Bowe Bergdahl’s Sentence: No Prison Time

A military judge has ruled that Bowe Bergdahl, who has pleaded guilty to charges of desertion and misbehavior before the enemy, should serve no prison time.

During a hearing Friday in Fort Bragg, N.C., Bergdahl was sentenced to dishonorable discharge, forfeiture of $1,000 in pay per month and a reduction in rank from sergeant to private, according to a statement from the Army.

The judge, Col. Jeffery Nance, had wide discretion in determining a sentence for Bergdahl, who walked off his military post in Afghanistan in 2009 and was held by the Taliban for five years. He could have given him anything from no prison time to life in prison.

Prosecutors had been seeking 14 years in prison, while defense lawyers had asked for no prison time and a dishonorable or bad conduct discharge.

“The judge didn’t explain his reasoning, he didn’t explain the mitigating factors,” NPR’s Frank Morris reported from the court.

The military court heard testimony from three current and former service members who were wounded while searching for Bergdahl. Prosecutors argued that he deserved a significant prison sentence because those service members were injured as a result of his actions; the defense said that he did not intend for anyone to get hurt and that it was the Taliban that actually injured them.

In a tweet after the sentencing, President Trump said, “The decision on Sergeant Bergdahl is a complete and total disgrace to our Country and to our Military.”

Trump’s comments on Bergdahl have been a factor in the case. While on the campaign trail, Trump repeatedly called Bergdahl a traitor and suggested that he should be executed. He highlighted those comments again at a recent press briefing, on the same day that Bergdahl pleaded guilty to the charges.

That led Bergdahl’s defense to file a motion to dismiss, saying that Trump’s remarks amounted to unlawful command influence. Nance ultimately decided that he wouldn’t throw out the case, saying that he was “completely unaffected” by the remarks and would still be able to rule fairly.

Bergdahl’s dishonorable discharge strips him of his veteran’s benefits. However, as Frank reported, that will automatically go to appeal with another military judge. That judge is able to mitigate the existing sentence, Frank said, but is not allowed to impose a harsher one.

“I was sitting in back of Bowe Bergdahl. He was stressed, he often looks stressed though,” Frank said. “You could see a big vein snaking across his temple. He was trembling a little bit after the sentence was announced.”

Bergdahl has been stationed at a base in San Antonio, and Frank says that now he has “a job waiting for him at an animal shelter in San Antonio. …He’s earned a reputation as someone who is amazingly good with feral cats.”

Injustice prevails! Today it was announced that a member of the US Military proven to have been a deserter was given the minimum sentence as punishment. This man is to receive all back pay totaling 300,000 dollars was sentenced to 1,000 dollars a month for ten months totaling 10,000 dollars. In addition he is to lose all entitlements and was demoted from Sergeant (E-5) to Private (E-2) with a dishonorable discharge. What the military fails to tell the public is that this dishonorable discharge can be elevated to a General discharge within two years. So now this soldier is looking at a $10,000 dollar fine, and discharged from the military. The lives of five American soldiers who also had a Mother, Father, Brother, Sister, Wife and Children were of no consequence. This same soldier will be free to write a book, sell his story to film makers and collect hundreds of thousands if not millions in doing so. A question which should have been part of the sentencing is; who will profit from the proceeds of both the book and film? Was there any clause in the discharge that stipulated all proceeds would go to the family members of those killed searching for this disgraceful soldier? The answer to that particular question is NO! Other questions which should have been asked; what is the qualification and background of the presiding judge? Was he investigated to clear him of being a possible Islamic sympathizer? What political party is the judge affiliated with, possibly the Democratic Party who is/was sympathetic to terrorists? What actual influence and how much if any…did the previous Commander-in-Chief have over the case? Why did the presiding judge determine the prison time for the soldier being held by the Taliban was sufficient, when in fact it was the soldier who conscientiously made the decision to desert his post? How many medical doctors and Psychologists examined the soldier to determine his mental state, or were they dependent only on one for his opinion and if so what is his political affiliation and was he sympathetic to Islamic terrorists? The defense Attorney’s injected the soldiers up bringing stating he had a rough childhood, how is this possible, his parents are Muslim. They also inferred he had PTSD. What proof do they have other than using the term diagnoses of PTSD? When a private American citizen remarked this soldier was a Traitor to his country, this citizen was only proclaiming that which the nation was thinking, the Defense Attorney’s utilized this as grounds of prejudice. Rest assured this same Defense Attorney coached this soldier to testify how remorseful he was and that he apologized for walking off his assigned post. The lives of the five killed looking for him were irrelevant, what was important was to get this soldier the very minimal sentence, something he was completely successful of doing. For the court to hurt the fragile, delicate feelings of this privileged soldier was not an option. The judge in the case found this case to be tiresome; therefore he wanted to end it as quickly as possible. Given all the circumstances, evidence and testimony, the soldier should have gotten as a minimal punishment; a dishonorable discharge, loss of “all “pay and allowances, and prison time of fifteen years minimal without possibility of parole. A stipulation should have been injected in the sentencing to read; “Any and all proceeds from any book or movie deal will be paid and distributed among the beneficiaries of the five soldiers killed in hunting for this soldier”. America, our justice system is corrupt and unbalanced to accommodate the lawless. Injustice Prevailed this day.

