Let me make this perfectly clear. I will never sacrifice my freedom so as not to offend savages. And neither should any other American. The MTA may have injected an ambigous, unconstitutional, and thoroughly reckless revision into their ad policy in order to appease a lawless mob, but it will not stand.

And where were these same gutless cowards protesting against fascists and enemedia tools when the anti-Israel ads were running? Their ugly anti-semitic bias is painfully obvious.

Here is the bottom line. Whatever capitulation the MTA is hoping to make to the sharia, the fact is that our ads are running, and based on this new ruling, I intend to expand and increase my New York buy.

And the message the MTA is sending is that if you don't like something — riot, destroy, attack, spray paint innocent people with toxic paint, and you, too, can impose your barbaric agenda on civilized people.

The epic battle between American Freedom Defense
Initiative executive director and blogger Pamela Geller and
The Metropolitan Transportation Authority (MTA) culminated with a court
decision that forced the transit authority to permit the display of
controversial ads about radical Islam
. But the story didn’t end there.
As TheBlaze reported this morning,
Geller’s case caused the MTA to rethink the manner in which it handles
First Amendment issues, leading to the adoption of some
potentially-controversial measures.

On Friday, TheBlaze spoke with a spokesperson who confirmed some of
the details surrounding the case, while clarifying the new changes that
passed on Thursday. As noted, one of the emergent provisions that was
added into the public company’s advertising standards in the wake of the
Geller debate allows the MTA to deny ads it believes could incite
violence (this was not mentioned in the press release the agency put out about the changes).

As previously noted,
a document, reflecting yesterday’s changes, was provided by the MTA to
TheBlaze this morning. It highlights the transit authority’s advertising
standards and reads, in part, “The licensee (‘advertising contractor’)
shall not display or maintain any advertisement that falls within one or
more of the following categories.” One of the category sections reads:

The advertisement, or any information contained in it, is
directly adverse to the commercial or administrative interests of the
MTA or is harmful to the morale of MTA employees or contains
material the display of which the MTA reasonably foresees would incite
or provoke violence or other immediate breach of the peace, and so harm,
disrupt, or interfere with safe, efficient, and orderly transit
operations.

It is the portion presented in bold that is new to the regulations.
It’s inclusion is interesting for a number of reasons. On the surface,
it appears oddly placed in the list of grievances that could lead to the
banning of an advertisement. Furthermore, there is some ambiguity
regarding what led to the inclusion of the “violence” reference in the
first place.

In an e-mail reply, MTA spokesperson Aaron Donovan told TheBlaze that
the change was among the “outstanding issues” that the agency was
looking to tackle in the new regulatory document.

“Since we hadn’t updated our advertising standards in 15 years, we
used this opportunity to address several outstanding issues or potential
hypothetical situations,” he wrote. “This is one of them.”

TheBlaze responded with additional questions about the motivations
for the change, asking how, in particular, the MTA’s court battle with
Geller impacted the new restriction on violent ads. Donovan responded,
admitting that the dilemma did play an integral role in the decision to
make the change.

“The ad, and more specifically the litigation surrounding it, caused
us to think about a variety of potential scenarios and review our
standards more carefully within a prism of First Amendment law,” he
commented.

Considering that the MTA has made its opposition to the ad’s message
known in the past — and taking into account continued calls for bans on
blasphemy and offensive messages — the natural question is: Will this
new regulation serve as a backdoor method for banning controversial ads
that take aim at specific faiths, like Islam?

To gain a better perspective, TheBlaze asked who would be involved in
the process of defining which messages incite violence and what the
metrics for doing so would be.

“It would go through the same process we currently use to determine
whether ads meet the overall guidelines,” Donovan explained. “Ads are
submitted to our advertising contractor, CBS Outdoor, for posting and
approval.”

Once the ads are submitted, Donovan said that CBS then decides which
ones need to be scrutinized more closely to ensure they meet guidelines.
Considering the other MTA regulation that was adopted on Thursday — the
requirement that political, religious and morality-based ads include a
disclaimer separating their ideals from the agency’s — the spokesperson
said that CBS would also be involved in flagging ads for that purpose.

“The MTA’s final determination is made by the MTA’s Director of Real
Estate, in consultation with CBS Outdoor (our ad contractor), the MTA’s
General Counsel, the Chairman, and others he may choose to consult
with,” he continued, highlighting how potentially-violent ads will be
assessed.

Still, considering these elements, the issue needs further
exploration. The language seems fluid enough to present further
First Amendment battles in the future — especially considering the
guidelines’ subjective nature.

