It could be tantamount to murder — but gay sex, no matter how evil the motive, is sacrosanct in California.

Intentionally Infecting Others with HIV No Longer a Felony in California

Story continues below advertisementIn a controversial move, California Gov. Jerry Brown has signed a bill downgrading the crime of deliberately exposing a sexual partner to HIV from a felony to a misdemeanor.
The measure comes just as an HIV-positive man in Scotland is being prosecuted for purposefully infecting a number of his Grindr dates with the virus, by insisting on “unprotected sex” or using perforated condoms.
After sex, 26-year-old Daryll Rowe would reportedly send “mocking text messages” to partners boasting he was HIV positive.
“Maybe you have the fever. I came inside you and I have HIV LOL. Oops!” Rowe texted to one partner, while he reportedly said to another in a phone call, “I ripped the condom. You’re so stupid. You didn’t even know.”
Rowe is now facing charges of “infecting four men with the virus and attempting to infect a further six,” a crime considered “Grievous Bodily Harm” in the United Kingdom, carrying a maximum sentence of life in prison.
The new California regulation lessening the crime of deliberately exposing others to the HIV virus was authored by state Democrats Sen. Scott Wiener (D-San Francisco) and Asm. Todd Gloria (D-San Diego), and cosponsored by a number of LGBT groups.
Senate bill 239 (SB 239), which will go into effect on Jan. 1, 2018, does not only apply to those who engage in consensual sex, but also covers those who give blood without telling the blood bank that they are HIV-positive, even when they do so with the specific intent of infecting patients with the contagious virus.
Republican lawmakers such as Sen. Jeff Stone, who is also a pharmacist, and Sen. Joel Anderson of Alpine voted against the bill, arguing it puts the public at risk.
“I’m of the mind that if you purposefully inflict another with a disease that alters their lifestyle the rest of their life, puts them on a regimen of medications to maintain any kind of normalcy, it should be a felony,” Anderson said during the floor debate.
“It’s absolutely crazy to me that we should go light on this,” Anderson said.
In 2015, an HIV-positive California landscape architect who boasted of intentionally infecting others with the virus was sentenced to six months in jail after pleading no contest to a misdemeanor health code violation.
Evidence from 11,000 text messages and three dozen audio clips showed Thomas Miguel Guerra bragging of his exploits and joking about keeping his condition secret from his sex partners.
“Yay lol,” read one text. “Someone getting poz that day. Poor Sucka.”
The San Diego judge who sentenced Guerra couldn’t hide her anger over the case.
“I think that’s a tremendous oversight in the law if this is just a misdemeanor,” said Judge Katherine Lewis, calling the light sentence a “travesty” while insisting the offense should be changed to a felony.
In 2011, a 51-year-old HIV-positive man who said he had intentionally infected “thousands” of partners turned himself in to Michigan police.
“He hits drifters,” testified one of David Dean Smith’s alleged female victims. “He hits people who are young. He hits young women, and from what I understand, he hits men, too. Those are his targets.”
A detective investigating the case said that Smith “intentionally attempted to spread the disease to kill people. His latest fantasy is strangling a woman and having sex with her dead body.”
The ACLU, which cosponsored SB 239, described the new measure as “modernizing” California HIV laws while praising Governor Jerry Brown for reforming “outdated laws that unfairly criminalized and stigmatized people living with HIV.”
In their report, the ACLU said that the law criminalizing the exposure of others to the HIV virus was passed in the 1980s and was “based on fear and the limited medical understanding of the time.”
LGBT activists also praised the new law, alleging that the former legislation unfairly disfavored specific groups.
“California’s outdated and draconian HIV criminal laws have disproportionately harmed people of color and transgender women,” said Melissa Goodman, LGBTQ, Gender and Reproductive Justice Project Director with the ACLU of Southern California.
“With the enactment of this law, our laws will now become more fair, less discriminatory, and will promote treatment and prevention rather than criminalization,” she said.
Rick Zbur, the executive director of Equality California, an LGBTQ advocacy group, said that SB 239 “is not only fair, but it’s good public health,” and will be “good for all Californians.”
“With his signature, Governor Brown has moved California’s archaic HIV laws out of the 1980s and into the 21st century,” Zbur said.
The new law makes the intentional transmission of the HIV virus a misdemeanor punishable by imprisonment in a county jail for not more than 6 months, if the perpetrator acts with the specific intent to transmit the disease to another person.
It also makes it a misdemeanor “to attempt to intentionally transmit an infectious and communicable disease,” punishable by imprisonment in a county jail for not more than 90 days.

