medicated for depression and anxiety brought on by acute despair.”

The inmates are basing their challenge on two legal points. They claim that indiscriminate indefinite detention is illegal under the due process clause of the US constitution.

The second argument is that the justification for never-ending detention under the Authorization for Use of Military Force (AUMF) was that it was needed to prevent committed enemies of the US returning to the battlefield. But the petitioners claim that justification has begun to unravel.

On the campaign trail Trump said of Guantánamo that he would “load it up with some bad dudes”.

Shortly before his inauguration he pledged in a tweet to block any further releases on grounds that all the 41 were “extremely dangerous people”.

That threat has come to pass. Pardiss Kebriaei, a lawyer with the Center for Constitutional Rights who represents one of the petitioners, Sharqawi Al Hajj of Yemen, who has been detained for 15 years, said that all moves towards release have ground to a halt since Trump came in.

“There’s nothing happening. It’s an entirely static situation, and that kind of indefinite detention without charge is intolerable, it cannot be allowed to continue,” she said.

Starting immediately, take no prisoners, that will alleviate problems with their treatment as radicalized muslims cannot be rehabilitated.

If they aren’t then why did Ontario elect the utter liar and incompetent, Dalton McGuinty and then replace him with the even worse, totalitarian despot-inclined, morals destitute, Kathleen Wynne? How did Alberta get the idiots it has had, like that Notley clown? He’s retiring, I’ve heard, but the only good premier has been Brad Wall of Saskatchewan. Well, maybe not children of SDS traitors, but certainly Canadian of similar persuasion. I met some of these people when at university and considered most simply dregs of the US. In fact when the late Senator J. William Fulbright publicly stated that “soon all the finest Americans will be in Canada”, I wrote to Senator Fulbright to tell him that I’d met some of these “finest Americans” and that “if they are your ‘finest’ then God help your country”.

Absolutely! And anyone who cares about what Guantanamo prisoners think is a mental retard with moral issues. As I pointed out previously, when in 2015 the South African mercenaries were hired by Nigeria to deal with Boko Haram, they took no prisoners. As their most senior officer told a BBC reporter when she asked what they had done with prisoners, his reply was classic, “Oh, we didn’t have that problem”.

These enemy combatants were captured on a field of war. They should be treated as such. I know of noting, within the Geneva Convention, that requires halal food, special garments, prayer rooms, or korans … So, feed ’em pork, keep them in orange jump suits, take away their korans … and allow Red Cross inspections every quarter. Although, Article 27, first paragraph, of the 1949 Geneva Convention IV provides: “Protected persons are entitled, in all circumstances, to respect for … their religious convictions and practices” Nowhere within said document does it state that the prisoners are to be furnished with religious books or texts, or given special dispensation, such as furnishing prayer rugs.
Treat those moslems as any other prisoner of war … and let ’em squeal.

The ONLY way to achieve respect from muslims is to do what they do but do it first and worse. As they do NOT recognize the Geneva convention WRT POWs or civilians, then they too do not deserve nor earn its coverage. Like not a few Israeli POWs caught and shot in the many wars there I would remove them permanently once interrogated.

You do realize that, currently, they’re served halal meals. They are furnished with the dress they desire (look at the pictures of their robes). They have their rooms cleaned and when a guard touches a kookran, the guards were gloves. They are furnished, at taxpayer expense, kookrans, prayer rugs, special places to pray … and the list goes freakin’ on .. not to mention tennis courts and soccer fields. None of these things are required under any existing conventions, treaties, or agreements. Make ’em live on pork and beans .. and clean up their own slop …

Why not put them out of their misery then.. They all want to die for allah.. Oblige them, but CREMATE the bodies.. Mussies believe that when they are placed in the ground dead, they are actually aware and awake and waiting for judgement day. That’s why they are really against cremation because their bodies will be destroyed.. My question is, if they think a dead person is awake and aware, why put them in the ground?? Awake and aware would suggest that the deceased is actually alive.,, Go figure

What about the rights of the prisoners being held by ISIS and Al Queda? Who is fighting for their rights? These prisoners have it better than where they came from. Three meals a day and a roof over their head is probably a new experience for most of them.

These detainees are not innocent lambs as the media tries to portray them as, they are hardened killers and radicals who are a danger not only to their societies, but also to their families and to themselves.

We should not be feeling sympathy of this kind for murderers who may have killed dozens or even hundreds of women and children.
