This is the opening salvo. I expect that the MTA will call on those limousine liberal lawyers in their ivory towers to enforce their free speech putsch. For the left, Baltimore is “free speech,” Ferguson is “free speech,” but our ads “might incite violence.”

“Group behind anti-jihad ads challenges MTA ban,” By Rebecca Harshbarger and Rich Calder, NY Post, April 30, 2015
The group that wants to run an anti-Muslim [sic] ad on city buses filed a letter in Manhattan federal court on Thursday charging that their ad is a public service and the MTA’s new policy violates its constitutional rights.
Judge John Koeltl ruled earlier this month that the MTA had to run an ad by The American Freedom Defense Initiative that read “Killing Jews is Worship that draws us close to Allah,” as well as “That’s His Jihad. What’s yours?”
On Wednesday, the MTA banned all political, religious, and opinion ads from the transit system following a fierce debate among officials over the First Amendment.
It still allows public service announcements, as well as commercial and governmental ads.
The MTA had filed a letter in court last Friday that said their proposed ad policy had rendered the AFDI’s claims “moot.”
The AFDI fired back in a letter on Thursday that “its public service advertisement is an educational message,” and that the MTA’s claims were “legally deficient, if not frivolous.”
It then urged the judge to require the MTA to show the controversial ad immediately.
It’s new policy prohibits any ads that advocate a political, religious, moral, or social message.
It also bans any ads that encourage unsafe behavior in the transit system.
The MTA said Thursday it was reviewing the letter.

I agree with that, also I have noticed that a lot of Americans seem to believe that the First Amendment will fight for itself. I have come to this conclusion from quite a few comments repsonding to me something along the lines of that can never happen here because we have the First Amendment. I strongly believe if your First Amendment is not defended and protected it will disappear at the first chance Obama gets.

I agree completely, and I also agree that the First Amendment is the keystone to democracy. The Soviet & Russian Constitutions are beautifully written, and guarantee many rights, including free speech. Yet outspoken critics of Russia are constantly harassed, jailed or liquidated. For them, it’s just a piece of paper.
After the collapse of the USSR, many people thought, including me, that the fight for liberty was won, and we could focus on other challenges. It was not so. I find myself locked in the same struggles that my grandparents and parents faced. They faced the World Wars, the Holocaust, the Korean War, Vietnam, and 100 million dead from communism.
And we still face creeping tyranny from misguided ideologues, constantly seeking to destroy freedom.
How the heck did we ever let the controversy over wedding cake bakeries become the great political issue of the day? As John Boehner said recently, “The world is on fire.”

I was not surprised I emailed my local Labour party (Ed Miliband is leader of the Labour party) with my concerns here is his reply. I have also previously emailed links to the Muslim Manifesto for the UK and the 1990 Cairo Declaration by the Organisation of Islamic Countries –
“Thank you for your email and I did look at the information you sent me previously and also at the Muslim Manifesto. Ed Miliband’s comments are in line with what Labour has been saying for some time. This is about tolerance and respect and taking action against those who deliberately promote hatred on religious grounds.
I understand the concerns raised and a criticism that this principle of tolerance is not always reciprocated towards Christians. We can only continue to work towards and pray for peace and mutual understanding.

I seriously don’t understand that these dhimmis including Politicians act like they have some sort of moral superiority over us because they think they are promoting ‘tolerance’ and ‘equality’ but if they are promoting equality then why did they specifically mentioned Islamophobia? Why not Buddhistphobia,Hinduphobia or Jewphobia? There are other minorities too in Britain why give special privileges to muslims only and then they talk about equality..

A public service announcement, dished up just the way MTA likes it?
– The look and feel of the ad should be similar to other public service announcements (PSA) that commonly appear on the MTA.
– Use similar fonts, similar graphics, similar colors to other MTA PSAs
– The heading could read: Public Service Announcement
– Message Content:
Islamic terrorists have declared war on the USA
– This format may actually have have more impact than your other ads.
– And it would be hard to reject as a PSA
– It is factually correct
– It alerts the public to a clear and present danger
– New York has already been attacked several times
– The public has a right to know that Islamic terrorists have declared war on the USA.
– Your submission for ad approval could be supported by an inexpensive survey of the New York area that asks:
“Have Islamic terrorists declared war on the USA?”
– 38%* will say yes, 10%* will say no, 52%*will say they don’t know.
– *THESE PERCENTAGES ARE MY ESTIMATES. THEY MAY BE WRONG.*
-These are my estimates, but you can do a ‘mini-survey’ to get a feel for the numbers
– Don’t just ask your friends/relatives/colleagues. They are definitely not representative of the average New Yorker.
-But you can stop about 20 New Yorkers on the street in Times Square and ask them this question.
– If they won’t stop, stand beside the New York Fries outlet, and offer people a free coupon for fries if they will answer this one question.
– Do the survey yourself, or with someone else. You need to get a feel for people’s reactions.
– This ‘mini-survey’ will give you an idea about the percentages, the suitability of the wording, and the reaction of the interviewees to the question.
– I predict that many of the 20 people you ask will say that they didn’t know that Islamic terrorists had declared war on the USA. They will be shocked.
-And if you ask them if they think the question is important, they will emphatically say yes.
– How to keep the survey inexpensive. Contact reputable survey companies that run omnibus surveys in New York. There are many, but look for a brand-name that people will recognize. In an omnibus survey, they add your single question to a list of unrelated ones, sponsored by others. They could ask about tooth paste preferences, or favorite car colors. In an omnibus, you don’t pay for the whole survey, just for your single question.
– the MTA will try to block your PSA ad, but you can prove that the PSA is needed, because 62%* don’t know the correct answer.

Creative ideas, perhaps, but first AFDI must insist that since the judge ordered the ads to be posted the ads must be posted. No one gets to make a judge’s order “moot” by unilaterally and “ex post facto” changing the wrongful policy they are guilty of applying in order to claim that no wrong was done after all — that’s legally absurd. The MTA board is not empowered to overturn a federal judge’s remedy against their own wrongful action by voting to do so! That is like saying that the public school boards ordered to desegregate by court order in the sixties could avoid the order by voting to make themselves “private academies” supported by public “merit scholarships” not subject to equal protection rules. We have a separation of powers in the U.S. Nobody gets to vote themselves out of a court order, only another judge can alter the ruling of the court.
If the MTA gets away with changing the policy for future cases, your ideas may help at the distant margins — but chances are the tyrants will get to pick and choose what is a “public service” and you will be effectively muzzed anyway. I don’t think the wise policy is to adapt one’s self to a tyranny or try to trick the tyrants into allowing you to say something. That would be like begging for crumbs off master’s table. Won’t they love that game! Instead, tyranny must be crushed.

Good points. I leave it to Pamella about how to proceed. Since she wins these fights, and gets back her legal costs, more fighting could be worth it. These judgements create useful precedents for future free-speech actions.
She may also decide to do both. That is, challenge the effort by MTA to retroactively change theri policies, and also run a “Public Service Announcement” that is permitted under the new policies. I don’t know what lawyers call this, but in chess it’s a ‘forking maneuver’. No matter which way the opponent moves, they lose a chess piece.