It’s Greenwich Village/San Francisco/Fire Island “values.” Let’s be frank.
As well, “civil rights” protections for this group have all but emboldened them to not only act as if they are above the law and, therefore, any considerations for the larger society, but just like with Muslims, their actually dictating policies that are openly anti-family, anti-morality, anti-humanity and clearly totalitarian and fascistic on their face. They are one of the key reasons why the U.S. is now 11th on a list of nations that actively persecute and oppress Christians.

This is yet another instance of how, as with Sharia law vs. Western values, in California amoral, depraved, subversive radical fringe Greenwich Village/San Francisco/Fire Island “values” trump traditional Judeo-Christian values and the considerations contained therein, and the extent to which they do.
BLM and Antifa thugs also endorse the further spread of homosexuality and transgenderism, openly equating the family, traditional morality, recognition of male-female differences, and Judeo-Christian values with “white supremacy.” This is proof of just how subversive and destructive to the moral and social fabric such an agenda truly is.

The policies such as enacted in California are exactly the type that are apt to set off Muslim rage – and with mass Muslim immigration to this country under Obama, “Dubyah” Bush, Clinton and “Daddy” Bush, coupled with high birthrates among that group, no doubt make another Orlando inevitable under such circumstances. One reason why that state gets away with all this, besides in their political makeup being “the Soviet Union of the Pacific,” is restrictive anti-gun laws that enable such tyranny to be imposed without any meaningful opposition or resistance, thus forcing Californians to “conquered people” status.

Democrats literally make no sense. They’ve insisted that sanctuary cities make us safer, and now this guy who is executive director of Equality California said that this is good for public health and good for all Californians. How in the hell is this good public health? NOT punishing people for intentionally transmitting HIV? And how did the law disfavor specific groups? I have little sympathy for those who partake in these vile acts of sodomy. Twenty five years or so ago the “Doc Holiday Syndrome” in the “gay” community was problem reported on. So let me get this straight:
If I intentionally shoot someone in the spinal cord with a gun and the person dies a year later, I will be charged with felony murder which carries a possible life sentence. But if I intentionally transmit a fatal disease that kills someone a year later I’m good to do it again after serving 6 months.
Can Jerry Brown be charged as an accomplice to murder when the first person who has been deliberately infected dies. What happened to the concept of INTENT in determining if something is a murder or not????

Scott Wiener is also the fascist who has all but criminalized (by penalty of jail time) the use of what the Left deems “wrong” “gender” pronouns (which sounds suspiciously influenced by Sharia blasphemy laws). Contrary to LGBT supremacist propaganda, the pronouns they recommend are anything but “neutral” (Orwellian terminology if ever it was), but represent a clear choosing of sides against G-d and the realities of nature and biology, and for an insidious ideology (part and parcel of radical, anti-family, anti-morality, anti-humanity Greenwich Village/San Francisco/Fire Island “values”) that seeks to destroy any and all differences between male and female as part of an overall drive to end what the Left deems “white male heterosexual privilege.” Transgenderism is as much a “mental illness” as Islam (i.e. not that much, really). It is artificial, fake, bogus, phony, false, a Big Lie, nature’s equivalent of a $3.00 bill, meant to clearly put one over on society (never mind G-d and nature), and completely dependent on Soviet-style secrecy to maintain such a community (i.e. the deliberate concealment of one’s original sex before being converted to another by hormone treatments, reassignment surgeries and, pre-K, constant propaganda from LGBT proselytizers), as well as forcing everybody else to be accomplices to and further perpetuators of a lie – to say nothing of being used as a weapon to erode the liberties of the larger society. The whole business of “transgender camps” for children is another can of worms, with a setup not too dissimilar to separate / parallel Muslim communities in Europe ruled entirely under Sharia law and which, for non-Muslims, are “no-go” zones. The transgenderization trend is even more insidious, given the various differences in health issues between men and women (I won’t go into any more specifics than one example, i.e. the symptoms of heart attacks are different for women than for men).

This is absolutely insane. I’m trying to find a link that actually works so I can read the law because this articles indicates that you can knowingly give infected blood to a blood bank and it’s just a misdemeanor as well under this law. That is just crazy. I wouldn’t be having any surgeries done in California. If this is true, California really is a place you want to stay away from. And, the ACLU, LGBTQ, and all Democrats are either woefully stupid or just plain evil.

I have been following “The HIV Dissidence”.
The existence of HIV has never been proven.

then the court is simply asked to prove the existence of the virus.
As is quite normal in criminal proceedings. Proof is required.
Since there is absolutely no proof, the case gets closed.
You simply cannot infect someone with a virus that does not exist.
