Brilliant news, freedom lovers. We won in Philadelphia. Your First Amendment rights were in jeopardy, so we fought and we are victorious.
The court granted our motion for a preliminary injunction. The judge held that the forum was a designated public forum, and so the content-based restriction on our speech could not survive strict scrutiny, and that regardless of the nature of the forum, the restriction was viewpoint-based. In short, we won on everything.

Free Speech Victory in Philly!

(Philadelphia, PA) — Today, a federal judge sitting in the United States District Court for the Eastern District of Pennsylvania granted the American Freedom Law Center’s motion for a preliminary injunction, holding that the Southeastern Pennsylvania Transportation Authority’s (SEPTA) refusal to run a “Stop the Islamic Jew-Hatred” advertisement on its advertising space violated the First Amendment. As part of his ruling, the judge ordered SEPTA to run the ad.
The preliminary injunction motion was filed on behalf of the advertisement’s sponsors, the American Freedom Defense Initiative (AFDI) and its co-founders, Pamela Geller and Robert Spencer, and is part of a civil rights lawsuit filed against SEPTA last year.
In May of 2014, AFDI submitted the below advertisement for display on SEPTA’s advertising space:
SEPTA rejected the ad, claiming that it “tends to disparage or ridicule any person or group of persons on the basis of race, religious belief, age, sex, alienage, national origin, sickness or disability.”
The federal judge, agreeing with all of AFLC’s arguments, ruled that SEPTA’s speech restriction was content- and viewpoint-based in violation of the First Amendment.
This is great victory not only for our clients, but for all freedom-loving Americans who cherish the First Amendment!

99% of Muslims have not read the Koran neither have they read the Hadith. They have taken the civility of the west for weakness. They even have the audacity to claim that 9:11 was an inside job and that there was never a holocaust! The evil manifested by these evil people towards the over 6 billion others in this world is unimaginable. The world will never know peace until Islam is banned world over and it’s adherents subjugated. It will come to pass and very soon islam will fall the same way communism fell.

You’re right. By far the majority of moslems are illiterate, and probably inbred. They are nothing but cannon fodder for the real core of the Islamist threat: the “holy men” who preach hatred in Arabic. Not easy to find any recordings, transcripts, or translations of those sermons, but what there is shows all we need to know about this heinous, medieval imperial force.

This is tremendous good news. But it strikes me as bitter sweet. It’s like freedom is
on death row in America and it just got a reprieve from the Gov. Why are we on the
defensive here in America against Islam? This “victory” feels more like a “last meal”
before the execution. It’s sort of like, “Great news! some judge actually had the
wisdom to make the commonsense choice for free speech!” …um…yeeeeeah! In a
way it’s starting to seem pathetic. Sorry for being such a party pooper. But this
“victory” doesn’t bode well for me. It feels more like an Indian summer before a very
long and cold winter.

The leap from criticism of Islam (and its promotion of genocidal violence) to disparagement of all Muslims reminds me of tyrant leaders of Islamic countries saying criticism of them is criticism of Islam and thus worthy of death. They have all their bases covered, no criticism of Islam or Muslims * * * or of Islamic tyrants is allowed.

I imagine SEPTA could as easily object to the AFDI ad on the basis of it being “Germanophobic” if it so chose–as it shows a former leader of Germany sitting with an Arab terrorist. Obviously SEPTA would never object to the ad on those grounds.
As the judge said-their objections are based on “viewpoint”; The ad simply presents undeniable “facts that,
in true Orwellian fashion, the Left considers unacceptable for public consumption: such as the deep-rooted Nazi/Palestinian connection (shared values) -and the antisemitic content of the Quran.