I would like to make two points about the MTA's new rule:

1) With this rule, the MTA is allowing ads criticizing groups of people that probably will not commit violent acts, as a result of said ads. So, public criticism of the most dangerous ideologies/ behaviors/ groups will not be allowed. These are the groups that most deserve public scrutiny and criticism.

2)The MTA is acknowledging the truth, in this case, that jihadists are likely to become violent. Are they also making a "racist" statement with this new rule, as Ms. Gellar is accused of doing? Just what are they admitting? Apparently, they are afraid of acts of savagery being committed. But, I thought jihad was a peaceful, inner struggle.

On the face of it, it seems some Eunchs running a public body have deceided that THEY cannot be trusted to perform their duty to the public in supporting free speach

It sounds like alot of double talk to me. It was already proven that they can’t ban an add that is offensive and incites violence, because this ad was allowed to go up whether the MTA wanted it or not. That kind of makes their new policies a moot point. You are allowed to have free speech, that is what the judge’s ruling said.
The MTA is trying to play pussy foot with the law. Anything that offends the morale of their employees can be banned. That could be just about anything. That could be a fat lady saying the picture of a thin model gives her low self esteem. That could be a poor rail conductor or a janitor saying that the pictures of taking vacations to Europe make them feel left out.
I have never heard of such a thing as that you can never offend anyone. This is like living in a twiltight zone. You then would have to walk on eggshells your whole life trying not to to be unpleasant. I thought NYC was for tough people who can deal with people from many cultures. That entails accepting what they don’t like and what they do like, accepting differences and conflicts and rolling with them instead of spraying them out of existence.
They are trying to turn NYC into some sanitized corporate Disneyland and I am sick of it. It doesn’t feel like NYC of the people any more, it feels like some tourist trap of commerical come ons that is fake and shallow and in the end brutal.
I thought people went to NYC to be shocked, offended and suprised by things. Now it will be just like another giant strip mall in the suburbs, everything guided by corporate policy, and no real life left in the people or environment.
Everything that made NYC fun is being stripped away. I am starting to hate it.

@pdxnag – What race are you referring to? Since I assume you are talking about Jihad loving muslims, last time I checked they come from many ethnicities(races) and nationalities. So therefore I come to the obvious conclusion that muslim is not a race. It is at best a political ideology, one that frequently plays it’s “race” and victimhood card, while simultaneously speaking out of the other side of their mouth and screaming Death to America and Death to Israel! We are not screaming death to you, we just want you to stop threatening us and our friends and go back to your own sandbox! “Hani” and other Muslims who threaten anyone is really pushing it. If Muslims continue their threats against people they may just meet their own end. People are becoming extremely agitated about the Muslim problems in society that they deal with almost on a daily basis. They are agitated and frustrated because they feel nothing is being done, and the crimes are not being dealt with properly. They are also getting agitated that the leadership is allowing the continued import of these people while they want larger numbers deported. I’ve talked to police a few times to ask their stance on this issue and they have expressed concerned that violent attacks against Muslims will start taking place in the near future, due to this frustration originating from poor political leadership which the police is unable to do anything about.

There is so much oil and gas in the world it is not neccessary to buy from them to keep them in this state of unheard of wealth and luxury!!!

Pam, quick suggestion: Insert the words “Support Free Speech” in between “Support Israel” and “Defeat Jihad” and put the ad on t-shirts. I think you would sell a ton of them (I’d certainly buy one!) and give the message some legs 🙂

Have you and/or David Yerushalami ever considered prosecution under USC (Title 18) Sec. 242 or 243 if MTA tries to remove your posters? I think it might be a good idea. If fear is to be the deciding argument here, then maybe you and David Yerushalami should have a piece of the action. A title 18 242 and/or 243 prosecution, then a civil lawsuit would send that message effectively.

The MTA needs to fire their attorney. ‘reasonably foresee would incite or provoke violence or other immediate breach of the peace…’ That is so vague and so subjective, it would never survive litigation. What if I submitted an ad making fun of PETA and the MTA decided they ‘reasonably foresee’ the animal rights group PETA may protest my ad thus beaching the peace, would that be OK. The MTA once again turns their brains off and the courts will force them to get a clue. They would have been smarter to just ban all nonprofit ads as stupid as that would be rather than now create confusion and unconstitutional subjectivity. Hmmmm, sounds a lot like the case they just lost!

