N.Y. Federal Court Hearing on whether MTA Must Run Anti-Jihad Bus Ad
March 23, 2015On Tuesday, March 24, 2015, a hearing will be held in the U.S. District Court for the Southern District of New York on the American Freedom Law Center’s (AFLC) motion for a preliminary junction, which asks the court to enter an order requiring New York City’s Metropolitan Transportation Authority (MTA) to run a “Hamas Killing Jews” advertisement on MTA buses.

The motion is part of a federal civil rights lawsuit filed on behalf of the American Freedom Defense Initiative (AFDI), Pamela Geller, and Robert Spencer after the MTA refused to run the following ad:
MTA’s rejection was based upon its “security assessment,” fearing that some New Yorkers (presumably Muslims) would likely take the Hamas quote to kill Jews as a religious instruction and thus engage in imminent violence. However, as the MTA acknowledges, this same ad ran in Chicago and San Francisco without incident.AFLC is asking the court to enjoin the MTA’s speech restriction on First Amendment grounds.
AFLC Co-Founder and Senior Counsel David Yerushalmi, who will represent AFDI, Geller, and Spencer at the hearing, commented, “The MTA’s prior restraint on our client’s speech is not only wrongheaded, it is clearly unconstitutional. Under the First Amendment, the government is not permitted to impose special prohibitions on speech out of fear that some members of the public might react violently to its content. Quite simply, the First Amendment knows no heckler’s veto.”
Yerushalmi continued, “If the MTA can get away with this obvious ploy to manufacture a threat when this ad has already run without incident in Chicago and San Francisco for months, it will use this pretext to shut down all unwanted speech. This would not only make a mockery of the First Amendment, it would actually encourage the thuggery and violence the MTA now claims it fears.”

I love New York! and I love you Pamela. Keep up the good work. You are the only one ‘in their face’. Everyone else is too afraid.

So the MTA thinks her ad may incite violence by muslims? That’s precisely why this ad is so important. We can’t be having these idiots robbing us of our freedoms under threat of violence. This is how they operate, these radical muslims, with intimidation and murder. The first Amendment is not to prevent hurt feelings, it’s to protect the right of free speech despite hurt feelings. These ads of Pam’s deliver an important message about a very important subject, islamic violence and Jew hatred. She deserves to be heard, and so do we. This is not some cheap, vulgar, attack by P.G., it’s a truthful quote offered within the context of our times. Nothing could be more relevant, more important, to humanity than to meet the challenges that this kind of hate brings to the world. It’s a ridiculous objection to say that she…WE…can’t publicly object to antisemitism and murder because the people that support these evils may get upset.

No civilization can be bothered by it. Time to squash, permanently, the muslims’ destructive ambtions. They should never have been permitted movement into our homeland.

I don’t love New York City, what I mean is I do not love those New Yorkers of a liberal and socialist persuasion who, indeed, brought this crisis of the threat and danger that is Islam and the muslims (sounds like a 60s rock band, there actually is such a band) and that representation of idiotic thinking is by NY mayor, DeblasiYO.
