Shame on the nation: American Hero Michael Behenna Loses Final Appeal

There is something horribly wrong in America when a soldier is jailed for killing the enemy. The criminalization of our heroes is the liberal wet dream and the goal of the enemy, Islamic supremacists. Indeed, they make common cause of their hatred of the good.

Lt. Behenna shot a known al qaeda killer on the battlefield, a terrorist the Army had actually issued a kill/capture order for before they realized he was already dead.

… we will not give up the fight. It is our hope that Congress will hold hearings on the Army’s Catch and Release policy and the current ROE’s that limit our soldiers and Marines ability to defend themselves sometime this fall…… I have come to believe that the only way the Army will release Michael from prison is for the American public to demand it.  In that regard I am once again asking for your help.  The Savage Nation has been so supportive of Michael, helping us with his legal expenses, and writing letters of encouragement to him.  Now I need their voice.  I need the voice of the American public to demand his release.

Michael is an exceptional young man and would never have been involved in the criminal justice system but for his attempt to interrogate Mansur.  Michael’s character and professionalism has shown through even through this difficult time.  When he was pending charges of premeditated murder he was never placed in pre-trial confinement. He continued to work in Iraq and when he redeployed with the 101st Airborne Division in November 2008, he lived off post in Clarksville, reporting to work every day at Ft. Campbell.  One of his assignments during that time was to work on President Bush’s security detail when President Bush visited the 101st Airborne Division just before Thanksgiving of 2008.

Michael Behenna Loses Final Appeal Bob McCartey

Short of a presidential pardon, which isn’t likely in this day and age, it appears Army Ranger 1LT Michael C. Behenna will remain behind bars at Fort Leavenworth, Kan., until he turns 40 years old.  The Court of Appeals of the Armed Forces in Washington, D.C., has upheld the 29-year-old Edmond, Okla., native’s conviction stemming from a May 16, 2008, shooting in Iraq of Ali Mansur, a known Al-Qaeda operative.

The sad news arrived shortly after 6 p.m. Central Thursday, almost 11 weeks after the five-member CAAF panel heard Lieutenant Behenna’s final appeal of the verdict that found him guilty of unpremeditated murder in the shooting death of Ali Mansur, a known Al-Qaeda operative in Iraq.

It is beyond comprehension how multiple levels of the military justice system were able to reconcile the lieutenant’s conviction with the fact that the government’s own expert witness reached the conclusion that the lieutenant acted in self defense — see this post and this post for more details — but they did.  And by a 3-2 margin.

America has truly lost it. Is it possible for another country to offer this man politcal asylum (we do it with dictators and killers of American soldiers like Omar Khadr).
I would like my country Canada to offer this man a home, if the U.S. govt will agree to his release on those conditions.
If America does not want him then he can come and live in a country that still respects it’s soldiers.
Stephen Harper please make this offer.

It is very strange timing during an election year for the Obama Democrats not to release Michael Behenna.
One would think with so many patriotic Americans doubting his loyalty not to mention his competence to lead, that he would not take advantage of the situation and gain some positive press by giving this man a pardon.
Hopefully the Republicans will seize this issue and run with it.
Clearly this man should not be in jail.
I feel very bad for his family. They must be devastated.

I agree with Alyn21 that Canada would do well to offer him asylum. We would be far better with the likes of his hero instead of having to take back Omar Kadhr, the darling of the Left and Islamists.

It should come as no surprise. Our military leadership under Obama has rewritten terms of engagement to favor jihadists. It is that plain and simple.
Our State Department has also been infiltrated and works to establish an Islamic Caliphate in the Middle East.

I’ve read this story a few times and always come away with the feeling that something is missing. There has to be more to it than what we are being told. He made some mistakes, still it is absolutely absurd for Behenna to be accused of and convicted of premeditated murder. It doesn’t make any sense.

There are many specific and detailed conditions determining “self defense” which I did not understand before reading the brief.
I think the military runs amok when soldiers are repeatedly placed in combat over extended periods. These hamfisted attempts to make examples out of soldiers the brass considers “loose cannons,” as a way of imposing discipline and rein in zealous soldiers, is chilling.
I hope that Behanna’s family keeps on fighting, and I’m sure they will, and eventually the powers that be decide he has served his sentence long enough to get their message across.