I knew one local gas seller who wouldn’t buy mideast oil. He only bought from Venezuela. I used to pay more for his gas for that reason. Maybe one way to get back at these people is to stop supporting their oil profits. Boycott buying their gas, take trains and busses, walk and ride bikes, stay home, whatever you can do to stop giving them profits for jihad.
I think the big corporate oil companies get most of their gas from the mideast. I usually buy from small chains because the prices are much better anyway. I also go where the gas pumpers are pleasant and not mean spiteful jihaidi looking people.
I had one rude guy tell me off for not saying thank you to him after all of his surly manners. I told him off and I won’t even look at that gas station again, let alone give them money. Go whre the people act like they even like Americans, that would be a good sign.

As usual, situation Kafkaesque: Pam’s signs opposing an ideology of violence have been rejected for ‘inciting’ violence, which is to say by opposing the incitement of violence. Jihad is an entire doctrine of supporting and funding violence.
Fighting words has just given a heckler’s veto to the angriest most unreasonable and totalitarian theocrats on the face of the earth. Sharia has rules for everything. NYMTA will have a lot of new rules to write in the coming years, everything from covering women in ads to no seeing eye dogs on trains.

The language of the MTA said:
The Metropolitan Transportation Authority approved new guidelines for advertisements on Thursday, prohibiting those that it “reasonably foresees would imminently incite or provoke violence or other immediate breach of the peace.”
In order to “incite or provoke violence” the ad itself must call for violence against a group or an individual. For example, if an ad said “Kill White People” that would “incite or provoke violence” against white people. However, if the ad was an ad that merely said something that someone disagrees with and that person responds with violence then the ad had not “incited or provoked violence”. For example, if an ad said “Repeal Obamacare” and someone reacted violently to that ad then the ad has not “incited or provoked violence”.
Pamela Gellar’s ad did not call for violence against a group or individual and therefore, does NOT “incite or provoke violence”.

Despite Pamela’s initial positive response to the MTA’s decision to put a disclaimer on advertisement something in me felt that they were still in some way punishing Pamela and our ads. Where was the disclaimers when the anti-Israel ads were up? Nowhere! I thought isn’t this the same thing the San Francisco bus line did? How can this be seen as a victory. It’s very obvious that they are cowering and fear the riots, mobs and the threats of violence.
I hope when Pamela’s sues the MTA she can get some money out of it so MORE ads can be displayed. Then perhaps these bastards will find out that they should not mess with Pamela Geller, America and the First Amendment.

So let me get this straight.
Miss Geller, and I have an argument, and she wins. The next day, while ruminating about that argument, I become so enraged that I go to a Mall, and start killing people with my AK-47.
When the police finally arrest me, I can tell them that it is all Pam Geller’s fault. Because she had no business being so clever, and smart enough to win our argument.
And she’s a racist.
And so they will let me go. And then they will go, and arrest Miss Geller instead.

The more legal support for Pamela (and America) the better. This is the greatest cause of the 21st Century. A matter of life or death for the United States of America. Resnick, who is handling the case, stated that the defendant, a New Jersey resident and former Wegmans employee, is accused of sending threats to kill and murder both the chief executive officer and the president of Wegmans. The threats were sent over the Internet from a fictitious e-mail account from a library in New Jersey. The fictitious e-mail account was in the name of the defendant’s former supervisor at Wegmans, who had been involved in the defendant’s termination from Wegmans in 2005.
A date for the defendant’s arraignment on the charges has not yet been scheduled.
The indictment is the culmination of an investigation on the part of special agents of the Federal Bureau of Investigation Cyber Crimes Task Force, under the direction of Special Agent in Charge Christopher M. Piehota; Cyber Crimes Task Force officers from the Monroe County Sheriff’s Office, under the direction of Sheriff Patrick O’Flynn; and the Rochester Police Department, under the direction of Chief James Shephard.

If they’re going to ban ads that “incite violence,” they’d best not be putting up the ISLAM ads all over the place, since it is ISLAM that incites violence.

BillyBoy, that guy obviously isn’t Muslim, otherwise, he wouldn’t have been prosecuted. Muslim death threats are protected by the First Amendment, whereas everyone else’s death threats are not. And our objections to the Muslim death threats are also not protected.
So, Muslims exercising their “freedom of expression” rights can threaten and commit murder – is not murder an “expression?” – while we are not allowed our free-speech rights to expose or object to those deadly threats and acts.

If the MTA is an organization that is funded by US tax dollars are they allowed to circumvent Consitutional rights by fiat? Because I thought all government entities (whether state, local or federal) had to comply with Constitutionally guaranteed rights, despite the corruption and apathetic amorality of their officials.

There are a critical mass of people fed up with pandering to the savage including the Zero in the White House who violates the U.S. Constitulion, the highest legal authority.