In addition this traitor, that is what someone is that deserts and then goes over to the enemy, which he did thereby causing so much death and injury to those that tried to retrieve him, he has received since his return more than $300,000 in benefits plus medical/psychological care, which as you have indicated could be transmuted to lifetime benefits. Upon his release he was immediately rewarded with back pay including elevating him in rank and service time pay increases as if he had served that time honorably and then paid as an NCO while he did nothing up to this point. So this thing that is now poised to cash in on his leftist popularity, with this slap on a wrist received what is tantamount to a reward for violating the military code. The reason we have a separate Uniform Code of Military Justice from the civilian system is that this system is part of the military system of discipline that is necessary to maintain military readiness and performance in combat zones. Even with them overlooking the traitorous conduct and just charging desertion, without receiving at least 15 years hard labor this rewards him for traitorous misconduct. As a former short-term Army officer (66-68) that has observed unconscionable civilian leniency slipping into this system, this was still shockingly unbelievable.

It was a court martial proceeding under the UCMJ (Uniform Code of Military Justice). Had it been a tribunal under different legal structure, his well-deserved execution would have been a distinct possibility.

I think Tribunals apply to capture enemy agents, not US Citizens serving in the military forces where the UCMJ applies. By the way, I am aware of only one soldier getting the death penalty for Desertion during WW-II, Private Eddy Slovik who was executed by firing squad in January, 1945.

But what Trump can do at this point? There is the law, that nobody could change the decision of this judge. I don’t mean the appeal from the defendant. I mean nobody can send this deserter to jail. This is beyond disgraceful. The judge Nance should not only be removed, but stripped of his benefits and given a dishonorable discharge. I’m sure, there are a lot of veterans who hope they never come in contact with this POS Berghdal. And I’m also sure that wherever he goes, he will be found out. Restaurants may refuse to serve him, etc. He presence on U.S. soil is detestable and an affront to all who have served in the battlefield. His lawyers asked for a bad conduct discharge, the worst you can get and yet, the judge saw fit to ‘upgrade’ him to a dishonorable. For what reason. It was surely “dishonorable” for the judge to do that.

Maybe the Colonel was trying to cut the losses. They’ve been feeding and paying this POS as an E-5 for the past five to ten years since he was promoted during this time. If he wasn’t sent to Ft. Leavenworth or some other stockade, the Government wouldn’t have to feed, bathe, or shelter that worthless piece of “human” debris. You are correct about that DD being the lowest form that can only be given by a General Court Martial while a BCD can be issued by a Special or General Court Martial. I checked Wikipedia on this which also noted that the 1968 Gun Control Law specifically made DD holders ineligible to own firearms.

The judge Col. Jeffery Nance is unfit to serve and obviously corrupt. This deserter cost the lives of many good men. He should have at least given him the jail time the prosecutor requested. I can well understand how the families of those 8 feel about this wretch, but he underwent due process according to American law so while many will have opinions, his disgrace will have to serve as his punishment, to haunt him through his dreams for the rest of his life because you cannot extract your conscience with the tip of a K bar.

Perhaps some of the vitriol directed against my country could be steered towards those closer to home involved in this.

RNp, you and the guys either side may misunderstand my meaning, that man was tried according to law, the defense were there to test the prosecution’s case, both sides are expected to do their best,
if the families are dissatisfied and they seek to appeal on a point of law, they will do so after being guided by legal council as to the grounds, like in our case re my son, we had to follow advise if we wanted a successful prosecution, we did, we got one. Emotion will not influence any court, it cannot, it’s too subjective, only evidence counts, if an appeal court finds the judge was wrong on a point of law, that could be grounds for revisiting the case. If that was my son killed looking for a deserter , of course I would take a view, as a father I’m bound to, but the families have to prove a miscarriage of justice somehow. If those Talib prisoners were “beyond release”, non could have been released, but remember who was in charge at the time and what the rules of E were.

Surprised? After Obo drained the military of the LOYAL ones that were once in command. “Mad Dog?” indeed, his kind are all that is left, so what else is new?
And you out there expect the military, as a whole, will be at your 6 when the time comes?
Sorry, but the 60s were the beginning of the end, no disrespect for our brothers in arms, but they longer have the leaders that will be needed to help us in our fight to keep our country and law.

I have no choice but agree. I joined in the 1960s and was willing to stay, but the political garbage that was forcing politics into the ranks made me get out before I reached “retch” status. I retired before I reached my wits end with some of the policies they were pushing.

Judge Army Col. Jeffery R. Nance worried about President Trump’s comments regarding Bergdahl??? SERIOUSLY? What about Obama lauding Bergdahl as a hero when the officers who actually served WITH Bergdahl testified that he was a deserter! The only consistency here is that Obama’s anti-American presidency resulted in rewards for anti-American behavior during his term and continues in his anti-American post-presidency. Army Col. I have no way of knowing if your comment about the influence of former Pres Obama in this case of very real ‘Travesty of Justice’ is the truth
– But – I would not be surprised if it is true
– For it is my opinion that at the very least Bergdahl should have received a dis-honourable discharge with no appeal
– AND total forfeiture of ALL pay AND allowances
– And some years in Ft. Leavenworth Military Prison.
– FOR there should be Strong and Harsh consequences for his actions against the US Military.

How nice of the judge to give the middle finger to Trump, the American military, and all American vets! This POS judge used his position to tell all future deserters, go for it, nothing really bad will happen. Now this animal bergdahl will more than likely get a nice book deal, a movie deal, insects like Kimmel will invite him on late night shows and all the time the families of the dead and wounded soldiers that went looking for him, will see his ugly mug on tv screens for decades, reminding them that their lost ones and their wounded family members are just out of luck.

As a convicted Felon, Bergdahl will be ineligible for a number of things such as government employment, the right to vote in most states, and he would fail a NICS check should he ever show up in a gun store to buy a gun. All this can be changed with a pardon. So, whatever you do, don’t vote for a mistake, like Hillary.