Could it be because he is an effective leader, war fighter and white male?
It is extremely disturbing to prompt myself to ask this question. Has the U.S. government surrendered itself to the interests of the enemy, and illegitimate invaders as though that would trump the concerns of legitimate citizens? This man has to be released from custody. Travesty is too light a word for this insanity. Since there is no discernible dissent, with some exception, within the legislature I can only assume the answer to the first two questions is yes.
Never surrender your firearms to these creatures masquerading as leadership.
Anything is possible in the minds of devious power-mad freaks like these.

I don’t understand america these days. Back in the 1800sworld you were jailed for not shooting the enemy. Also to top it off the United States Army teaches our soliders to shoot in combat with the enemy not to pick the right situation for self defense or when to not shoot as far as this country ahould be concerned it doesn’t matter if we capture them to interrogate them 99% of them will die in interrogation before they speak so why takw that 1%i chance of grtting something when we could just shoot the enemy and have one less idiot to look for…..I wish our military wouldn’t make examples out of there own soliders because it makes this country look 10 times worse to other countries….. so on that noye I THINK ALL MILITARY MEN WHO HAVE BEEN OUT IN PRISON FORFOR SHOOTING A PERSON WHO HAS BEEN ASSIGNED AS SOME ONE WHO IS SUPPOSED TO SHOT/CAPTURED SHOULD BE PARDON OF ALL CRIMES BECAUSE THATS WHAT THOSE SOLIDERS WERE TAUGHT TO DO

This story makes me SO sad – and also SO angry!! It reminds me of the jailing of the two Border guards who were chasing a drug runner and shot him (but not fatally). I forget the reason(s) they used to uphold the convictions, but arresting & incarcerating these two border agents was beyond the pale and did NOT hold up to the Gov’t’s arguments! They were just doing their duty – but, if memory serves, there were also too many political considerations as well, including the always-looming illegal immigration issue and the pressure to find ways to grant amnesty, etc. The agents were just pawns in a rotten bi-national political scheme…

Meanwhile, Obummer personally picks targets for drone strikes, on the principle that anybody who’s hanging around an area where terrorist activity has taken place “is up to no good” and therefore fair game for incineration. (But capturing them and interrogating them between their three-square halal meals and prayer time and soccer breaks would be horrendously inhumane, as we all know … )

Remember Obama said in his book something about “when the wind blows in an ugly direction, he will stand with the Muslims”…Americans must stand with the Americans! Where are the men? If our founding fathers came back here today, the ANGER they would have, for all that they personally sacrificed.
We are once again, as a country, expected to PRESERVE those freedoms awarded to us by our founders. If we didn’t have these evils arrive on our soil to test us, we would be tip toeing through the tulips of life. Our country of Judeo-Christian brethren are being tested. As we should be if our nation is to stir in the hearts and minds of our youth, a stronger patriotism with G-ds protections.
Our country has become diluted. In every sense of the word. Diluted by Hollywood, by public schools and Universities, by the “ENEMEDIA” by the community organizers, by the government entrenchment of self serving elite. Our youth don’t stand a chance of holding onto American values and Patriotism in this culture of confusion.
We have stupid programs in the public school system called the IB program. A non mandated, anti-American…”Globalist” educational system that NEEDS to brainwash our young people by this liberal progressive agenda they hold near and dear, that not just America can be right, but everyone can be right. The International Baccalaureate program…look into it.
There is no time to relax people. Soap up your car windows like the “SENIORS 2012” do, if that is what it takes. Write on your car windows “VOTE FOR AN AMERICAN 2012” or something clever, but get this Obama Muslim OUT!
While standing in the supermarket pick up a tabloid with Michele or Obama on the cover and say outloud…WE GOTTA VOTE THIS GUY OUT, HE’S RUINING OUR COUNTRY! Get people stimulated, make them think, get into an argument if you have to. Do your part to stop the Muslim train from pulling into your station.
All I am saying is that with stories like the one above, the reality is, we need to fight because FREEDOM ISN’T FREE!

He murdered the guy. No question about that. And he probably should have killed him, but it was not what he was ordered to do. The superior officer that gave him the job to escort him back should be fired for not foreseeing this might happen. I don’t think I would have done what he did. If he was smart he would have killed him instead of capturing him–and this would not have happened. I suspect Michael will be released early in a few years. I highly doubt he will serve the full 15 years. I would not call Michael a hero, but he seems like a fine example of an Army officer and one who should be returned to duty. It is a shame his career was cut short due to brief lapse in judgement. His dead mates were most likely avenged.

War is cruel and you cannot refine it, not if you wish to win. Holding the the higher moral or ethical ground, especially against a Taliban or Jihadist enemy combatant, whom affords no such conventions will only further endanger one’s life and safety.
Political correctness and the concern for the civil liberties of terrorist and common criminals will continue to expose this nation to compassionate annihilation. It has made a mockery of the Constitution and the Rule of Law, which tried and convicted Lt. Behenna. If not changed, it will eventually increase the jeopardy of our troops in combat, and transform our military into an emotional half-way house.

I feel the need to correct you in this article. 1 LT Behenna did not kill the insurgent on the battlefield. In truth, He and his SSG were ordered to release the prisoner after questioning, and on their own, they decided to interrogate him again. There were 4 people present…1 LT Behenna, the SSG, the interpreter, and the insurgent. Only 3 of these people can tell you what happened next because the insurgent was killed during this interrogation. I’m just saying, what you wrote is misleading. The insurgent was unarmed, and they had stripped his clothes off him during the interrogation. If you want the full complete story, google Michael Behenna as many articles have been written about it. I know…my son served in Iraq with 1 LT Behenna. In the article, you will read that this all starts with an MRAP hitting an IED. That MRAP was driven by my son, and he was the only one of his team to come out of that incident unharmed. All the rest were killed or seriously injured. My son and the other men of 5th platoon, however, were not present at the killing of this insurgent. As to Michael Behenna’s innocence or guilt…I do not know. There are many unanswered questions in my mind about some of the evidence and the behavior of the 1 LT and his SSG involved after the fact.

As a veteran who spent 6 months in Iraq and Saudi Arabia I have to say any government, any president, and any judges who voted agrees with this decision, the 3 judges who upheld it, your lives are not worth defending. Let your Liberalism and gun control laws defend you, you can defend yourselves and go to hell for all I care.

Whatever happened DOESNT MATTER – they are in a ‘War zone’ and the man that is dead is a ‘wanted dead or alive’ “terrorist”! All that matter is that OUR guys look out for each other, accomplish their mission and come home safe IF they can. You DO know what that ‘terrorist’ would have done to your son or the LT if THEY had been captured??

I’ve spent 10 years in the Special Forces served under 4 Presidents Nixon, Ford, Carter and President Ronald Reagan I always thought that Carter was the worst until obama came a long!!!! This man Has To GO in Nov If we give him 4 more years then we are STUPID America!! I never ran to Canada during the draft I did my time, But if obama wins you might see a lot of people moving. @Sharon Sutten: My post was not intended to point any fingers. I totally agree our country and military leadership is screwed up. I have 2 sons in infantry and know as well as any military mother what our soldiers are dealing with. I also do not have any doubt this insurgent was guilty of setting off the IED that almost killed my own son. You miss the point of what I posted. THE POINT is that if you are going to report on stories like this…please be accurate. This insurgent WAS NOT KILLED ON THE BATTLEFIELD, but under questionable circumstances where orders were disobeyed by this 1 LT. He also put the rest of his entire platoon at risk by ORDERING them to lie to the investigators. There are things I know about this situation that you do not. If this indeed was self-defense…why hide everything and burn the body? On the other hand…this platoon had suffered a huge loss with that IED, and they should not have been the ones to interrogate this insurgent. In the end, everyone loses here. But worst of all, our soldiers are pretty much between a rock and a hard place, a no-win situation.

He should be getting a medal; instead he is treated like a criminal. This is the USA of the 21st century…how sad is that? We need to get the worst president in US history out of office this November, and turn around the asinine policies of the liberal left. Congress is worthless, the Supreme Court for the most part is, and the Executive branch is beyond incompetent. Time to make some real “change” and soon…or we are soon to be another third world garbage heap.

so whats the answer for those in uinform or those thinking about joining? ask yourself first, do you believe your doing the job you swore under oath to defend the Constitution is being upheld? if not….get th f@$ k out ! do not enlist! when we have a commander in chief who upholds the Constitution, then enlist. i am retired 20 yrs service so i can say this with clear conscious.
